Ellen is not named as a minor child in her mother's will, but is younger than her married sister, Ann, born c. 1705. She may have been born later than 1707.

No bequests; standard form will; executors son James Winnard and son-in-law James Gerard; names wife Mary beneficiary during her lifetime; at her death to be divided into 4 parts, for sons William and James, daughter Alice wife of Jas Gerard, and the children of "my late daughter Catherine the wife of Thos Perry. Designated on will as "yeoman"; this probably means he had a freehold title to some property. Does not describe any such property but mentions rentals, and profits from leasehold, ground rent, etc.

QSP/1103: FILE - Bickerstaffe and Samlesbury - bastardy of Jane Swift and Hugh Heatley, yeoman. - ref. QSP/1103/1 - date: c1716 C__ Lancr: "Foreasmuch as it appears unto us upon complt. of the Overseers of the Poor of the township of Bickerstaffe in the said county that Jane Swift of Bickerstaffe aforesaid spinster was lately delivered of a male bastard child called Hugh, which is likely to become chargeable to Bickerstaffe aforesaid; and that as well upon the information upon Oath of the said Jane Swift that Hugh Heatley of Samlesbury in the said County, yeoman, is the father of the child; and alsoe upon Oath of Mrs. Gill midwife who was present at her delivery of the said bastard child and in her Extremity saith that she then declared the said Hugh Heatley was the only father of the said bastard child. Wee therefore whose hands and seales are upon hereunder subscribed , two of his Mag'sties Justices of the Peace and Quor__ and for the said County doe hereby adjudge and declare the said Hugh Heatley to be the putative father of the said bastard child and that the same is likely to become chargeable to Bickerstaffe aforesaid and doe hereby order the said Hugh Heatley to pay or cause to be paid to the said Jane Swift the mother, for and towards the charges for Lying In, the sume of thirty shillings; and to pay or cause to be paid unto the churchwarden & overeseers of the poor of Bickerstaffe for and towards the maintenance of the said bastard child the summe of forty shillings p Annum to be paid by four qurarterly paym'ts from the birth of the said child which was on the seventeenth day of this last? September while the said child attain to the age of fourteen years or whilst it shall be chargeable to Bickerstaffe aforesaid; and lastly we do hereby order that the said Hugh Heatley doe upon notice of this order or a true coppy hereof give sufficient security to the Churchwarden and overseers of the Poor of Bickerstaffe well and truly to indemnify the said Town'p from the said bastard child . Earl of Derby...and Thomas Marsh of Rainford...shoemaker...in consideration of the surrender of one indenture of lease of the premises hereinafter mentioned (RN 146) bearing date 26 Aug. 1772 - and was granted unto the said Thomas Marsh for the lives of Jacob Mather, Margaret Mather and Thomas the son of the said Thomas Marsh. Whereas Thomas Marsh the younger is now living; and also of the surrender of one other indenture of of unimproved moss ground (RN 139) hereinafter mentioned as being the life of John Mather. And also of the sum of 50 pds paid by the said Thomas Marsh. QSP/1685/10 - date: 1753 22 May Abstract: Complaint being made...to us...Justices of the Peace...BY the churchwardens and overseers of the poor of the township of Pemberton...that Joseph Ashurst *Jane* his wife and Betty and Peggy their children, poor persons and now actually chargeable to Pemberton...lately come to reside there and do not farm 10 pds a year, neither have done or performed any other matter or thing whereby they have gained any legal settlement there. Now upon hearing the said complaint...and a full hearing of the defence by the Overseers of the poor of ...Orrell...we do adjudge the said complaint to be true...and declare the said Joseph Ashurst (etc) to be poor and now actually chargeable to Pemberton aforesaid and that their last legal settlement was in Orrell...(we) require (the overseers of poor of Pemberton) to remove and convey said Joseph Ashurst (etc) and them deliver to the churchwardens or overseers of the poor of Orrell (who) are likewise hereby required to receive and provide for them...herein fail not at your Peril. 22 May 1753. signed J. Property ("living and tenement") held as granted under the "hand and pease" (obscure) of Nicolas (Grequishand?) given to three sons, George (oldest), Richard and William (youngest), "my natural children"; all minors. Remaining estate divided into 3 parts, wife Alice receiving two parts, one being "the portion of grounde lyeing in Eccleshill by estimation foure acres or thereabouts being part of the tenement of Thomas Baron I give unto Alice my wife all my right, interest and title and by indenture of lease...??may appear. " Executors and guardians of children: Thomas Boulton of ---elle, husb.; Richard Foole of Livesay. Inventory is brief and hard to read; apparently, livestock, oats and barley comprise most of it. Debtors and creditors somewhat confused. Value not deciphered. At the end of the written will the phrase "common law" has been written in another hand. The will is consistent with parish register data re the birth of the children and death of first wife in 1629. Apparently there were no children from the second marriage and perhaps the phrase "common law" refers to this marriage? Possibly Thomas Boulton was an uncle of the children. Richard Fool is probably John's brother. In the Name of God Amen on the eighth day of September 1591...I William Chadocke? of Bickerstaffe...do make this my last will and testament in manner and forme following...I bequeath...the hands of almighty god my saviour...burial...unto that place (that) my parent and other wyfe? was buried thence. Also my mynd and will is that all my ? notably and ?...be equally divided into three...unto myself to be bestowed...as allocated. Between Richard Urmeston, Thomas Pendibery, John Edge, the younger, and John Holme, plaintiffs and Richard Harflynche deforciant of 2 messuages, 23 a. of land, 6 a. of meadow, and 8 a. of pasture in Wyndill (Windle). Richard Harflynche acknowledged one messuage, 10 a. of land, 2 a. of meadow, and 8 a. of pasture of the said tenements to be the right of the said Richard Urmeston, and remitted all right to the plaintiffs and to the heirs of the said Richard. Moreover, Richard Harflynche granted that one other messuage, 8 a. of land and 2 a. of meadow of the said tenements which Alice Stele, late the wife of Peter Harflynche, held for the term of her life; and that 5 a. of land and 2 a. of meadow, the residue of the said tenements which Roger Harflynche held for the term of his life after the decease of the said Alice and Roger should remain to the plaintiffs and to the heirs of the said Richard Urmeston, for which Richard Urmeston gave him 40 pds. 1510-1558; probably 1527 (see citation 1).
