Whereas complaint hath this Day been made [to] the Overseers of the Poor of the Township of Standish with Langtree in the said Parish that *Betty Arkwright of the said Township, single woman, was about six years and forty seven weeks ago delivered of a male bastard child in the same Township which is since christened by the Name of Peter and is now alive... that John Greenough of Ince in Makerfield in the said County Whitster is the true and only Father of the said Bastard Child, who hath been duly summoned to appear before us...NOW we the said Justices...declare and adjudge the said John Greenough to be the reputed Father of the said Bastard-Child...do order that he the said John Greenough shall and do forthwith pay, or cause to be paid, unto the Overseers of the Poor of the Township of Standish with Langtree, or some of them, the sum of Three pounds six shillings... and also that the said John Greenough shall and do pay, or cause to paid unto the Overseers of the Township of Standish with Langtree...Given under our Hands and Seals, this eighth Day of July in the Year of our Lord 1791.

Full text: Whereas complaint hath been made unto us, two of his Majesty's Justices of the Peace and Quorum in and for the County of Lancaster,and residing next unto the limits of the Parish Church of Standish with Langtree in the Parish of Standish with Langtree Co.Lancs by the Church-Wardens and Overseers of the Poor of the Township of Standish with Langtree in the Parish and County aforesaid that Cicely Arkwright *of Pemberton* in the said County, single woman, hath lately been delivered of a female Bastard Child *in the Township of Pemberton* which is yet living and chargeable to the said Township of Standish with Langtree. And whereas the said Cicely Arkwright this Day came voluntarily and of her own free Will and Accord before us, and then and there uher Examination upon Oath did declare, that she the said Cicely Arkwright was *about three Weeks ago, delivered of a female Bastard Child, in the said Township of Pemberton which hath been since christened by the Name of Elizabeth and that the said Child was born a Bastard in the said Township of Pemberton *during the Residence of its said Mother, the said Cicely Arkwright therein, under the Authority of a *Certificate from the Overseers of the Township of Standish with Langtree aforesaid, owning her to be *legally settled there, and that and that the legal Settlement of her the said Cicely Arkwright being at the Birth of the said Child in the said Township of Standish with Langtree the said child has the same Settlement, and is now living, a
heretofore hath been and still is chargeable to the said Township of Standish with Langtree and likely so to continue: and that John Leyland of *Pemberton in the said County, Weaver beget the said Child on her Body, and is the father of the same. And whereas the said John Leyland hath been duly summoned to appear before us the said Justices, to the End that upon the Examination of the Cause and Circumstances of the Premises, we might take such Order as to Right doth appertain; and hath not appeared before us nor shewed any sufficient Cause why he should not be adjudged the reputed Father of the said Bastard Child.

We therefore the said Justices, upon due Examination and Consideration of the Premises as well as upon the Oath of the said Cicely Arkwright do hereby declare and adjudge that the said Child was born a Bastard upon the Body of the said Cicely Arkwright in the said Township of Pemberton and now is living, and heretofore hath been and still is chargeable to the said Township of Standish with Langtreee and that the said John Leyland is the Father of the said Bastard Child. Thereupon we ordain as well for the better Relief of the said Township of Standish with Langtree as for the Sustentation and Relief of the said Bastard Child, that the said John Leyland shall and do forthwith upon the Notice of this our Order pay, or cause to to be paid unto the Church-Wardens and Overseers of the Poor of the said Township of Standish with Langtree, or some of them, the Sum of one pound ten shillings for and towards the Charges and Expenses incident to the Birth of the said Bastard Child, and the Maintenance of the said Bastard Child, from the time of its Birth, to the time of making this our Order, and the sum of sixteen shillings for and towards the Costs of this Order and Filiation; such Charges, Expenses, Costs and Sums of Money respectively having been duly ascertained upon Oath before us the said Justices to be reasonable. And we do likewise hereby further order, that the said John Leyland shall well and truly pay, or cause to be paid, unto the Church-Wardens and Oversee of the Poor of the Township of Standish with Langtree, or to some of them, 1/6 weekly and every Week from this present Time, for and during so long Time as the said Bastard Child shall be chargeable to the said Township of Standish with Langtree for and towards the Relief and Keeping of the same Bastard Child;and also that she the said Cicely Arkwright shall and do pay, or cause to be paid, unto the Church-Wardens and Overseers of the Poor of the said Township of Standish with Langtree for the
Time being, or some of them, 1/6 weekly and every Week, so long as the said Bastard Child shall be chargeable to the said Township of Standish with Langtree.

hath not appeared nor shown any sufficient Cause why the said Child shall not
be filiated upon him.

NOW we the said Justices, upon hearing the said Complaint upon Oath, do hereby
declare and adjudge the same to be true, and do also as well upon Examination
of the Cause and Circumstance of the Premises, upon the Oath of the said Betty
Arkwright as otherwise, declare and adjudge the said John Greenough to be the
reputed Father of the said Bastard-Child and thereupon, as well for the better
Relief of the said Township of Standish with Langtree as for the Keeping and
Relief of the said Bastard-Child do order that he the said John Greenough shall
and do forthwith pay, or cause to be paid, unto the Overseers of the Poor of
the Township of Standish with Langtree, or some of them, the sum of Three
pounds six shillings which they have expended and been put unto by Reason and
on Account of the said *Betty Arkwright's Lying-in, and in *maintaining of the
said Bastard-child to the Time of the Making of this our Order; and also that
the said John Greenough shall and do pay, or cause to

paid unto the Overseers of the Township of Standish with Langtree aforesaid for
the Time being, or some of them one shilling in Money, weekly and every Week
from this present Time, for and during so long as the said Bastard Child shall
be chargeable the same Township, for and towards the Relief and Keeping of the
same Bastard Child;and also that she the said Betty Arkwright shall and do pay,
or cause to be paid, unto the Overseers of the Poor of the said Township of
Standish with Langtree for the Time being, or some of them, one shilling in

Complaint being made...to us...Justices of the Peace...BY the churchwardens and overseers of the poor of the township of Pemberton...that Joseph Ashurst *Jane* his wife and Betty and Peggy their children, poor persons and now actually chargeable to Pemberton...lately come to reside there and do not farm 10 pds a year, neither have done or performed any other matter or thing whereby they have gained any legal settlement there. Now upon hearing the said complaint...and a full hearing of the defence by the Overseers of the poor of ...Orrell...we do adjudge the said complaint to be true...and declare the said Joseph Ashurst (etc) to be poor and now actually chargeable to Pemberton aforesaid and that their last legal settlement was in Orrell...(we) require (the overseers of poor of Pemberton) to remove and convey said Joseph Ashurst (etc) and them deliver to the churchwardens or overseers of the poor of Orrell (who) are likewise hereby required to receive and provide for them...herein fail not at your Peril. 22 May 1753. signed J. Body but of sound and perfect mind and memory praise be therefore
Given to Almighty God, to make and ordain this my Last Will
And Testament In manner following.
First and principally I comend my soul into the hands of Almighty
Tgod hopeing for pardon for all my sins by the mor? Death
And passion of my saviour and redeemer Jesus Christ
And my body I comitt to the earth desently to be interred at the
Discreshion of my Executris. Hereafter named and all that
Temporall estate wherewith it hath pleased Almighty God to bless
Me, I give devise and bequeath the same in manner following
First that all my debts if any such there be (funerall expenses

then whereas my son-in-law James Marsh now standeth in debted to me the sum_

Then I give and bequeath to my son Nehemiah Ashurst the sum of thirty

Thomas Blackhurst appears 12 times in this calendar between 1659 and 1683, twice when appointed as a "gate waiter" and 10 times for various misdemeanors such as assault, abuse, playing bowls on Sunday, letting his swine wander, etc.

Robert Caddick appears in land transactions in Bickerstaffe in 1606, 1628; he was probably the heir, and the name that is not found in this photocopy due to cropping.

Adam Eccles alias Cliff, in 1717, as a "Papist" registered an estate for the lives of Thomas, Ellen and Ann Cliff, his children; Eng. Catholic Non-Jurors, 98. p 373 vol iii.

Mary, born to Frances Ashurst, was designated as Fairhurst in the 1851 Census although she was Mary Ashurst in 1841 and at birth.

2. After extensive research for alternate explanations, I have concluded that Elizabeth HART was Elizabeth HOWARD, daughter of Robert Howard and Margaret Cave Howard. Since she was not really "of this parish" (Wigan) so would be unknown to the clerk, and did not sign the register, her surname was written as the clerk heard it. .

Property ("living and tenement") held as granted under the "hand and pease" (obscure) of Nicolas (Grequishand?) given to three sons, George (oldest), Richard and William (youngest), "my natural children"; all minors.
Remaining estate divided into 3 parts, wife Alice receiving two parts, one being "the portion of grounde lyeing in Eccleshill by estimation foure acres or thereabouts being part of the tenement of Thomas Baron I give unto Alice my wife all my right, interest and title and by indenture of lease...??may appear.

Inventory is brief and hard to read; apparently, livestock, oats and barley comprise most of it. Debtors and creditors somewhat confused.
Value not deciphered.
At the end of the written will the phrase "common law" has been written in another hand.
The will is consistent with parish register data re the birth of the children and death of first wife in 1629. Apparently there were no children from the second marriage and perhaps the phrase "common law" refers to this marriage? Possibly Thomas Boulton was an uncle of the children. Richard Fool is probably John's brother. Text of Will:

In Ye name of God Amen I John Ffoole of Eccleshill in ye County of Lancaster husbandman being in my perfect ...? health and remembrance and (admittinge?) ye ffrayltie of this world and how certain death is to everie man therefore my will and minde is to set in order and dispose of all my estate as followeth: Suprimis, for ye estate that is (?hand a lease?) to and granted under ye (hand Pease?) of Nicolas (Gregishand?) of Clayton, Esqu., as by my lease will appeare I give my whole estate, interest and title after my decease to my three sonnes namely George, Richard and William my natural children.
And for
ye onely use of unto and of them equally, the issues and proffitts cominge, growing and arising to bee divided amongste them Untill William my youngest sonne accomplish the full age of eighteen years provided (word crossed out).
My will and mind is that if it fortune George Ffoole my eldest sonne to live to ye expiration of ye foresaid eighteen years of age, sayd George shall give unto Richard Ffoole and William Ffoole his natural brothers either of them the sume of thirty pounds of lawful English money if then the said Richard and William bee then livinge. And if it fortune that either of them be then dead shall give unto the survivor the summe of forty pounds. And if it shall fortune that George my eldeste sonne to dye then mind I that my livinge and tenement to remaine to Richard my second sonne (?glaer..nger) unto William his brother the somme of forty pound. And if it fortune that Richard dye then my whole estate to remaine to William my youngest sonne during the time then unexppired. Then for my worldly goods after my funeral expenses..? I divide into three parts. One third part to remaine to Alice my wife. Ye yet second third part to my three sonnes equally and wish that then the third and last part being my owne to Alice my wife as the portion of grounde lyeing in Eccleshill by estimation foure acres or thereabouts being part of tenement of Thomas Baron I give unto Alice my wife all my right, interest and title. And by indenture of lease to ? ? will and may appeare. Then further my will and mind is that Thomas Boulton of M:?helle in ye county of Lancs husbandman and Richard Ffoole of Livesay of ye sayd county husbandman that ye shall have ye education and bringing up of my children with ye possession of the tenement beforementioned for the onely use and behalfe of ye foresayd children during ye sayd terme beforementioned, and further I make Thomas Boulton and Richard Ffoole my lawful Executors in hope they will see this my last will and testament performed and my special trust is in them.

*NOTES: Sir Nicholas Shireburne, of Stonyhurst: this family had been noted as papists and recusants since at least 1678. Sir Nicholas, the last Shireburne, died in 1718, his estate passing to his daughter Mary, duchess of Norfolk...then to William Weld of Lulworth in Dorset.
