This is the last Will and Testament of me William Rylance Smith of Birmingham in the County of Warwick Agent and Collector by which I mean to dispose of all my wordly estate.
I give, devise, and bequeath unto my son William Handasyd Smith and my daughter Charlotte Smith whom I hereby appoint my Executor and Executrix all my freehold and leasehold messuages, buildings, lands, hereditaments and premises with their respective appurtenances situate in the parish of Harborne in the county of Stafford and in the Borough of Birmingham or elsewhere in England. And also all monies, securities for money, ground rents and all other my Personal Estate, property and effects whatsoever and wheresoever and of what nature or kind soever which I shall be possessed of, interested in or entitled to at the time of my decease to hold all and singular my said real and personal estates to them my said trustees, their heirs, executors, administrators and assigns according to the different natures or tenures of the same estates and property respectively upon the trusts hereinafter declared concerning[?] the same (that is to say).
Upon trust that they my said trustees or the survivor of them, his or her heirs, executors and administrators do and shall at such convenient time or times after my decease as they shall judge proper absolutely sell, dispose of and convert into money all my real estates and such parts of my personal estate and other property as shall not consist of money or securities for money either by public auction or private contract and either together or in parcels as they my said trustees or the survivor of them shall think proper and do and shall call in and receive all such debts and sums of money as shall be then out and owing to my estate. And I do hereby declare that upon payment of the monies arising from such sale or sales it shall be lawful for my said trustees and the survivor of them and the executors and administrators of such survivor to give and sign any receipt or receipts for the same and which receipts when so given and signed shall be good and sufficient discharge to any purchaser or purchasers or other person or persons paying any purchase or other monies and his, her and their heirs, executors and administrators for so much[?] as in such receipt or receipts shall be expressed to be received. And that such purchaser or purchasers or other person or persons paying any such purchase or other monies as aforesaid and his, her and their respective heirs, executors, administrators or assigns shall not afterwards be obliged to see to the application or be answerable or accountable for any loss, misapplication or nonapplication thereof or any part thereof.
And upon further trust that they my said trustees do and shall by and out of the monies to arise by such sale or sales and from the collection and receipt of my said personal estate (after payment of all my just debts, funeral and testamentary expenses) pay the following legacies (that is to say).
To my said son William Handasyd Smith fifty pounds and to my said daughter Charlotte Smith fifty pounds which I hereby give and bequeath to them for their own use.
And as to and concerning all the rest, residue and remainder of the said trust monies arising from such sale or sales as aforesaid and from all other my personal estate, property and effects of what nature or kind soever upon trust that they my said trustees and the survivor of them and the executors and administrators of such survivor do and shall as soon as conveniently may be after my decease divide the same into four equal parts or shares.
And do or shall pay one of such fourth parts or shares unto my said son William Handasyd Smith for his own use and disposal and to whom I hereby give and bequeath the same accordingly.
And do and shall pay one other of such fourth parts or shares unto my said daughter Charlotte Smith for her own use and disposal and to whom I hereby give and bequeath the same accordingly.
And as to one other of such fourth parts or shares upon trust that they my said trustees and the survivor of them and the executors and administrators of such survivor do and shall lay out and invest the same upon Government or good freehold or leasehold security and do and shall from time to time alter and vary the same at their, his or her direction for or into other stocks, funds or securities of the like nature and do and shall pay the interest, dividends and annual income thereof into the proper hands of my daughter Elizabeth the wife of James Jenkins or into the hands of such person as she shall by any note or writing under her hand from time to time appoint to receive the same during her life but not so as to dispose of the same or any part thereof by sale, mortgage, charge, assignment or otherwise in the way of anticipation to the intent that the same may be for the sole and separate use of the said Elizabeth Jenkins and after her decease upon trust that they the said trustees shall stand possessed of and interested in the said last mentioned fourth part or share and the interest, dividends and profits thereof in trust for all and every or such one or more (exclusively of the other) of her issue whether children or grandchildren with such provisions for their respective maintenance, education and advancement and in such shares if more than one and with such restrictions and in such manner as she the said Elizabeth Jenkins shall by deed or will appoint and in default of such appointment and so far as any such (if incomplete) shall not extend in trust for all and every her children to be divided amongst them if more than one in equal shares and if but one the whole to be in trust for such one or only child and in case the said Elizabeth Jenkins shall die without leaving issue of her body then the said trustees for the time being shall stand possessed of and interested in the said fourth part or share in trust for the said James Jenkins if he shall be then living his executors, administrators and assigns but in case he shall be then dead then in trust for such person or persons and for such uses, intents and purposes as the said Elizabeth Jenkins shall by Will or other writing direct or appoint the same and in default of such appointment in trust for the person or persons who at the time of my decease under the statutes made for the distribution of the estates of intestates would be entitled to my personal estate and would be dived between or amongst the same persons respectively in the shares in which the same would be divisable under the same statutes.

And I do declare my will to be that after the decease of either of my said daughters Elizabeth and Caroline my said trustees or the survivor of them his or her executors or administrators shall at his or her discretion pay and apply for or towards the maintenance or education of her or their children where portion or portions under the trust aforesaid shall not then be vested all or any part of the interest or dividends of such his, her or their presumptive[?] portion or portions.
And it is my will and I do direct that my said trustees and executors or either of them shall not be charged or chargeable with any more of the said trust monies or promises than they shall actually receive nor with and for any loss or damage which may happen thereto so as such loss or damage happen without his or her willful default or neglect nor the one of them for the other of them but each of them only for his or her own acts, deeds, receipts and disbursements.
And also that it shall and may be lawful to and for my said trustees and executors in the first place by and out of the said trust property to deduct and reimburse themselves respectively all such loss, costs, charges and expenses as they shall respectively sustain or be put unto in executing the trusts of this my Will.

John Such - Clerks to Mess'rs Palmer & Sons Sol'rs Birm'm /.I William Rylance Smith of Birmingham in the County of Warwick Agent and Collector do make this Codicil to my Will dated the twenty fifth day of June 1842 and do hereby revoke and make void so much of the said Will as relates to the two several one fourth parts or shares of the residue of my estate and effects thereby given in trust for the benefit of my daughters Elizabeth the wife of James Jenkins and Caroline the wife of William Payne respectively and their respective issues and husbands and in lieu thereof do hereby will and direct that the trustees of my said Will and the survivor of them and the executors and administrators of such survivor shall immediately after the division by my said Will directed to be made of my said residuary estate and effects pay over the same two several one fourth parts or shares to my said daughters Elizabeth and Caroline respectively in equal portions for their own absolute use and disposal. And I hereby give and bequeath the same two several one fourth parts or shares to my said daughters Elizabeth and Caroline accordingly and direct and declare that their respective receipts alone notwithstanding coverture shall be good discharges for the same.

William Frederick (Will) GIBSON and his wife Mary Emma (May) WAKELAM emigrated to Canada from Birmingham, England in 1897. Will & May homesteaded in the Blackwood District, Assiniboia, NWT (85km ENE of Regina, Saskatchewan). They were joined in April 1899 by Will's brother Bernard. Initially Will & Bernard learned farming methods from neighbor H.T. (Henry Thomas) SMITH, a respected land owner in the Abernethy area. Note: the Dominion Land Grant for William Frederick Gibson on SW 06-19-10 W2 dated Mar 14, 1902 was registered at the Assiniboia Land Registration District, Regina, on Jun 21, 1902 [image available on microfilm from the National Archives of Canada: Fiat No. 86245, Homestead 68924, Liber 165, Folio 415, File Reel Number C-6063].Will and May christened their farm home "The Wren's Nest" - possibly named after the hill and mine openings (limestone quarries) near Dudley, 12km west of Birmingham. Will was a talented artist, and did many paintings on china. The couple sold their farm in 1952, retiring to live in Sintaluta.
William died on Feb 27, 1957 and May on Jul 15, 1957. They never had any children.

1. I HEREBY revoke all former Wills and Testamentary dispositions made by me and declare this to be my last Will and Testament.
2. I APPOINT Lloyds Bank Limited (hereinafter called "the Bank") to be the Executor and Trustee of this my Will and I declare that the Bank shall be entitled (free of duty) to remuneration such remuneration to be a first charge on my estate and in accordance with the Bank's published terms in force at the date of entering on the trust and may without accounting for any resultant profit act as banker and perform any service on behalf of my estate and on the same terms as would be made with a customer.
3. I GIVE the following legacies and specific bequests:-
(a) To my nephew Donald my presentation silver salver and silver ink-stand.
(b) To my brother Arthur's widow, Kath, antique silver teapot.

ALL THE residue of my estate I give to the Bank upon trust to sell, call in and convert the same into money with power to postpone such said calling in and conversion for so long as they shall think fit and to invest the proceeds and pay the interest thereof and of my unconverted estate (if any) to my wife for her life and I declare that should the income as aforesaid amount to a loss within any one year then Three hundred and fifty pounds they shall in each of such years realise sufficient capital to provide such income of Three hundred and fifty pounds. FURTHERMORE should the Bank be of opinion that my wife requires a greater income in any one year (and this is left to their sole discretion, bearing in mind that my wife's comfort and well being is the first consideration) they may in any one year raise a further sum up to One hundred pounds out of my said capital.
5. UPON THE death of my wife the Bank shall realise the said residue or so such as remains thereof and divide the proceeds equally between:-
(a) Dr. Barnardo's Homes.
(b) The Imperial Cancer Research Fund.

Last Will and Testament of James Tucker CARPENTER, dated Dec 12, 1876 (with Codicils dated Feb 08, 1881 and Dec 29, 1882). Proved in Exeter on May 10, 1883.This is the last Will and Testament of me James Carpenter of Bunkersland in the parish of Tiverton in the County of Devon, Yeoman -
I give and devise All that my Messuage or Tenement Farm and Lands called "Middle Bradley" with its appurtenances situate in the parish of Tiverton aforesaid unto my Son in law John Carpenter and to William Cosway of Tiverton aforesaid Gentleman their heirs and assigns Upon trust that the said John Carpenter and William Cosway or the survivor of them or the executors or administrators of such survivor (hereinafter called my said Trustees or Trustee) shall out of the rents and profits of the said hereditaments and premises pay the annual sum of Fifty pounds to my Daughter Mary Ann the Wife of William Henry Gater during her life and if the said William Henry Gater shall survive his said Wife shall pay the said Annual sum of Fifty pounds to the said William Henry Gater during his life and subject thereto shall pay the residue of the said Rents and Profits to my Son William Baker Carpenter and his assigns during his life and subject to the payment of the said Annuity and to the life interest of the said William Baker Carpenter Upon trust that my said trustees or trustee shall pay or apply the rents and profits of the said last mentioned hereditaments and premises to or for the use of my two Grandsons James Carpenter and William Carpenter Sons of the said William Baker Carpenter equally between them until they shall respectively attain the age of Twenty four years and when and so soon as they shall respectively attain that age then I give and devise the same hereditaments and premises unto and to the use of my said two Grandsons James Carpenter and William Carpenter equally between them as tenants in common but if either of my said two Grandsons shall die under the age of Twenty four years then I give and devise the same hereditaments and premises unto the survivor his heirs and assigns.
I give and devise All that my Messuage or Tenement Farms and Lands called "Higher Withleigh" with its appurtenances situate in the parish of Tiverton aforesaid unto and to the use of my Son James Henry Carpenter his heirs and assigns Subject nevertheless to the payment unto my Executors hereinafter named within three months after my decease of the sum of Seven hundred pounds and any sum which may be due from me on Mortgage or Deposit of the Title Deeds of the said Messuage or Tenement and premises which sum or sums I direct shall form part of my personal Estate and subject also to the payment out of the Rents and Profits of such last mentioned hereditaments and premises of an annuity or annual sum of Fifty pounds to my Daughter Caroline Emily the Wife of the said John Carpenter during her life and if the said John Carpenter shall survive his said Wife then I direct that the said Annuity shall be paid to the said John Carpenter during his life and I direct that the several Annuities hereinbefore given shall be payable half yearly (clear of all deductions except Legacy Duty) and that the first payment thereof shall be made at the expiration of Six months after my decease and that the receipts in writing of such of the Annuitants who are married women shall be a good and sufficient discharge for the same and I declare that no such married woman shall have power to deprive herself of the benefit of such Annuity by way of anticipation. And I declare that the said Annuitants shall have the like power of distress for the recovery of their respective Annuities in case the same shall at any time be in arrear for twenty eight days after the same shall become due as Landlords have for the recovery of rent reserved on a common demise.
I give and devise All that my Messuage or Tenement Farms and Lands called "Lower Withleigh" with its appurtenances situate in the parish of Tiverton aforesaid unto and to the use of my said Daughter Caroline Emily Carpenter her heirs and assigns subject to any Mortgage there may be thereon at the time of my decease.
I give and bequeath to my said Daughter Mary Ann Gater the sum of Two hundred pounds.
I give devise and bequeath All the rest residue and remainder of my real and personal Estate and Effects subject to the payment of my debts funeral and testamentary expenses to my said Son William Baker Carpenter and the said John Carpenter their heirs executors administrators and assigns equally to be divided between them.
And I appoint the said William Baker Carpenter and John Carpenter joint Executors of this my Will. And I give and devise to them their heirs executors administrators and assigns respectively All Estates vested in me upon any trust or by way of Mortgage subject to the equities affecting the same. I declare that the provisions of the Acts of Parliament of the 22 and 23 Victoria Chapter 35 and of the 23 and 24 Victoria Chapter 145 shall be applicable as far as may be to this my Will. I revoke former Wills by me at any time made and declare this to be my last Will and Testament.
