In the Name of God Amen. I Agness Were of Bolham in the parish of Tiverton in the County of Devon Widow being weak in body but of strong mind means and understanding make and appoint this to be my last Will and Testament.

First I resign my Soul into the Hands of Almighty God who gave it and my Body to decent Christian Burial and my Will is that I may be buried at Halberton in the said County of Devon and as to such worldly goods and Effects as it hath pleased God to bless me with I dispose thereof in manner following, that is to say

I give to my son Robert Were the Sum of One Shilling. I give to my daughter Sarah the Sum of Ten Pounds of lawful British money. I give to my daughter Mary the like sum of Ten Pounds and the bed performed that is now in the parlour Chamber. I give to my daughter Dorothy the Sum of Eight Pounds of like lawful money. I give to my daughter Joanna the Sum of Ten Pounds of like lawful money. I give to my daughter Margaret the like Sum of Ten Pounds. I give to my daughter Agness the Sum of eight pounds of like lawful money. I give to my daughter Susannah the Sum of Ten Pounds of like lawful money. I give to my daughter Nancy the Sum of Ten Pounds of like lawful money. I give to my Grand daughter Mary Ann Coles the Daughter of James Coles the Sum of five pounds of like lawful money.

All which said Sums by me hereinbefore given amounting in the whole to the sum of Eighty one pounds and one Shilling I do hereby order and direct shall be paid by my Executor hereinafter named within six months next after my Decease. All the rest residue and remainder of my Goods Chattles and Effects whatsoever not hereinbefore by me given I give the Same to my two Sons Peter Were and John Were to be equally divided between them share and share alike they paying thereout my just Debts and funeral Expences. And I do hereby appoint my said two Sons Peter and John Joint Executors of this my Will hereby revoking all the Wills by me heretofore made and I do declare this to be my last Will and Testament

This is the last Will and Testament of me Margaret Were of Tiverton in the County of Devon Spinster. I give and bequeath unto my sister Nancy Coles of Tiverton aforesaid Widow all my household goods and furniture, plate, linen, china, glass and books and also all my wearing apparel for her own absolute use and benefit. Also I give and bequeath unto my two nephews Henry Were of Farleigh in the Parish of Tiverton aforesaid Yeoman and Benjamin Were of Moorhayes in Tiverton aforesaid Yeoman all my monies and securities for money and all other my real and personal estate and effects whatsoever and wheresoever (except as aforesaid) upon trust to make sale and dispose of my said real and personal estate as shall not then consist of money and to call in and receive all such debts and sums of money as shall be deemed owing to me on mortgage or otherwise and out of the monies to be received thereby shall and will in the first place pay off and discharge my just debts, funeral and testamentary expenses and after payment thereof then upon trust to pay the several legacies hereinafter mentioned (that is to say).

To my brother Robert Were of Bolham in Tiverton aforesaid Gentleman ninteen pounds and ninteen shillings sterling. To the said Nancy Coles the sum of one hundred pounds sterling. To my niece Mary Ann Oakes of No. 6 Waterloo Place, London widow the sum of fifteen pounds sterling. To Benjamin Oakes son of the said Mary Ann Oakes the sum of ten pounds sterling. To Ellen Child and Ann Oakes daughters of the said Mary Ann Oakes the sum of ten pounds sterling each. To my nephew Charles Coles of Halberton in the said County of Devon Dairyman the sum of one hundred pounds sterling. To my nephew John Coles of Witheridge in the said County Yeoman the sum of forty pounds sterling. To my nephew Samuel Coles of Luppitt in the said County Yeoman the sum of forty pounds sterling. To my nephew Peter Were of Washfield in the said County Yeoman the sum of forty pounds sterling. To my nephew Charles Were of Halberton aforesaid Yeoman the sum of forty pounds sterling. To my niece Sarah the wife of Isaac Snow of Tiverton aforesaid Yeoman the sum of ninteen pounds and ninteen shillings sterling. To my niece Mary the wife of Edward Dening of Halberton aforesaid Yeoman the sum of forty pounds sterling separate and apart from her present or any future husband and her receipt alone to be a sufficient discharge for the same. And to each of them the said Henry Were and Benjamin Were the sum of fifty pounds sterling.

All which said several and respective legacies hereby first shall be paid by my Executors hereinafter named within three months next after my decease. And all the rest, residue and remainder of my said real and personal estate whatsoever and wheresoever except as aforesaid subject to the payment of my debts, funeral and testamentary expenses and the before mentioned legacies I hereby give and bequeath the same unto and to be equally divided between them the said Nancy Coles, Henry Were and Benjamin Were share and share alike as tenants in common and not as joint tenants provided always.

And I do hereby further declare that the receipts of them the said Henry Were and Benjamin Were and the survivor of them his executors and administrators shall be a good discharge for all monies which in such receipt shall be expressed to be received and that all persons paying any monies to the said Henry Were and Benjamin Were their executors and administrators for the purpose of this my Will and taking a receipt from them or him accordingly shall not be obliged to see to the further application thereof nor be honorable[?] for the misapplication or nonapplication of the same monies. And I do hereby further declare that neither of my said trustees shall be answerable for the other of them nor for the acts, deeds or defaults of the other of them nor for involuntary losses nor for money received under receipts in which they shall join only for the sake of conformity and that they shall and may reimburse themselves and each other out of the said trust a provisos or out of any monies that may come to their hands by virtue of this my Will all costs and expenses to be incurred by them in the execution of this my Will or any Will in relation thereunto.

And lastly I appoint them the said Henry Were and Benjamin Were joint Executors in trust of this my Will. And I hereby revoke all other Wills by me made at any time heretofor and do declare this present writing to be my last Will and Testament in witness whereof I the said Margaret Were the Testatrix have to this my last Will and Testament contained in two sheets of paper set my hand and seal to wit/ my hand to and at the bottom of the first sheet and my hand and seal to the second and last sheet this seventeenth day of October in the year of our Lord one thousand eight hundred and fifty five.

This is the last Will and Testament of me Robert Were of Pitt Farm Hennock the County of Devon Yeoman

I give and bequeath all my Farming Stock (both alive and dead) Implements and Utensils of Husbandry, growing crops, crops in ground, Horses and Carriages and all other Chattels belonging to or used in my business as a Farmer unto my son Peter Were to and for his own absolute use and benefit. I also give unto him my interest in the Farm occupied by me subject to the right which I hereby give unto my Wife to reside in the Dwellinghouse thereof for so long as she pleases to do so. And I declare that the aforesaid bequest to my son shall be subject to payment by him of my Debts funeral and testamentary expenses. I give unto my said Wife Sarah Were all such Articles of Household Goods and furniture, plate, linen, china, glass, books and other household effects as she may select for her own use and I give the residue of my Household effects unto my said son.

I give devise and bequeath all the rest residue and remainder of my estate and effects whatsoever and wheresoever unto my said Wife and I appoint her sole Executrix of this my Will. And I revoke all other Wills.

In witness whereof I have hereunto set my hand this twenty sixth day of August 1878.

THIS IS THE LAST Will AND TESTAMENT of me SARAH WERE of No 1 Horsdon Terrace Tiverton in the county of Devon widow.

I desire to be buried in the Burial Ground of the Independent Chapel in the parish of Cadeleigh in the said county and that my funeral may be conducted by Messieurs Thorne Brothers of Tiverton Drapers. I give my gold watch and chain to my daughter Maria Symons Carpenter. I give all my plate and plated articles and jewellery to my daughter Harriet Roberts Quick and I give all my wearing apparel to my said daughters Maria Symons Carpenter and Harriet Roberts Quick equally to be divided between them.

All the residue of my estate and effects whatsoever and wheresoever I give devise and bequeath unto Henry Mudford of Tiverton China Merchant and John Thorne of the same place draper (hereinaf­ter called "my trustees"). Upon trust that my trustees shall sell call in and convert into money the same or such part thereof as shall not consist of money and shall with and out of the proceeds thereof and with and out of my ready money pay my funeral and testamentary expenses and debts and shall stand possessed of the residue upon the trusts following (that is to say).

As to the sum of three hundred and sixty pounds part thereof in trust for all the children of my late daughter Margaret Wotton who shall attain the age of twenty one years in equal shares as tenants in common. As to the sum of five hun­dred pounds further part thereof in trust for all the children of my deceased daughter Sarah Melhuish (except her son John who became entitled to Hatherland Farm in the parish of Washfield Devon) who shall attain the age of twenty one years in equal shares as tenants in common. As to the sum of three hundred and sixty pounds further part thereof in trust to invest the same in or upon such securities as may for the time being be authorised by law and to pay the income thereof unto my said daughter Maria Symons Carpenter for her life without power for her to anticipate the same and upon her de­cease to stand possessed of the said sum and the investments for the time being repre­senting the same in trust for Robert Were, Frank, Alfred, Sarah Were, John Seymour, Gwineth Leslie [sic] (being six of the children of the said Maria Symons Carpenter) in equal shares as tenants in common and I direct that if any of the said six children shall die under the age of twenty one years the said sum shall be divided among the remainder of them who shall attain that age in equal shares. As to the sum of three hundred and sixty pounds further part thereof in trust to invest the same in or upon such securi­ties as may for the time being be authorised by law and to pay the income thereof unto my said daughter Harriet Roberts Quick for her life without power for her to antici­pate the same and upon her decease to stand possessed of the said sum and the investments for the time being representing the same in trust for all the children of the said Harriet Roberts Quick who shall attain the age of twenty one years in equal shares as tenants in common.

And as to the sum of fifty pounds further part thereof in trust to retain and divide the same equally between them my trustees for the trouble they may have in carrying out the trusts of this my will.

And as to the residue of my said es­tate in trust for and to divide the same between my said daughters Maria Symons Carpen­ter and Harriet Roberts Quick absolutely so that the share of the said Harriet Roberts Quick shall exceed by twenty pounds the share of the said Maria Symons Carpenter (to whom I have already advanced the sum of twenty pounds) Provided always.

And I declare that if any grandchild of mine entitled in expectancy to a share of my estate under this my will shall at my death (or in the case of the children of the said Maria Symons Carpenter and Harriet Roberts Quick respectively at the death of his or her mother) be under the age of twenty one years my trustee shall invest the expectant share of each such minor with power to vary the investments thereof from time to time and the income thereof shall be applicable for his or her maintenance education advancement or benefit in such manner as my trustees shall in their discretion think fit. Provided fur­ther and I also declare that in the event of my estate proving insufficient to provide the several sums hereinbefore directed to be set apart or paid thereout such several sums shall abate or be reduced rateably.

Provided lastly and I also declare that if my said daughter Harriet Roberts Quick shall within three calendar months after my death by notice in writing to be given to my trustees or one of them offer to purchase the dwellinghouse and premises now in my occupation then and in such case the said dwellinghouse and premises shall be sold to my said daughter at a price to be agreed upon be­tween her and my trustees or if they are unable to agree then at a price to be deter­mined by valuation in the usual way.

And I appoint the said Henry Mudford and John Thorne EXECUTORS of this my will.
