Last Will and Testament of Thomas RICHARDS, dated Oct 05, 1864. Proved Aug 31, 1867.This is the last Will and Testament of me Thomas Richards of Number Fifty eight Hockley Street Birmingham in the County of Warwick Button Maker.
First I direct that all my just debts funeral and testamentary expences be fully paid and satisfied. Whereas my Son Thomas Richards now residing in Australia Button Maker is indebted to me in the sum of twenty six pounds and my Son John Richards of Hockley Street Birmingham aforesaid Chaser and Victualler is indebted to me in the sum of two hundred pounds for monies lent and advanced by me to him and for which I hold a mortgage security on his property in Richard Street near Vyse Street in Birmingham aforesaid. And my Son in law John Harper husband of my Daughter Sarah Harper of New John Street West in Birmingham aforesaid Slater is also indebted to me in the sum of seventy pounds lent and advanced by me to him. And my son William Henry Richards of New John Street West aforesaid Button Maker is also indebted to me in the sum of two hundred and fifty pounds for monies lent by me to him and in the sum of three hundred and fifty pounds for my stock in trade tools and implements of trade in Hockley Street aforesaid making six hundred pounds Subject to be reduced to two hundred and fifty pounds on the death of me and my Wife Ann as expressed in a certain Memorandum in writing dated the third day of October one thousand eight hundred and sixty four made between him of the one part and myself of the other part and therein mentioned expressed and set forth. And whereas I am desirous that the said several sums of money shall when paid fall into and form part of my personal estate and be divided in manner hereinafter expressed.
I give and bequeath unto my dear Wife Ann for and during the term of her natural life to and for her own use and benefit absolutely All my household furniture plate linen china books pictures prints wines spirituous and other liquors which shall be in and upon my dwellinghouse in Hockley Street aforesaid or elsewhere at the time of my decease and from and immediately after her decease I give and bequeath the same furniture and effects and every part thereof unto my Daughter Caroline absolutely.
And as to all other the residue of my estate whatsoever and wheresoever and of what nature sort or kind soever including all my ready money securities for money bonds bills notes mortgage book and other debts and all other my estate both real and personal and whether vested contingent reversionary or otherwise of or to which I shall or may be entitled at the time of my decease unto my said Son the said John Richards (without prejudice to the said debt due from him to me) and my said Daughter Caroline Richards To hold to them their heirs executors administrators and assigns according to the several natures and properties thereof respectively. Upon trust immediately after my decease call in and obtain payment of all debts and sums of money due and owning to me at my decease from each of my said Sons Thomas, John and William Henry and from my said Son in law John Harper and from any other person or persons indebted to me at my decease and also to convert into money all other my estate whatsoever and wheresoever and of what nature sort or kind soever (except my said household furniture and effects hereinbefore disposed of) and put and place out the net proceeds arising therefrom upon security of freehold leasehold and other good and eligible security and pay the interest arising therefrom from time to time as and when received unto my said Wife Ann for and during the term of her natural life to and for her own sole absolute use and benefit and from and immediately after the decease of my said Wife Then Upon trust to call in and collect all principal and other monies out at interest as aforesaid and all other my estate not hereinbefore disposed of and pay and divide the same unto equally between and amongst all my children namely Mary Ann the wife of William Handesyete [sic] Smith Builder, Thomas, Sarah the Wife of the said John Harper, Caroline, James, John, William Henry and Ellen Wife of Joseph Norris Photographer equally share and share alike as tenants in common and not as joint tenants to and for their own sole absolute use and benefit.
Nevertheless my mind and Will is that in case my said Son Thomas shall depart this life in my lifetime then I direct his share of my said estate to go to and be equally divided between and amongst his two children Caroline Riley Richards and William Frederick Richards share and share alike to and for his and her own sole absolute use and benefit.
And I hereby declare that any property which any female shall have take or be entitled to under this my Will the same shall be paid to or otherwise held in trust for her free from the debts power control engagements Bankruptcy or Insolvency of any husband she may happen to have and her receipt alone notwithstanding coverture shall be a good discharge for the same. And as to any property vested in me as trustee or mortgagee at the time of my decease I give devise and bequeath the same unto my said Son John and Daughter Caroline To hold to them their heirs executors administrators and assigns according to the several natures and properties thereof respectively subject to the equities affecting the same and to be conveyed assigned and disposed of accordingly.
And Lastly I hereby appoint my said Wife and Caroline Executrixes and my said Son John Executor of this my Will. I hereby revoking [sic] all former wills by me made and declare this only to be my last Will and Testament.
