I, JOHN EDWARD WALTON of 39 Ashfield Avenue Kings Heath in the City of Birmingham Gentleman hereby revoke all testamentary dispositions heretofore made by me and declare this to be my last Will which I make this twelfth day of June One thousand nine hundred and thirty three.

1. I GIVE DEVISE AND BEQUEATH all my real and personal property whatsoever and wheresoever unto my wife KATE ELIZABETH WALTON and appoint her EXECUTRIX of this my Will

2. PROVIDED ALWAYS that in the event of my said wife dying in my lifetime I APPOINT my son FRANCIS WILLIAM WALTON and my daughter FLORENCE EDITH WALTON Executors and Trustees of this my will and give devise and bequeath all my real and personal estate whatsoever and wheresoever in manner following:-

(a) To my son Francis William Walton the sum of Five hundred pounds free of duty

(b) To my son Arthur Christopher Walton the sum of Two hundred and fifty pounds free of duty

(c) To my Trustees the sum of Four hundred pounds and any income therefrom to be paid by them to my son John Howard Walton on his leaving the army by weekly sums of One pound and in the meantime to invest the same in their names or place same on deposit account in their names PROVIDED ALWAYS that in the event of my son dying before the whole of the said sum of Four hundred pounds and the income thereof shall have been paid to him in manner aforesaid the residue thereof shall fall into my residuary estate

(d) To each of my daughters as shall be married at the time of my death the sum of Five hundred pounds free of duty

(e) I GIVE AND BEQUEATH the residue of my residuary estate to such of my daughters or daughter as shall be unmarried at the time of my death in equal shares as tenants in common

(f) PROVIDED ALWAYS that if all my said daughters shall be married at the time of my death then after making the said payments of Five hundred pounds to each of my daughters as shall be married aforesaid I GIVE DEVISE AND BEQUEATH the residue of my residuary estate equally between all my children as tenants in common PROVIDED ALWAYS that if any child of mine shall die in my lifetime leaving a child or children who shall survive me and attain the age of twenty one years then in every such case the last mentioned child or children shall take and if more than one equally between them the share which his her or their parent would have taken of and in the residue of my residuary estate if such parent had survived me

KATE ELIZABETH WALTON of 9 Birmingham Road Alvechurch in the County of Worcester Widow.

1. I REVOKE all testamentary dispositions heretofore made by me.

2. I APPOINT Midland Bank Executor and Trustee Company Limited (hereinafter called "the Company") Executor and Trustee of this my Will upon the conditions (except as regards remuneration) specified in the Company's handbook in use at the date hereof AND I DECLARE that the Company shall be entitled to remuneration in accordance with such scale of fees of the Company as may be published and in force at the date of my death which remuneration shall be payable (without abatement) out of income or capital or both as such scale may provide and be chargeable accordingly for all purposes of my Will and shall be free of duties (and be payable in addition to the customary share of brokerage) AND I DESIRE that the firm of Springthorpe Holcroft and Bishop of 3 Waterloo Street in the City of Birmingham shall be employed as Solicitors in connection with my estate unless the Company sees reason to the contrary.

3. I BEQUEATH free of duty to my daughter Kate Winifred Walton all my personal domestic and garden effects and articles of personal use and ornament and clothes in or about the house in which I may be residing at my death absolutely.

4. I BEQUEATH free of duty the sum of Five hundred pounds to each of my children Francis William Walton John Howard Walton Ralph Thomas Walton Florence Edith Slayter and Grace Craig.

5. I DEVISE AND BEQUEATH the residue of my estate unto my Trustees upon trust to sell the same with full power to postpone such sale and to invest the proceeds of any such sale in any investments available to a private person without limitation in any way to Trustee investments and in the absolute discretion of my Trustees and to re-invest the same as occasion may arise accordingly and to hold my said residue and the investments for the time being representing the same upon the following trusts:-

(a) to pay the income therefrom to my daughter the said Kate Winifred Walton until her death or until her re-marriage

(b) If my said daughter shall marry the income from my said residue shall be divided equally between her and such of my children as are named in Clause 4 hereof

(c) Upon the death of the said Kate Winifred Walton whether she shall then be married or not my said residue shall be divided equally per capita between all my grandchildren then living and if any of them shall then be an infant the share of any such infant shall be held by my Trustees in trust to pay the income therefrom to the parent or guardian of such infant or to retain the same in their absolute discretion and to pay the capital together with any accumulated income to such infant upon attaining the age of twenty one years.

5.[sic] I FURTHER DIRECT that during the life of my said daughter Kate Winifred Walton and so long as she shall remain un-married she shall be permitted to occupy the residence in which I shall be living at my death or if with the written consent of my said daughter my Trustees shall see any reason for the sale of the same they shall sell the same accordingly and shall at the discretion of my said daughter purchase another residence for her use and occupation during her lifetime and may invest therein a sum equal to or less than the nett proceeds of sale of the said residence in which I shall be living at my death and in so far as such proceeds of sale shall not be so utilized the same shall fall into my residue and be subject to the trusts herein contained for the benefit of my said daughter and otherwise. My said daughter shall be responsible for the payment of all outgoings in respect of any such residence and for the full insurance of the same and shall keep the same in substantial repair.

The Condition of this Obligation is such That if: the said William Smith, Charles Smith and Susannah wife of Jesse Greaves Administrator:s of all and singular the Goods Chattles and Credits of: William Smith deceased do make or cause to be made a true and perfect Inventory of all and singular the Goods Chattles and Credits of the said deceased which have or shall come to the Hands Possession or Knowledge: of them the said: William Smith, Charles Smith and Susannah Greaves or into the Hands and Possession of any Person or Persons for: them and the same so made do exhibit or cause to be exhibited into the Registry of: the Bishops Court of Lichfield at or before the: last day of: February next ensuing and the same Goods Chattles and Credits and all other the Goods Chattles and Credits of the said deceased at the time of: his death which at any time after shall come to the hands or Possession of the said: William Smith, Charles Smith and Susannah Greaves or into the hands and Possession of any other Person or Persons for: them do well and truly administer according to Law. And further do make or cause to be made a true and just Accompt of: their said Administration at or before the: last day of: November and all the Rest and Residue of the said Goods Chattles and Credits which shall be found remaining upon the said Administrators Accompt the same being first examined and allowed of by the Judge or Judges for the time being of the said Court shall deliver and pay unto such Person or Persons respectively as the said Judge or Judges by his or their Decree or Sentence pursuant to the true Intent and Meaning of a late Act of Parliament made in the two and twentieth and three and twentieth Years of the Reign of our late Sovereign Lord King Charles the Second intitled an Act for the better settling of Intestates Estates shall limit and appoint And if it shall hereafter appear that any last Will and Testament was made by the said deceased and the Executor or Executors therein named do exhibit the same into the said Court making Request to have it allowed and approved accordingly if the said: William Smith, Charles Smith and Susannah Greaves being thereunto required do render and deliver the said Letters of Administration (Approbation of such Testament being first had and made) in the said Court then this Obligation to be void or else to remain in full Force and Virtue.

In the Name of God Amen. I William Handasyd of Birmingham in the County of Warwick Brass Cock Founder and Warming Pan Maker being of sound and disposing mind, memory and understanding and in perfect health of body, praise be Almighty God for the same, considering with myself the certainty of death and the uncertain hour thereof do make and publish this my last Will and Testament by which I mean to dispose of all my Worldly Estate in manner following, that is to say.

I direct that all my Just Debts and Funeral Expenses shall be fully paid and satisfied by my Executrix and Executor hereinafter named as soon as conveniently may be after my decease. And I direct that my body shall be decently interred in a plain and unexpensive manner in such place as my said Executrix and Executor shall think proper.

And I give, devise and bequeath to my Dear Wife Elizabeth Handasyd and my Friend and Partner in Trade William Rudder of Birmingham aforesaid Brass Cock Founder and Warming Pan Maker their Exec[ut]ors and Advisors all my part share in the effects in Trade of a Brass Cock Founder and Warming Pan Maker aforesaid and the Good Will thereof and all Implements, Tools, Fixtures and Effects used in and about the same and also all my Household Furniture, Implements of Household, Goods, Plate, Linen, Bedding, China, Books and other the Debts, Effects and ready Monies due, owing or belonging to me and all and singular other my Personal Estate and Effects whatsoever and wheresoever and of what nature, kind or quality soever and whether in possession, remainder, reversion or expectancy whereof or wherein I shall be possessed or in any wise intitled unto upon the Trust and to and for the Ends, Intents and Purposes hereinafter mentioned, expressed and declared of and construing the same, that is to say.

Upon Trust that they my said Trustees and the Survivor of them his or her Executors and Advisors do and shall continue to carry on my said Trades during so long as my said Wife shall live in case the same can be so long carried on to advantage and in case my said Trades cannot be so long carried on to advantage and my said Trustees shall deem it expedient to discontinue the same then upon Trust to sell and dispose of the Stock, Fixtures, Implements and Effects in and belonging to such Trades respectively and the Good Will thereof either by Public Sale or Private Contract as they shall think most proper for the most Money and best price or prices that can or may be reasonably got or gotten for the same and do and shall put, place and keep out at Interest the Product to arise by such Sale or Sales upon Government or good Freehold or Leasehold Security or Securities in the Names of them my said Trustees and from time to time call in and again place out the Same or any part or parts thereof to Interest upon one[?] or other Security or Securities of the like nature as they shall see fit and proper and then upon trust to pay unto or otherwise permit and suffer my said Dear Wife to have, receive and take the Profits, Gains and Increase to be made by my said Trades and the Interest, Dividends and Profits to arise from the Product of the Sale of my said Estate and Effects as the case may be to and for the Support and Maintenance of herself and such of my Children as shall reside with her and during the term of her natural life.

And from and immediately after the decease of my said Dear Wife then upon Trust to pay distribute and divide all and singular my said Personal Estate and Effects whatsoever and the Money arising therefrom unto between and amongst all and every the Child and Children of me the said William Handasyd and the Issue of my Son George who is now dead my said Children taking equally Share and Share alike and the Issue of my said Son George taking between them the Same Share only as one of my Children to and for his, her and their own respective use and benefit and upon further Trust in case any or other of my said Children or Grandchildren the Issue of my said Son George shall happen to depart this life in the lifetime of me the said Testator William Handasyd leaving Issue then such Issue shall take the Part or Share of and in the said Trust, Monies, Effects and Promises to which his, her or their Parent or Parents would have been entitled if living to be paid, assigned and transferred to such Issue respectively as well as the Issue of my said Deceased Son George as and when he, she or they shall attain his, her or their age or respective ages of twenty one Years the Interest, Dividends, Gains and Proceeds of the Share and Shares of such Issue respectively to be applied and disposed of by my said Trustees to and for the Maintenance, Education and Support of such Issue respectively in such manner as they shall think proper provided always.

And it is my Will that the Sum of one hundred pounds apiece which I have heretofor given and advanced to my Daughters Sarah and Elizabeth shall be deemed accounted for and taken as part of the Property, Effects and Promises which they would otherwise have been entitled to under this my Will provided also that it shall and may be lawful to and for my said Trustees to advance and lend to my said Dear Wife Elizabeth Handasyd any Sum of Money not exceeding the Sum of Two Hundred Pounds upon her own Bond in case my said Trades shall be discontinued as aforesaid.

And I do hereby declare my Will to be that it shall and may be lawful to and for my said Trustees and their respective Executors and Advisors by and out of all or any of the Monies which by virtue of this my Will or any Trust herein declared shall come to their or any of their hands to deduct, retain to and reimburse themselves all such reasonable Costs, Charges and Expenses as they respectively shall or may sustain, expend or be put unto, in or about the Execution of this my Will and also that they my said Trustees, their respective Heirs, Executors and Administrators shall be charged and chargeable only every of them for and with his or her own respective Acts, Receipts, Payments and willful Defaults and not otherwise and shall not be charged or chargeable with or for any Sum or Sums of Money other than such as shall actually and respectively come to his, her and their hands by virtue of this my Will nor with any Loss or Damage that may happen in placing out any of the Monies aforesaid or any part or parts thereof in or upon any such Stocks, Funds or Securities as aforesaid nor with or for any other Loss or Damage which may happen thereto so as the same but not occasioned by his, her or their willful Default or Neglect.

And I nominate and appoint my said Dear Wife Elizabeth Handasyd and the said William Rudder Executrix and Executor of this my Will and I do hereby revoke and make void all former and other Will and Wills by me made and do declare this only to be my last Will and Testament. In testimony whereof I the said Testator William Handasyd to the two first Sheets of this my Will contained in three Sheets of Paper have set my hand and to the third and last Sheet thereof my hand and Seal this Seventeenth day of October in the Year of our Lord One thousand Eight hundred and Eleven.

To date only circumstantial & hearsay evidence exists equating George HANDASYD (1728-1803) Schoolmaster who died in Watford, Herts, son of Dr. Clifford HANDASYD ...to George HANDASYD who married Sarah AUDSLEY, presumed father of William HANDASYD (c1750-1811) Brass Cock Founder of Birmingham:

1. The marriage of George HANDASYD & Sarah AUDSLEY took place on Jun 22, 1749 in the church of Saint Mary at Hill, London. This is the same church, site of the first 2 (of 3) marriages of Dr. Clifford HANDASYD of Gaynes Hall, Huntingdon, later of Red Lyon [Red Lion] Square, London. The marriage of George & Sarah took place just prior to the c1750 birth of William as calculated from William's age-at-death (61 years; buried Oct 11, 1811 St Paul's Birmingham).

2. William HANDASYD of Birmingham and his wife Elizabeth (Ward) named their first son George and their first daughter Sarah; neither forename apparently derived from her immediate WARD/PEMBERTON family... More importantly, they named a son Joseph Audsley (Joseph Audsley HANDASYD s/o William & Elizabeth buried Aug 15, 1789 St Paul's Birmingham.)

3. A family story passed down by Emily Alice, wife of Tom Lea PAYNE (1861-1950) great grandson of William & Elizabeth HANDASYD, purports that our family is related to "General Handasyd." By implication this refers to Major General Sir Thomas HANDASYD (c1644-1729) Colonel of the 22nd Foot and Governor of Jamaica during the period 1702-1711, also the father of Dr. Clifford HANDASYD above.

Research is ongoing to discover the critical baptism record of William HANDASYD (c1750)... finally proving that he is the son of George HANDASYD & Sarah AUDSLEY as proposed here. Also for any documentary evidence confirming that the said George is indeed George, son of Dr. Clifford HANDASYD.
