This is the last Will and Testament of me John Payne of Birmingham in the County of Warwick Button Manufacturer. I give and bequeath unto my dear wife Elizabeth all my household goods, plate, linen, china, books, pictures and all other the chattels or furniture which may be in or about my dwelling house at the time of my decease for her sole and separate use and benefit and so that the same shall not be subject or liable to the debts owed, interference or engagements of any person with whom she may hereafter intermarry.

I give, devise and bequeath all my real estate and also all and singular my stock in trade goods, all book debts, monies, securities for money and all and singular other my Personal Estate and Effects whatsoever and wheresoever vested or contingent and whether in reversion, remainder or expectancy or otherwise not hereinbefore specifically disposed of unto my said dear wife and my friends Thomas Short of Birmingham aforesaid Gentleman and Paul Birch of Birmingham aforesaid Gilt Toy Maker their heirs, executors, administrators and assigns according to the nature and quality of the same estates respectively But nevertheless upon the trusts herein declared that is to say.

To and regarding my trade of a Button Maker and the stock, tools, implements and other effects belonging thereto upon trust as soon as convenient after my decease cause an inventory and valuation of my said stock in trade and effects to be taken and to carry on my said trade or business and to use and occupy my leasehold premises in Saint Pauls Square in Birmingham aforesaid for the purpose until they can meet[?] with a purchaser for the same at a fair and reasonable price but with full liberty to discontinue carrying out the said business at any time when they consider it would be beneficial to my estate so to do and then upon trust to sell and dispose of the said lease or buildings and the said leasehold premises either together or separately and either by public auction, private contract or by valuation or tender and in their discretion may appear most advisable and either wholly or in part upon debit or otherwise upon receiving proper and approved security for the amount thereof payable in a reasonable time and for the purpose of effecting any such sale or sales do and shall enter into, make and execute all such contracts, agreements or conveyances, assurances, acts, deeds, matters and things as to them or him shall seem reasonable and subject to the trusts aforesaid. I declare that my said trustees or trustee for the time being shall stand possessed of and interested in the monies to arise from such sale or sales as aforesaid or otherwise to be received from the reliation[?], reversion or getting in of my said estate and effects upon trust to lay out and invest the same in some or one of the public stocks or funds of Great Britain or in the purchase or on mortgage of freehold or leasehold property or other securities and from time to time to alter and vary such securities for or unto others of a like nature as occasion shall require or as they shall think fit and to stand possessed of such stocks, funds or other securities or investments the interest, dividends and annual produce thereof upon trust after payment of my just debts and the expenses of my funeral and of proving and carrying this my will into effect to pay to my dear mother Sarah Payne the interest of the sum of two hundred pounds part thereof which I hereby direct to be separately invested for that purpose during the term of her natural life and in the next place to pay the remainder of such interest, dividends and annual proceeds unto my said dear wife during her life in case she shall so long continue my widow she thereout providing for the maintenance and education of my said children during their respective minorities but in case of her marrying again then to pay to her the interest, dividends and annual proceeds of the sum of the sum of one thousand pounds only for her own sole and separate use and so that the same shall be in nowise subject to the debts, control or engagements of her future husband and that her receipt alone shall be a sufficient discharge to my said trustees or trustee for the time being for the same and in that case to pay the remainder of such interest, dividends and annual proceeds unto and lay out the same for the maintenance and education of my said children during their respective minorities and as to all the rest and residue of the said stocks, funds and securities and the interest, dividends and annual produce thereof I give and bequeath the same unto and equally between all and every my children who being a son or sons shall attain the age of twenty one years or being a daughter or daughters shall attain that age or marry under that age but the share of each of my said daughters to be for her own sole and separate use and not to be subject or liable to the debts or control of any husband with whom she may intermarry. And in case of the death of either of my said children without leaving issue before his proportionate share shall have become vested or payable under this my will then the share or shares of him, her or them so dying shall belong and be paid or transferred to the survivors of my said children if more than one in equal shares and if but one then the whole thereof to such one child but in case any of my said children shall die leaving a child or children him or her surviving I give and bequeath the share to which my said child would have been entitled under this my will unto his or her surviving child or children in equal shares provided always.

And I do hereby declare that it shall be lawful for my said trustees or trustee for the time being to raise and apply for and towards the advancement or preferment in the world of any of my said children any part not exceeding one third of his or her share or expectant share of and in the said trust monies, stocks, funds and securities under the trusts hereinbefore declared of and concerning the same notwithstanding such share shall not then have become vested or payable under or by virtue of the said trusts.

I give devise and bequeath all estates vested in me upon any trust or trusts or by way of mortgage and which I have power to dispose of by this my will with their appurtenances unto my said trustee or trustees for the time being their heirs, executors, administrators and assigns according to the nature and quality thereof respectively upon trust to hold or dispose of the said trust estates in the manner in which the same ought to be held or disposed of pursuant to the trusts affecting the same and upon payment of the money to be accrued on mortgage to convey or assign the estates in mortgage to the person or persons for the time being entitled thereto.

And I declare that on the death, refusal or inability of any trustee or trustees the surviving or acting trustees or trustee their, his or her executors or administrators may appoint a new trustee or trustees as occasion may require to whom any requisite conveyance shall be made and who may act in the same manner as if named in this my will. And I hereby declare that my said trustees and the survivors and survivor of them and the executors and administrators of such survivor shall and may at all times in the first place reimburse and indemnify themselves respectively and deduct and retain to themselves respectively out of the said trust estate and premises all such costs, charges, damages and expenses as they or either of them shall or may at any time expend, lay out or be put unto for or by reason of all, any or other of the trusts hereby in them reposed and that neither of them shall be answerable for any loss which may happen to any of the said trust premises unless such loss happen through his, her or their wilful neglect or default nor for any loss which may happen by depositing any money in the hands, keeping or custody of any public or common banker nor the one for the other or others of them nor for more monies than shall actually come into each of their hands respectively.

And I do hereby revoke and make void all other wills by me at any time heretofore made. And I declare this to be only my last will and testament. In witness whereof I the said testator have to this my last will and testament contained in four sheets of paper set my hand and seal in manner following that is to say to the first three sheets I have set my hand and to this fourth and last sheet my hand and seal this fourth day of January one thousand eight hundred and forty two.

I give and bequeath unto my dear wife Hannah Chirm all my household goods, plate, linen, china and all and singular other my personal property to and for her personal use and benefit also all and singular my messuages, lands, tenements, hereditaments and premises whatsoever and wheresoever the same may be and also all my money, securities for money, money in the funds and all other my personal Estate and effects of whatsoever denomination the same may be to hold to my said wife Hannah Chirm for and during the term of her natural life or so long as she shall continue my widow and unmarried to and for her own absolute use and benefit and I do hereby order and direct the script and scripts of my said wife alone shall be a sufficient discharge to any person or persons who shall pay to her any sum or sums of money by way of rent or otherwise and from and after the decease of my said wife or second marriage which ever may first happen I give and bequeath all and singular my real and personal Estate and Effects unto my children in manner following that is to say.

I give and bequeath unto my daughter Hannah Maria Gulliver two messuages or dwellinghouses situate in Aston Road in the Parish of Aston in the County of Warwick also ten houses, one warehouse and shopping thereunto belonging situate in Church Street and Great Charles Street Birmingham and also seven other messuages or dwellinghouses situate in Church Street aforesaid at the upper part thereof together with the shopping belonging thereto all in the aforesaid Parish of Birmingham to and for her separate use and benefit And also all that messuage or dwellinghouse situate in Broad Street Birmingham and now in the occupation of Mr. Rabone to and for her separate use as aforesaid independent of and not subject or liable to the debts, engagements or control of her present or any future husband or husbands with whom she may intermarry and that he or they shall not intermeddle therewith and that her script alone under her own hand shall from time to time be good and sufficient receipts and discharges to my said trustees for payment of the same and from and after her decease the rents, issues and profits thereof to be applied to and for the maintenance and support of such child or children as she shall have at the time of her decease until the youngest thereof shall attain his or her age of twenty one years and so soon as the youngest thereof shall attain the said age of twenty one years then I direct that my said trustees shall divide the said property equally amongst my said daughter's children their heirs and assigns in equal shares and proportions.

I give and bequeath unto my son Thomas Chirm all that my messuage or dwellinghouse situate in Broad Street Islington in the Parish of Birmingham aforesaid now in the occupation of Mr Pagett for and during the term of his natural life and from and after his decease I give and bequeath the same unto my daughter Ellen Flint for and during the term of her natural life and to her heirs and assigns in the same and like manner and form in all resects as the property heretofor bequeathed to my daughter Hannah Maria Gulliver.

I also give and bequeath unto my said son Thomas all that my dwellinghouse in Newhall Street in Birmingham aforesaid together with the shop adjoining thereto now in the occupation of Goodwin Nash also all that messuage or dwellinghouse situate in Shipcote Street Birmingham known by the sign of the Green Dragon also all that messuage or dwellinghouse situate in Broad Street Islington aforesaid now in the occupation of Miss. Mallett for and during the term of his natural life and from and after his decease if unmarried and died without issue lawfully begotten then and in such case I give and bequeath the same unto, between and amongst his Brothers and Sisters in equal shares and proportions as tenants in common but not as joint tenants but if my said son Thomas shall marry and his wife should survive him having lawful issue of the said marriage then it is my will and I so hereby order and direct that they my said trustees or the Survivors or Survivor of them do and shall receive and take the rents, issues and profits of all and singular the same premises and pay unto such widow of my son Thomas Chirm the rents and profits of the aforesaid premises for and during the term of her widowhood towards the maintenance and support of herself and child or children but in case she shall marry again then I direct that my trustees shall retain in their hands the rents, issues and profits thereof for the sole benefit of such child or children until the youngest thereof shall attain his or her age of twenty one years when the same shall be equally divided amongst them share and share alike their heirs or assigns but in case she shall have no issue lawfully begotten of my said Son then I direct that the aforesaid premises shall descend unto and be equally divided amongst my children which shall be then living at the time of her decease and to their heirs and assigns for ever as tenants in common and not as joint tenants.

I give and bequeath unto my daughter Bessy Durham nine messuages or dwellinghouses situate in Shipcote Street in the said Parish of Birmingham and also all that messuage or dwellinghouse situate in Broad Street Birmingham now in the occupation of Mr. Blakemore to hold unto my said daughter Bessy Durham for and during the term of her natural life independent of and not subject or liable to the control, debts or engagements of her present or any future husband with whom she may intermarry and from and after her decease I give and bequeath the same unto her daughter Maria Durham during the term of her natural life and from and after her decease to such child or children as she may have at the time of her decease and to their heirs but provided she dies without issue then I direct that the same shall descend unto such of my children as shall be then living and to their heirs in equal shares and proportions as tenants in common and not as joint tenants to hold unto them their respective heirs, Executors, administrators and assigns for ever.

I give and bequeath unto my daughter Ellen Flint all that my messuage or dwellinghouse situate in Broad Street Islington in the Parish of Birmingham aforesaid in the occupation of Mrs. Berry and also all those fourteen messuages, tenements or dwellinghouses situated in Shipcote Street otherwise Islington Place in the Parish of Birmingham aforesaid together with the rents, issues and profits thereof together with a Brewhouse and other appurtenances adjoining and belonging to the same for her sole and separate use and benefit for and during the term of her natural life free and clear from the debts or control of her husband and her receipt alone shall be a sufficient discharge for my said trustees without the husband joining in such receipt or receipts and from and after her decease I give and bequeath the same premises and every part thereof unto and amongst all and every the child and children of my said daughter Ellen Flint lawfully begotten who shall be living at the time of her decease and to their respective heirs and assigns in equal shares and proportions as tenants in common and not as joint tenants and if there shall be but one such child of the said Ellen Flint lawfully begotten as aforesaid then I give and bequeath the said premises unto such only child, his or her heirs, Executors, administrators and assigns for ever.

I give and bequeath unto my daughter Charlotte Wilson all those my six messuages or dwellinghouses with the appurtenances thereunto belonging situate in Bisopgate Street Birmingham aforesaid subject for ever hereafter in common with the tenants and occupiers of the property hereinafter bequeathed to my son John Chirm of a right of road and also to a right of way to the pump and well of water upon the said premises each paying a proportionate part of the expences of keeping the said road or way and pump in proper repair and also all that piece or parcel of land in Bishopgate Street aforesaid adjoining the above mentioned premises and covering to the front of the aforesaid Street to hold unto my said daughter Charlotte Wilson for and during the term of her natural life and from and after her decease I give and bequeath that same and every part thereof unto her daughter Emma Wilson, her heirs and assigns for ever provided she has issue lawfully begotten but in case she dies without such issue then I give and bequeath the same amongst all and every my child or children which may be then living and to their heirs and assigns share and share alike as tenants in common and not as joint tenants free from the debts or control of their present or any future husband with whom they may intermarry.

I give and bequeath uto my son John Chirm all those my eleven messuages or dwellinghouses situate in Bishopgate Street Birmingham aforesaid also all that my messuage or dwellinghouse situate in Newhall Street Birmingham and now in the occupation of Mrs. Barber together with the appurtenances thereunto belonging for and during the term of his natural life and from and after his decease to his wife during the term of her natural life or so long as she shall remain a widow and unmarried and from and after her decease or second marriage which ever may first happen then the same to go and be equally divided amongst such child or children as may be then living of my said Son John Chirm and to their heirs and assigns as tenants in common and not as joint tenants but in case he she or they shall die without issue then I direct that the said property shall descend in like manner as before amongst and between such of my children as shall be then living share and share alike and to their respective heirs, Executors, administrators and assigns.

I give and bequeath all those my two messuages, hereditaments or dwellinghouses situate in Newhall Street at the corner of Charlotte Street Birmingham aforesaid together with the wharf upon the borders of the canal side and the shopping thereunto belonging to Ellen Flint during the term of her natural life free and clear and freely exonerated from the debts or control of her husband and from and after her decease to such child or children as she may have living in equal shares and proportions and to their heirs and assigns for ever but in case she the said Ellen Flint dies without issue then I direct that the said property shall descend to such of my said children as shall be then living and to their heirs and assigns in equal shares and proportions and I do hereby will, order and direct that my Executors and Executrix hereinafter named shall retain in their hands the rents, issues and profits of the said premises until they shall have the sum of eight hundred pounds in hand and with which said sum I direct that they my said Executors and Executrix or the survivor of them shall liquidate two certain debts due and owing upon the said property which I have hereinbefore bequeathed, and I hereby further will, order and direct that in case my said Son Thomas survives my dearly beloved wife that he shall stand and be possessed of all and singular the personal effects hereinbefore bequeathed to my Wife as aforesaid*.

I hereby order, will and direct that my said Sons and daughters and their respective heirs, Executors, administrators and assigns shall pay a proportionate part or share of the Ground rent upon which the building is erected and bequeathed as aforesaid according to the value of each parties property interested therein and I hereby order and direct that my said Trustees their respective Executors or administrators or the Survivor of them shall retain in his or their hands sufficient property out of my real Estate or the rents, issues and profits of such Estate and apply the same to and for the sole and proper purpose of keeping all and singular the aforesaid respective property in good and tenantable repair from time to time and at all times and in such manner as the same may be deemed necessary and requisite and I do hereby will, order and direct my Executors and Executrix shall not be accountable for the acts and deeds of the other of them but each for his own act and deed only and lastly I hereby nominate, constitute and appoint Mr. James Busby of Edgbaston near Birmingham Gentleman, William Blyth of Edgbaston aforesaid Merchant and Thomas Chirm of the City of London in the County of Middlesex Gentleman Executors and my dear wife Hannah Chirm Executrix of this my last Will and Testament revoking all other Wills by me heretofore made. In witness whereof I the said Joseph Chirm the testator have to this my last Will and Testament contained in this and the nine preceeding sheets of paper set my hand (viz) my hand to the nine preceeding sheets of paper and my hand and seal to this my last sheet of paper this twenty ninth day of July in the year of our Lord one thousand eight hundred and thirty.

Proved at London 21st March 1831 before the worshipful John Danbery Doctor of Laws and Surrogate by the oath of Thomas Churm (in the Will written Chirm) the Nephew and Hannah Chirm Widow the Relict two of the Executors to whom Asministration was granted being first sworn duly to Administer, power reserved of making the like grant to James Busby and William Blyth the other Executors.

*Ty / On the 24th Dec'd 1850 Adm'on with the Will amended of the Goods Chattals and Credits of Joseph Chirm late of Birmingham in the Co'y of Warwick Gentleman dec'ed left unadm't by Hannah Chirm Widow the Relict and Thomas Churm (in the Will written Chirm) the Nephew resp'ly dec'ed whilst living two of the Ex'ors named in the s'd Will was granted to John Richard Chirm the nat'l and lawful Son of the s'd De'ced he having been first sworn by Com'on duly to admst'. James Busby and William Blyth the other and surviving Ex'ors named in the s'd Will hav'ng renounced the Probate & Execution thereof (as by Acts of Court appear'd). Hannah CLIFT was christened 1 on 01 Nov 1767 in Halesowen, Worcester, England. She died 2, 3, 4 on 20 Sep 1847 in Edgbaston, Warwick, England. She was buried on 27 Sep 1847 in St Pauls, Birmingham, Warwick, England. She married 5 Joseph CHIRM on 19 Dec 1785 in Aston Juxta Birmingham, Warwick, England.

This is the last will and testament of me Hannah Chirm of the Parish of Edgbaston in the County of Warwick Widow in the first place I direct that all my just debts funeral expences and the charges of proving this Will may be paid as soon as conveniently may be after my decease by my Executor hereinafter named
