Last Will and Testament of Robert Ebbels, dated Feb 17, 1843, with a Codicil dated Feb 17, 1843, Proved Mar 17, 1848:

Copy Will and Codicil of Robert Ebbels late of the parish of Halberton, Devon, Yeoman, Deceased.
Executors Joseph Baker and Richard Davey
Proved 17th March 1848 in the Archdeaconry Court of Exeter.
Effects sworn under £300.

I Roberts Ebbels of Brimbottom in the county of Devon Yeoman do make this my last Will and Testament in manner and form following that is to say I desire to be buried in Willand churchyard as near as possible to my late Dear Wife and I give and bequeath unto the Sexton of the said parish of Willand for the time being yearly for ever the sum of five shillings to be paid and payable on Christmas Day yearly and I hereby charge my Farm and Lands situate at Brimbottom aforesaid called Merrys with the payment of the same.

I give and bequeath to my brother-in-law Courtnay Davey the sum of Fifty pounds. I give and bequeath unto my nephew Joseph Baker of Sutton Barton the sum of Forty pounds. I give and bequeath unto John Webber of Holcombe Rogus in the county of Devon shoemaker the sum of Ten pounds. I give and bequeath unto the said Joseph Baker and my brother-in-law Richard Davey of Tiverton in the said county of Devon innkeeper my said Farm and lands called Merrys and all other my Lands Tenements and Hereditaments situate and being in the said parish of Halberton To hold the same unto them the same Joseph Baker and Richard Davey their Heirs executors administrators and assigns. Upon Trust nevertheless and to and for the use and benefit of Robert Davey, the son of the said Richard Davey, when and so soon as he shall attain the age of 21 years and then for the use and benefit of the Heirs and assigns of the said Robert Davey forever. And until the said Robert Davey shall attain the said age of 21 years it is my Will and I hereby direct the said Joseph Baker and Richard Davy out of the rents and profits to be received by them in the meantime of all and singular my said lands, tenements, and hereditaments in Halberton aforesaid to pay unto my sister Mary Baker yearly and every year her the sum of Twenty pounds by quarterly payments and to divide the residue of the said Rents and Profits unto and between them the said Joseph Baker and Richard Davey and their respective executors administrators and assigns. To and for their respective use and benefit as tenants in common and not as joint tenants.

And I give and bequeath unto the said Joseph Baker and Richard Davey all the rest and residue of my real and personal Estate and Effects to hold the same unto them the said Joseph Baker and Richard Davey their heirs executors administrators and assigns respectively as tenants in common and not as joint tenants subject nevertheless to the payment of my just debts, funeral and Testamentary expenses and the legacies hereinbefore by me given and bequeathed. And I hereby appoint the said Joseph Baker and Richard Davey joint executors of this my Will hereby revoking all former Wills in witness whereof I the said Robert Ebbels have to this my last Will affixed my hand and seal this 17th day of February in the year of our Lord one thousand eight hundred and forty three.

This is a codicil to the last Will and Testament of me the aforesaid Robert Ebbels. The sum of five shillings given by me by my said Will to the Sexton of the parish of Willand in the time being is given upon this express condition that the said Sexton keeps my grave and also the graves of my father and mother, of my said Wife, and of my late brother John in decent repair and that the said Graves are not disturbed for the interment of any other person or persons. And I direct the executors of my said Will to fix a headstone to my grave of the same size and height as that fixed to the grave of my said Wife. And I charge my said farm and lands called Merrys with a sufficient sum from time to time to keep all the headstones in Willand Church Yard belonging to the members aforesaid of my family in decent repair and the bequest in my said Will of the said farm and lands must be considered upon that express condition. Witness my hand and seal this 17th day of February one thousand eight hundred and forty three.

Notes from Anthony Hunt:

Lived at Merry's Farm, Brimbottom (Brithem Bottom) in the parish of Halberton. He bought Merrys Farm, in the Lower Town quarter of Halberton, in 1806 (Land Tax Assessments, film 1471963). From then until 1819 it was described as the " Piles moiety of Channons". Before 1806 it was owned by the Misses Spry and Lane.

Robert Ebbels was buried at his request in Willand Churchyard, where his wife Jane, parents and brother John were also buried.

Notes from Anthony Hunt:

Apparently had a daughter (see gravestone inscription below) called Elizabeth who must have died, which is why her husband left the majority of his estate, including Merry's Farm at Brimbottom, Burlescombe, to Robert Davey, his nephew (my g-g-grandfather).

Death date from inscription on gravestone in Willand churchyard:
"Sacred to the memory of JANE the wife of ROBERT EBBELS, who departed this life June the 15th (18th ?) 1835 aged 55years. Dear wife ... (illegible) ... mother of Elizabeth."

From the DFHS transcription of the Willand burial registers - Jane Ebbels of Halberton buried 25th January 1833, aged 56.
