This is the last Will and Testament of me FRANK DONALD GIBSON of 5 Breeze Road Birkdale Southport in the County of Merseyside Retired Bank Manager.
1. I REVOKE all prior Wills.
2. I WISH my remains to be cremated.
3. I APPOINT John Edward Dominick Philip Alphonsus Loy of 26 Hoghton Street Southport aforesaid Solicitor to be the sole Executor and Trustee of this my Will and I give to him a legacy of £250 if he shall prove my Will and act in the execution of the Trusts hereof.
4. IN CASE the said John Edward Dominick Philip Alphonsus Loy shall die in my lifetime or shall refuse or be unable to act in the office of Executor and Trustee then I appoint Midland Bank Trust Company Limited (hereinafter called "the Company") to be the sole Executor and Trustee of this my Will upon its published standard conditions as now in force (as if the same were here set out) with remuneration as provided by those conditions and the Company's standard scale of fees in force at my death and with power to charge remuneration in accordance with any later standard scale of fees of the Company for the time being in force and I desire that the firm of Cockshott Rayner & Loy of 26 Hoghton Street aforesaid shall be employed as Solicitors in connection with my estate unless the Company sees reason to the contrary.
5. I BEQUEATH to my Domestic Help Mrs. Mary MacCabe the sum of £100 in addition to any wages which may be due to her at my death.
6. SUBJECT as aforesaid and to the payment of my debts, funeral, testamentary and administration expenses I GIVE DEVISE AND BEQUEATH all my real and personal estate whatsoever and wheresoever to Mrs. Mary Nixon absolutely and beneficially if she shall survive me and subject thereto I GIVE DEVISE AND BEQUEATH my said real and personal estate to my niece Patricia J. Flynn and my nephew Barrie D. Gibson or to the survivor of them living at my death and in case they shall then both be living in equal shares absolutely and beneficially PROVIDED ALWAYS that in case my said niece and my said nephew or either of them shall die in my lifetime leaving a child or children living at my death who shall attain or shall have attained the age of eighteen years or marry under that age then such last mentioned child or children shall take by substitution and if more than one equally my said real and personal estate or the share therein (as the case may be) which his her or their parent would have taken had such parent survived me.
7. THE SAID John Edward Dominick Philip Alphonsus Loy or any other Trustee for the time being of this my Will being a Solicitor or other person engaged in any profession or business may be so employed or act and shall be entitled to charge and be paid free of all capital transfer tax and in priority to all other dispositions under this my Will all professional or other charges for business or acts done by him or his firm in connection with the Trusts hereof including acts which a Trustee would have done personally.
