Last Will and Testament of Jesse GREAVES, dated Apr 17, 1848, Proved Sep 29, 1848. PRO Catalogue Ref: Prob 11/2080, Image Ref: 303.This is the last Will and Testament of me Jesse Greaves of Birmingham in the County of Warwick but now of Rutland House Cheltenham in the County of Gloucester Gentleman by which I mean to dispose of all my worldly Estate.
I give and bequeath to my dearly beloved niece Charlotte Ann the wife of John Lea of Cheltenham aforesaid formerly Charlotte Ann Smith Spinster all the pictures, prints, books, plate, linen, china, wines, liquors, provisions, household goods, furniture, chattels and effects (other than money or securities for money) which I shall be possessed at the time of my death absolutely for her own sole and separate use and disposal.
I give and bequeath to Elizabeth Dunn of Stourbridge in the County of Worcester Widow the sum of one hundred pounds for her own use and to Catherine Lamb Widow now residing near Bromsgrove in the said County of Worcester the like sum of one hundred pounds for her own use.
To my nephew William Handasyd Smith (brother of the said Charlotte Ann Lea) I give a legacy of fifty pounds and to my niece Catherine the wife of William Payne (sister of the said William Handasyd Smith) a legacy of one hundred pounds for her own sole and separate use and disposal and for which her receipt alone shall be a good discharge. And I direct that the last mentioned legacies shall be paid free of legacy duty.
To the treasurer for the time being of a certain Society in London called the "London Missionary Society" I give the sum of nineteen pounds to be applied by him for the use and purpose of the same Society. And I direct that the receipt of the person who shall be Treasurer of the said Society at the time when the above sum is paid shall be a sufficient discharge for the same.
I give to Charlotte Smith the daughter of Charles Smith of Noble Street in the City of London Pocket Book Maker one annuity or yearly sum of twenty pounds during her life clear of all deductions to be paid half yearly in equal portions in every year, the first payment to be made at the end of six calendar months from the time of my decease and I direct my trustees hereinafter named and appointed to lay out and invest as soon as conveniently may be after my decease a sufficient sum of money in the purchase of an annuity of the same amount as before given such annuity to be properly secured on Government or good freehold or leasehold security in England and to be paid and made payable to the said Charlotte Smith as hereinbefore appointed and immediately upon such investment being made as aforesaid the said first mentioned annuity to the said Charlotte Smith shall cease and determine.
I give and devise all my freehold, copyhold and leasehold estates and chattels real (except estates vested in me upon mortgage or trust) unto my niece the said Charlotte Ann Lea and John Dickin of Birmingham aforesaid Banker, their heirs executors and administrators cooperatively according to the natures and tenures thereof upon trust that the said Charlotte Ann Lea and John Dickin or the survivor of them, her or his heirs executors and administrators shall as soon as conveniently may be and at least within twelve calendar months from my decease sell the same either together or in parcels and either by public auction or private contract with full power to buy in and to rescind any contract for sale and to resell without being responsible for any loss occasioned thereby and to do and execute all such acts and assurances for effectuating any such sale or sales as they he or she shall think fit.
I give and bequeath All my Personal Estate (except chattels real included in the general devise hereinbefore contained and except what I have otherwise bequeathed by this my Will) unto the said Charlotte Ann Lea and John Dickin their executors and administrators upon trust that they the said Charlotte Ann Lea and John Dickin or the survivor of them or the executors or administrators of such survivor shall as soon as conveniently may be and within twelve calendar months at least from my decease call in, sell and convert into money such part of my said Personal Estate as shall not consist of money. And I declare and direct that the said Charlotte Ann Lea and John Dickin and the survivor of them and the heirs executors and administrators respectively of such survivor shall by and out of the monies to arise from the sales, calling in and conversion aforesaid (after payment of all expenses of such sales or conversion or incident thereto) and the money of which I shall be possessed at my death, pay and discharge my funeral and testamentary expenses and debts, the legacies bequeathed by this my Will and any Codicil thereto and until investment of a sum sufficient to satisfy the said annuity bequeathed to the said Charlotte Smith will pay the said annuity and shall and will also as soon as conveniently may be after my decease apply out of the monies to arise and be received as aforesaid a sum sufficient to purchase such annuity in manner before directed.
And as to the rest and residue of the said monies upon trust that they the said Charlotte Ann Lea and John Dickin or the survivor of them or the heirs, executors and administrators respectively of such survivor do and shall distribute and devise the same unto four equal parts or shares.
And as to three equal undivided fourth parts or shares In trust to pay the same unto the said Charles Smith, Elizabeth Dunn and Catherine Lamb equally between them share and share alike as tenants in common and not as joint tenants their respective executors administrators or assigns and as to one other being the remaining undivided fourth part Trustees to pay the same unto the said Charlotte Ann Lea for her own sole and separate use and disposal, her executors administrators or assigns. And I direct that the receipt alone of the said Charlotte Ann Lea notwithstanding coverture shall be a good discharge to any trustees or trustee paying the same.
I give and devise all estates and hereditaments vested in me upon mortgage or trust unto the said Charlotte Ann Lea and John Dickin their heirs executors administrators or assigns respectively according to the respective natures and qualities thereof, As to the estates and hereditaments (subject to the equity of redemption subsisting therein respectively) I direct the money secured on such mortgages shall be accrued as part of my Personal Estate. And as to estates and hereditaments vested in me upon trust I direct that the same may be dealt with according to the trusts affecting the same and be conveyed and assured when requisite and necessary and so far as the rules of Equity will permit.
And I appoint the said Charlotte Ann Lea and John Dickin joint executrix and executor of this my Will and authorize the acting executors, executrix or executor for the time being of this my Will to satisfy and debts claimed to be owing by me or my estate and any liabilities to which I or my estate may be alleged to be subject upon any evidence they he or she shall think proper and to accept any composition or security for any debt and to allow such time for payment (either with or without taking security) as to the said acting executors executrix or executor shall deem fit and also to compromise or subject to arbitration and settle all accounts or matters belonging or relating to my Estate and generally to act in regard thereto as they she or he shall think expedient without being responsible for any loss thereby occasioned. And I hereby declare that the receipts or receipt in writing of the trustees or trustee for the time being acting in execution of any of the trusts hereof, for the purchase money of the premises sold, or for any monies shares or securities which may be paid or transferred to them her or him in pursuance hereof or of any of the trusts hereof shall effectually discharge the purchaser or purchasers or other person or persons paying or transferring the same therefrom and from being required to see to the application or being accountable for the misapplication or nonapplication thereof. And I hereby also declare that the said trustees hereby appointed or either of them or any trustee or trustees to be appointed as hereinafter is provided shall die or be desirous of being discharged or refuse or become incapable to act then and so often the said trustees in the place of the trustee or trustees so dying or desiring to be discharged or refusing or becoming incapable to act then and so often the said trustees or trustee (and for this purpose any retiring trustee shall be considered a trustee) may appoint any other person or persons to be a trustee or trustees in the place of the trustee or trustees so dying or desiring to be discharged or refusing or becoming incapable to act and upon every such appointment the said trust promises shall be so transferred that the same may become vested in the new trustee or trustees or solely as the case may require and every such new trustee shall (both before and after the said trust promises shall have become so vested) have the same powers authorities and discretions as if he had been originally appointed a trustee.
And I further declare that the trustees or trustee for the time being of this my Will shall be chargeable only with such monies as they or she or he respectively shall actually receive and shall not be answerable there out for the other of them nor for any Banker, Broker or other person in whose hands any of the trust monies shall be placed nor for the insufficiency or deficiency of any stocks funds shares or securities nor otherwise for involuntary losses and that the trustees or trustee for the time being may reimburse themselves herself or himself out of the monies which shall come to their her or his hands under the trusts aforesaid all expenses to be incurred in or about the execution of the aforesaid trusts.
In Testimony whereof I the said Testator Jesse Greaves have to this my last Will and Testament contained in six sheets of paper set my hand this seventeenth day of April one thousand eight hundred and forty eight.
