This is the last Will and Testament of me Emma Hopkins of Camden Terrace Camden Street in Birmingham in the County of Warwick Widow.

First I give and bequeath all my household furniture implements and utensils of household and also all my ready money securities for money, goods, chattels and personal Estate and Effects whatsoever and wheresoever whereof or whereto I shall be possessed or entitled or have power to dispose at the time of my decease unto my good friends Robert Walter Winfield of Cambridge Street in Birmingham aforesaid Brassfounder and Edward Banbridge of No. 29 Parade in Birmingham aforesaid Merchant their executors and administrators upon trust that they my said trustees or the survivor of them his executors or administrators do and shall so soon as conveniently can be after my decease sell and dispose of such parts of my personal estate as shall not consist of money or securities for money for the most money that can be reasonably obtained for the same either by public auction or private contract and do and shall with and out of the money to arise from such sale, my ready money and securities for money pay to and reimburse themselves and themselves costs charges and expences incident to such sale or otherwise to be incurred in the execution of trusts hereby declared and also pay all the debts which shall be justly owing from me at the time of my decease and my funeral expences and the expences of the probate and execution of this my Will and do and shall stand and be possessed of the residue of the said monies and securities for money upon trust they my said trustees or the survivor of them his executors or administrators do and shall place out or continue the same or any part thereof in or upon good freehold securities at interest or invest the same or any part thereof in the purchase of stock in any of the public Funds of Great Britain in their or his names or name and from time to time alter and vary and change the same securities stocks or funds for others of a like nature at their or his discretion and do and shall stand and be possessed of the said trust money and the securities stocks or funds upon or in which the same shall be placed out invested or continued as aforesaid and the interest dividends and proceeds thereof upon trust to pay assign and transfer the same respectively unto my children Robert Hemus Hopkins, Emma Handasyd Hopkins, Anna Hopkins, Eliza Ann Hopkins, John James Hopkins and George Hopkins in equal proportions share and share alike at their respective ages of twenty one years provided always.

And I do hereby declare that in case any one or more of my said children shall die under the age of twenty one years without leaving lawful issue him her or them respectively surviving then the share or shares as well original or surviving by virtue of this clause of the said trust monies securities or funds and the interest dividends and proceeds thereof intended for such child or children so dying shall from time to time accrue and be paid assigned and transferred to the survivors or survivor of my said children if more than one in equal proportions share and share alike and if but one the whole to such only surviving child at such times or time as are hereinbefore mentioned touching their his or her original shares or share.

Provided also and I do hereby direct that my said trustees or the survivor of them his executors or administrators shall until the shares of my said children respectively shall become payable assignable and transferable apply the annual interest dividends and proceeds of the said trust money and of the securities stocks or funds upon or in which the same shall be placed out or invested in for and towards the maintenance education use and benefit of my said children respectively in proportion to their presumptive shares of the said trust money securities stocks or funds at such time or times and in such manner as my said trustees or the survivor of them his executors or administrators shall in their or his discretion think fit.

Provided also and I do hereby declare that it shall be lawful for my said trustees or the survivor of them his executors or administrators to advance any sum or sums of money they or he may think proper out and in part of the presumptive share of such of my said children of the said trust money securities stocks or funds and the interest dividends and proceeds thereof for putting him or her to any business or profession or otherwise for his or her preferment or advancement in the world although such child may not then have attained the age of twenty one years.

And whereas I am entitled for my life to the income arising from a certain sum of three hundred pounds intended to be speedily invested in the purchase of stock in the three per cent Consolidated Bank Annuities with a power of making such disposition of the said sum and stock as is hereinafter contained Now I do hereby give and bequeath the said sum of three hundred pounds and the stock in which the same shall be so invested as aforesaid unto the said Robert Walter Winfield and Edward Banbridge their executors and administrators upon trust that they my said trustees or the survivor of them his executors or administrators do and shall pay or transfer the said sum of three hundred pounds and the stock in which the same shall be so invested as aforesaid and the dividends thereof unto my said children in equal proportions share and share alike as and when they shall respectively attain the age of twenty one years provided always.

And I do hereby declare that in case any one or more of my said children shall die under the age of twenty one years then the share or shares as well original as surviving by virtue of this clause of the said sum of three hundred pounds and the stock in which the same shall be invested and the dividends thereof intended for such child or children so dying shall from time to time accrue and be paid or transferred to the survivors or survivor of my said children if more than one in equal proportions share and share alike and if but one the whole to such surviving child at such times or time as are hereinbefore mentioned touching their his or her original shares or share.

Provided also and I do hereby direct that my said trustees or the survivor of them his executors or administrators shall until the shares of my said children respectively shall become payable or transferrable apply the annual dividends of the said sum of three hundred pounds and of the stock in which the same shall be invested in for and towards the maintenance education and benefit of my said children respectively in proportion to their presumptive shares of the said money and stock at such time or times and in such manner as my said trustees or the survivor of them his executors or administrators shall in their or his discretion think fit.

Provided also and I do hereby declare that the receipts of my said trustees or the survivor of them his executors or administrators shall be effectual discharges from time to time of the purchasers of any trust property and personal effects herein made saleable for their purchase money or so much thereof as in such receipts shall be expressed to be received and that after such receipts shall be given such purchasers shall not be obliged to see to the application of such purchase money or be accountable for the misapplication or nonapplication thereof.

And that if my said trustees or either of them or any future trustees or trustee to be appointed in the stead of them or either of them or any succeeding trustee or trustees shall die or shall go to reside beyond the seas or shall be desirous of being discharged from or decline or become incapable to act in the trusts hereby created before the same shall be fully performed then and so often as the same shall happen it shall be incumbent on the surviving or continuing trustee or the executors or administrators of such surviving trustee by writing under his or their hands to appoint some person or persons to be a trustee or trustees in the stead of the trustee or trustees so dying declining or becoming disqualified to act as aforesaid and that on such appointment all the said trust estates monies and premises shall with all convenient speed be transferred so that the same may be loyally vested in the surviving or continuing trustee and such new trustee or if there shall be no surviving or continuing trustee then in such new trustees only their executors or administrators upon the same trusts as are hereinbefore declared thereof or such of them as shall be then subsisting and capable of taking effect.

And I do hereby appoint the said Robert Walter Winfield and Edward Banbridge joint executors of this my Will and declare the same to be my last Will and Testament.

And I do hereby declare that my said trustees and executors and the trustee or trustees to be appointed as aforesaid or any of them or any of their executors or administrators shall not be accountable for any more monies than they respectively shall actually receive nor for any loss which may happen to the same except by their wilful default or neglect and that such of them shall be accountable for his own executors administrators acts defaults receipts and disbursements only and that it shall be lawful for my said trustees and executors and the trustee or trustees to be appointed as aforesaid or any of them or any of their executors or administrators out of my said trust monies and the income thereof to reimburse themselves and allow to their respective cotrustee and cotrustees all such sums of money costs and expences as they shall expend or be put unto in the meantime of this my Will.

In Witness whereof I the said Emma Hopkins the Testatrix have to this and the four preceding sheets of this my last Will and Testament written upon five sheets of paper set my hand the eleventh day of August one thousand eight hundred and forty six.
