Last Will and Testament of Hugh Roberts, dated April 07, 1855. Proved at Exeter on Sep 21, 1855.

This is the last Will and Testament of me Hugh Roberts the Elder of Cadleigh in the County of Devon Gentleman as follows (that is to say)

I give and devise unto my wife Sarah Roberts and her Assigns during her natural Life All that part of my Messuage Dwelling-house and Premises called Meadhays in Cadleigh aforesaid namely the Parlor, the Parlor Chamber, Spare Bed room, Salting house, and room over the same, together with the large passage (being the Eastern part of my said Dwelling house) and the new Cellar adjoining with the room over it and that part of the Garden which lies below the lower path across such Garden and a liberty of taking water at all times from the Brass Tap in the Courtlage of the said Premises and of using the accustomed ways and paths to and from the said devised Premises through the other part of the said Courtlage. I also give and devise unto my said Wife and her Assigns during her natural Life All those my cottages with their respective Appurtenances situate in Little Silver Village in Cadleigh aforesaid The said part of Meadhaysto be free and clear from all Rates Taxes and Assessments and if any such shall be assessed or payable in respect thereof I will and direct such Assessments and Outgoings to be paid and discharged by the Person and Persons for the time being estated and possessed of and in the other part of my said Messuage or Dwelling house and Premises called Meadhays she my said wife and her Assigns reparing and keeping in good repair the Premises so devised to her as aforesaid having Timber delivered on Meadhays Estate for that purpose I further give unto my said wife for her Natural Life the use of such part of my Household goods, and Furniture as my Executors hereinafter named shall deem necessary for her Accomodation I also give unto my said Wife the sum of Fifty Pounds to be paid to her within a Month after my decease

And subject to the respective devises gifts and charges aforesaid I give devise and bequeath unto John Squire the younger late of Cruwys Morchard in the said County of Devon but now of Lancelles in the County of Cornwall Son of John Squire of Cadleigh in the said County of Devon his Heirs Executors Administrators and Assigns according to the nature Tenure and Quality of the Several Messuages Lands Hereditaments and Premises respectively my said Messuage or Dwelling-house Lands and Premises called Meadhays and all other my Lands Hereditaments and Premises in Cadleigh aforesaid and Tiverton in the said County of Devon Upon Trust nevertheless for the Ends Intents and Purposes hereinafter mentioned and declared of and concerning the same (that is to say) Upon Trust to permit and suffer my said Wife and her Assigns to receive and take out and from the rents and Profits of my Messuages Tenements and Premises in the Parish of Cadleigh aforesaid (except the part of Meadhays and the Cottages hereinbefore devised to my said Wife for her life and the chapel and yard hereinafter mentioned) An Annuity or yearly rent Charge of Fifty Pounds to be paid without any deduction or abatement whatsoever by equal quarterly payments on Lady day Midsummer day Michaelmas day and Christmas day in every year the first quarterly payment to be made on such of the said days as shall first happen after my decease which Annuity I give and devise unto my said wife accordingly

And subject to the payments and Devises aforesaid to and for my said Wife I will and direct all and singular my Messuages Lands Tenements Cottages and Premises Chapel and yard in Cadleigh and Tiverton aforesaid to be and remain and the said John Squire the younger his Heirs Executors Administrators and assigns shall stand and be possessed thereof Upon trust for myson Hugh Badcock Roberts and his assigns during his Natural Life he and they reparing and keeping in repair the same premises and from and immediately after his decease upon trust for all each and every of the children of my said son equally between them if more than one as Tenants in Common their each and every of their Heirs Executors Administrators and Assigns -.'for ever subject to and charged and chargeable with the payment Yearly and every Year for ever of the clear Annual Sum or yearly rent Charge of Seventy five Pounds sterling for the purposes hereinafter mentioned namely in the first place the said yearly sum of Fifty Pounds devised to my said wife during her natural Life asaforesaid and the remaining sum of Twenty Five Pounds unto my four daughters, Sarah, Jane, Maria, and Harriet (independant of their respective Husbands as hereinafter mentioned) equally between them share and share alike as Tenants in Common and not as joint Tenants and their respective Heirs Executors Administrators and Assigns And from and after the decease of my said wife the whole of the said Annual Sum or yearly Rent Charge of Seventy five Pounds to be and remain Upon Trust for my said Four Daughters equally between them share' and share alike their respective Heirs Executors Administrators and Assigns for Ever independant of their respective Husbands as hereinafter mentioned with respect to the Hereditaments and Premises in Cheriton Fitzpaine

And as to for and concerning my Lands Hereditaments and Premises in the parish of Cheriton Fitzpaine in the said County of Devon and all other my Real as well as all my Personal Estate not hereinbefore otherwise disposed of I give devise and bequeath the same unto the said John Squire the younger and my said son Hugh Badcock Roberts their Heirs Executors Administrators and Assigns according to the nature tenure and quality thereof Upon Trust nevertheless for the Ends Intents and purposes hereinafter mentioned and declared of and concerning the same (that is to say)

Upon Trust that they my said Trustees or the survivor of them or the Heirs Executors Administrators or Assigns of such survivor do and shall with all convenient speed after my decease sell dispose of and convert into Money such part of my Household Goods and Furniture as shall not be appropriated to or for the use of my said Wife Also my Farming stock and Implements in Husbandry and all other my saleable Chattels and Effects and collect get in and receive my Monies and Securities for Money and with or from the Monies to arise or be received therefrom to pay satisfy and discharge my just Debts Funeral, and Testamentary Expences as far as the same will extend Provided that if my Personal Chattels and Effects shall be insufficient for that purpose in such case I do further will and direct the said John Squire the younger and Hugh Badcock Roberts and the survivor of them and the Heirs Executors and Administrators of such survivor to raise such deficiency with the Expences and Charges attending the same by a Mortgage or Mortgages of my Lands Tenements and Premises in Cheriton Fitzpaine aforesaid or any part thereof for the purpose of discharging such Debts Charges and Expenses And subject to such Mortgage and Mortgages I will and direct my said Trustees or the survivor of them and the Heirs Executors Administrators and Assigns of such survivor to stand seized and possessed of such Lands Tenements and Premises in Cheriton Fitzpaine aforesaid

Upon Trust by and out of the Clear Rents and Profits of such Hereditaments and Premises or some part thereof (after discharging all Intrest to accrue due in respect of such Mortgage or Mortgages as aforesaid) to pay unto my Grandson Robert John Prickman and his Assigns during his Natural Life a clear yearly rent Charge or Sum of Ten Pounds and unto my two Granddaughters Mary Ann Prickman and Maria Prickman and their respective Assigns during their several Lives the Clear yearly Rent Charge or sum of Eight Pounds each which said Annuities I give and devise to my said Grand Children accordingly And I do hereby declare that such Annuities shall commence from my decease and be paid thenceforward by Quarterly payments the first payment to be made or begin Three Calendar Months next after my decease and be applied by my Trustees or Trustee for the time being in or towards the Clothing Maintenance or support of my said Three Grandchildren respectively and every Quarters payment to continue to be so applied until they shall severally attain the age of Twenty two Years after which time the same to be received by the Annuitants respectively by whose receipt and receipts for the same shall from time to time be a sufficient discharge I also give and bequeath unto my said Grandson Robert John Prickman the sum of Twenty Pounds to be paid when he shall attain his said age of Twenty two years

And I further will and direct the said John Squire the younger and Hugh Badcock Roberts and the survivor of them, and the Heirs Executors and Administrators of such survivor to stand seized and Possessed of all and singular my Messuages Tenements Lands Hereditaments and Premises in Cheriton Fitzpaine aforesaid subject and chargeable as aforesaid Upon Trust to permit and suffer my said Four Daughters Sarah, Jane, Maria, and Harriet to receive and take the clear rents and Annual Profits thereof after deducting the charges aforesaid or to have hold possess and enjoy the same Hereditaments and Premises to and for their respective use and benefit as Tenants in Common And their respective Heirs Executors Administrators and Assigns for ever according to the tenures and qualities of the said Hereditaments respectively separate and apart from any Husband or Husbands to whom they respectively shall or may happen to be married and without being subject or liable to their or any of their Debts Engagements or Controul And I do declare that the receipt and receipts of my said Daughters respectively for the Rents and Profits which theymay receive shall be a sufficient discharge.. and sufficient discharges for the same whether Covert or sole Provided Always and I declare it to be my will and I do accordingly direct that if any Annuity or Annuities rent Charge or Charges under or by virtue of this my will or any part or parts thereof shall be unpaid for Fourten days next after any or either of the days or times of payment aforesaid it shall be lawful for the person orpersons entitled thereto to enter into and upon all and every or any part or parts of the Hereditaments and Premises hereby charged therewith and distrain for the same with the Costs and Charges occasioned by the nonpayment thereof and to dispose of such Distress and Distresses in like manner as for rent reserved on a common demise

Provided also and I do will and declare that it shall be lawful for my said son during his natural Life to take Timber from my Estates in Cadleigh aforesaid during his Natural Life for the repairs thereof and for such other uses and purposes that he may think proper And that whilst any of my Debts shall remain unpaid it shall be lawful for my said Trustees or Trustee for the time being respectively to sell and dispose of take down carry and draw away any Timber Tree or Trees growing or to grow on any or either of the Hereditaments and Premises hereinbefore directed to be charged with the payment of my Debts or any part thereof for the purpose of raising Money to expedite the payment of such Debts And for facilitating any mortgage or Mortgages which may be made under or by virtue of this my will I do declare that the Receipt and Receipts of my said Trustees and Trustee for the time being shall be a sufficient discharge and sufficient discharges for the Money and Monies lent paid or advanced thereon And that the person and persons lending paying or advancing the same shall not be liable for any loss misapplication or nonapplication thereof Nor to acertain whether any such Money or Monies shall have been required or wanted to be raised for the purposes of this my Will nor to acertain or inquire whether my Personal Estate and Effects or any part thereof have or hath been got in and applied for the purposes aforesaid And I do expressly authorise my said Trustees and the survivor of them and the heirs Executors and Administrators of such survivor to raise by the ways and means aforesaid such sum and sums of Money as he or they shall require in the performance of this my Will although the same may not have been herein specifically provided for

All the Residue and Remainder of my Personal Estate and Effects (if any be) after the discharge of my Debts Funeral Testamentary and Trusts Expences I will and direct to be equally divided among my said Four Daughters, Sarah, Jane, Maria, and Harriet share and share alike as Tenants in Common, Provided Also and I do further will and declare that the said John Squire the Younger and Hugh Badcock Roberts and the survivor of them and the Heirs Executors and Administrators of such survivor shall not be charged or chargeable with or for any more monies or Effects than shall actually come to their Hands respectively under or by virtue of this my will and any one or more of them shall not be answerable or accountable for the other or others of them, but each and every of them for his own Acts Deeds Neglects and Defaults only Nor for joining in receipts for the sake of conformity Or for any loss by placing or depositing any money or monies in any Public Bank or Banks And that it shall belawful for the said Trustees & Trustee his Heirs Executors and Administrators with and out of the Monies which may come to their respective hands to retain to and reimburse themselves respectively all such Costs Charges Losses Damages and Expences as they any or either of them shall or may sustain expend layout or be put unto in or about the aforesaid Trusts and the performance of this my Wife or in any manner relating thereto

And lastly I nominate and appoint the said John Squire the younger and Hugh Badcock Roberts Executors In Trust of this my last Will and Testament hereby revoking every Will by me heretofore made In Witness whereof I the said Hugh Roberts the Testator have to this my last Will and Testament written on Five Sheets of Paper subscribed and set my Hand and seal, namely my Hand to the first four sheets and my hand and seal to this Fifth Sheet the seventh day of April One thousand eight hundred and fifty five

Appeared Personally John Squire, (the younger,) of the parish of Lancelles, in the County of Cornwall, Yeoman, and Hugh Badcock Roberts, of Cadeleigh in the County of Devon Yeoman the Executors named in the last Will and Testament of Hugh Roberts (the Elder) late of Cadleigh aforesaid, Gentleman who died on or about the Eighteenth day of April 1855 and made oath that the Estate and Effects of the said deceased which he any way died possessed of or entitled to within the ARCHDEACONRY OF EXETER, and for or in respect of which a Probate of the said Will is to be granted, exclusive of what the deceased may have been Possessed of or entitled to as aTrustee for any other person or persons, and not beneficially, and without deducting any thing on account of the Debts due andowing from the deceased, are under the Value of Six hundred Pounds, to the best of the Deponents knowledge, information and belief, And they lastly made Oath, that the said deceased was not possessed of or entitled to any Leasehold Estate or Estates for Years either absolute or determinable on Lives, to the best of their knowledge, information and belief.

This is the last Will and Testament of me Sarah Roberts of Cadeleigh the County of Devon Widow.

I appoint John Squire the Elder of Mill Farm in the said parish of Cadeleigh Yeoman and Richard Poole of Bathealton in the County of Somerset Yeoman Executors of this my Will.

I give and bequeath unto my four Daughters Sarah the Wife of Robert Were of Pitt Farm in the parish of Hennock in the County of Devon Yeoman, Jane the Wife of the said Richard Poole, Maria the Wife of John Shattock Stevens of ... and Harriet the Wife of John Squire the younger of Launcells in the County of Cornwall Yeoman all my ready money, moneys in the Bank and all other sum and sums of money of which I may die possessed together with my Plate, Books and Wearing Apparel equally to be divided between them for their separate use respectively independent of the debts, control or interference of their respective Husbands and for which the receipts of my said Daughters respectively shall alone be sufficient discharges.

I give and bequeath unto my said Executors John Squire the Elder and Richard Poole all my Household Goods and Furniture and all my Personal Estate whatsoever and of what nature or kind sover (not hereinbefore specifically disposed of) Upon trust with all convenient speed after my decease to sell dispose of and convert into money so much thereof as shall be in its nature saleable and collect get in and receive the residue thereof and with and out of the said moneys pay satisfy and discharge all my just debts funeral and testamentary expenses and subject thereto To pay unto my Grand Children Robert John Prickman, Mary Ann Prickman and Maria Lavinia Prickman the sum of Three Pounds Sterling each to purchase suits of mourning and to pay and divide the residue thereof unto between and amongst my said four Daughters Sarah Were, Jane Poole, Maria Stevens and Harriet Squire and my son Hugh Badcock Roberts in equal shares and proportions the shares of my said Daughters to be for their separate use respectively and for which their respective receipts shall alone be sufficient discharges.

Travelled to New Zealand on the sailing ship "Lyttleton" to marry Alfred Walter MONEY, having met him in England some years earlier. Upon arrival, Alfred met her on horseback, leading a second mount for her to ride. The couple took the bridle track to the Carlton Hotel, which Alfred owned, he having emigrated to New Zealand some years earlier from Wisbech, Cambridgeshire.

THIS IS THE LAST Will AND TESTAMENT of me SARAH WERE of No 1 Horsdon Terrace Tiverton in the county of Devon widow.

I desire to be buried in the Burial Ground of the Independent Chapel in the parish of Cadeleigh in the said county and that my funeral may be conducted by Messieurs Thorne Brothers of Tiverton Drapers. I give my gold watch and chain to my daughter Maria Symons Carpenter. I give all my plate and plated articles and jewellery to my daughter Harriet Roberts Quick and I give all my wearing apparel to my said daughters Maria Symons Carpenter and Harriet Roberts Quick equally to be divided between them.

All the residue of my estate and effects whatsoever and wheresoever I give devise and bequeath unto Henry Mudford of Tiverton China Merchant and John Thorne of the same place draper (hereinaf­ter called "my trustees"). Upon trust that my trustees shall sell call in and convert into money the same or such part thereof as shall not consist of money and shall with and out of the proceeds thereof and with and out of my ready money pay my funeral and testamentary expenses and debts and shall stand possessed of the residue upon the trusts following (that is to say).

As to the sum of three hundred and sixty pounds part thereof in trust for all the children of my late daughter Margaret Wotton who shall attain the age of twenty one years in equal shares as tenants in common. As to the sum of five hun­dred pounds further part thereof in trust for all the children of my deceased daughter Sarah Melhuish (except her son John who became entitled to Hatherland Farm in the parish of Washfield Devon) who shall attain the age of twenty one years in equal shares as tenants in common. As to the sum of three hundred and sixty pounds further part thereof in trust to invest the same in or upon such securities as may for the time being be authorised by law and to pay the income thereof unto my said daughter Maria Symons Carpenter for her life without power for her to anticipate the same and upon her de­cease to stand possessed of the said sum and the investments for the time being repre­senting the same in trust for Robert Were, Frank, Alfred, Sarah Were, John Seymour, Gwineth Leslie [sic] (being six of the children of the said Maria Symons Carpenter) in equal shares as tenants in common and I direct that if any of the said six children shall die under the age of twenty one years the said sum shall be divided among the remainder of them who shall attain that age in equal shares. As to the sum of three hundred and sixty pounds further part thereof in trust to invest the same in or upon such securi­ties as may for the time being be authorised by law and to pay the income thereof unto my said daughter Harriet Roberts Quick for her life without power for her to antici­pate the same and upon her decease to stand possessed of the said sum and the investments for the time being representing the same in trust for all the children of the said Harriet Roberts Quick who shall attain the age of twenty one years in equal shares as tenants in common.

And as to the sum of fifty pounds further part thereof in trust to retain and divide the same equally between them my trustees for the trouble they may have in carrying out the trusts of this my will.

And as to the residue of my said es­tate in trust for and to divide the same between my said daughters Maria Symons Carpen­ter and Harriet Roberts Quick absolutely so that the share of the said Harriet Roberts Quick shall exceed by twenty pounds the share of the said Maria Symons Carpenter (to whom I have already advanced the sum of twenty pounds) Provided always.

And I declare that if any grandchild of mine entitled in expectancy to a share of my estate under this my will shall at my death (or in the case of the children of the said Maria Symons Carpenter and Harriet Roberts Quick respectively at the death of his or her mother) be under the age of twenty one years my trustee shall invest the expectant share of each such minor with power to vary the investments thereof from time to time and the income thereof shall be applicable for his or her maintenance education advancement or benefit in such manner as my trustees shall in their discretion think fit. Provided fur­ther and I also declare that in the event of my estate proving insufficient to provide the several sums hereinbefore directed to be set apart or paid thereout such several sums shall abate or be reduced rateably.

Provided lastly and I also declare that if my said daughter Harriet Roberts Quick shall within three calendar months after my death by notice in writing to be given to my trustees or one of them offer to purchase the dwellinghouse and premises now in my occupation then and in such case the said dwellinghouse and premises shall be sold to my said daughter at a price to be agreed upon be­tween her and my trustees or if they are unable to agree then at a price to be deter­mined by valuation in the usual way.

And I appoint the said Henry Mudford and John Thorne EXECUTORS of this my will.
