Last Will and Testament of Peter Were, dated Dec 30, 1845 with a Codicil dated Jul 15, 1846. Proved on Sep 18, 1846.

This is the Last Will and Testament of me Peter Were of Washfield in the County of Devon Gentleman as follows (that is to say).

I give and devise unto my Nephew Robert Were the Younger of Farley in the Parish of Tiverton in the said County and his Assigns for and during the natural Life of my Sister Nancy Coles an Annuity or clear yearly Rent Charge or Sum of Twenty Pounds without any deduction or abatement for any present or future Taxes whatsoever to be issuing and payable out of my Messuage Tenement Estate and Premises called Coombe Pit, otherwise Higher Farley situate in the Parish of Tiverton aforesaid Upon Trust nevertheless for the sole and separate use and benefit of my said Sister Nancy Coles independantly and exclusively of any husband to whom she may be married and without being in any wise subject to his Debts Engagements or Controul. And I do declare that the receipt and receipts of the said Nancy Coles whether she be covert or sole shall be good and sufficient discharges for the said Annuity or any part thereof. The said Annuity or clear Yearly Rent Charge or Sum of Twenty Pounds to be paid to the said Robert Were or his Assigns In Trust as aforesaid by four equal quarterly payments on Lady day, Midsummer day, Michaelmas day, and Christmas day in every year the first payment to be made on such of the said Quarter days as shall first happen next after my decease And I do subject and Charge my said Messuage Tenement Estate and Premises to and with the payment of the said Annuity accordingly And in case the said Annual Sum or yearly rent charge or any part thereof shall be unpaid for the space of Fourteen days next after any or either of the aforesaid days whereon the same is or ought to be paid as aforesaid it shall be lawful for the said Robert Were his Executors Administrators and Assigns to enter upon all and every or any part of the Hereditaments and Premises hereby charged therewith and to distrain for the same or so much thereof as shall be so in arrear with costs and make sale of such Distress and Distresses as for rent reserved by Lease on a common demise as often as such nonpayment shall occur Provided always and I do expressly declare that in case the said Nancy Coles shall sell, assign, incumber, transfer or in any manner dispose of by way of anticipation the said Annual Sum or Yearly rent Charge of Twenty Pounds or any part thereof Then and in such case And from and immediately after such Sale Assignment Transfer or disposition the said Annual Sum or Yearly rent charge shall cease determine and be void and merge in the Freehold and Inheritance of the Hereditaments and Premises hereby Charged therewith as fully and effectually as if the said Nancy Coles was actually dead

And subject to the Payment of the said Annuity I give and devise the said Messuage or Tenement Estate and Premises called Coombe Pit otherwise Higher Farley with the appurtenances unto my Two Nephews Peter Were and Henry Were of Washfield aforesaid Sons of my Brother John Were their Heirs and Assigns for ever as Tenants in Common and not as joint Tenants

I give and bequeath unto my Niece Harriet (Daughter of my said Brother John Were) the Sum of Fifty Pounds to be paid by my Executors hereinafter named within one Year next after my decease.

I give and bequeath unto each and every of my Brothers and Sisters (Agnes excepted) the Sum of One Hundred Pounds to be paid by my Executors within One Year next after my decease and I will and direct that if any one or more of my said Brothers and Sisters (Agnes excepted) shall happen to die in my Life time leaving a Child or Children who shall be living at my decease. Then in every such Case the Legacy of every such Brother and Sister so dying shall be paid to and among the Child or Children of every such deceased person in equal proportions if more than one and if but one to such only Child so that such Child and Children of every such Brother and Sister so dying may have his her or their Parent's Legacy or Sum of One Hundred Pounds.

I give and bequeath unto my sister Agnes Waterman the sum of Nineteen Guineas if she shall be living at my decease to be paid by my Executors within one Year next after my decease.

I give and bequeath unto the Child and Children of my deceased Sister Sarah Leach the Sum of One Hundred Pounds to be paid to them respectively by my Executors within One Year next after my decease equally between them if more than One and if but One to that only Child.

I give and bequeath unto the Child and Children of my deceased Sister Susannah Coles the like Sum of One Hundred Pounds to be paid to them respectively by my Executors within One Year next after my decease equally between them if more than One and if but One to that only Child.

I give and bequeath unto Eliza Anstey Spinster now residing with me the Daughter of Thomas Anstey of Washfield deceased the Sum of Two Hundred Pounds if she shall attain her age of Twenty One Years to be then paid by my Executors.

I give and bequeath to Nancy Leach Daughter of my said brother John Were the sum of One Hundred Pounds to be paid within One Year next after my decease. I give and bequeath unto Elizabeth Dorrell Daughter of my late deceased Sister Susannah Coles the sum of Fifty Pounds to be paid within One Year next after my decease.

I give and bequeath unto my Sister Joanna Durstone the Wife of Samuel Durstone of London Cabinet Maker the sum of One Hundred Pounds to be paid within One Year next after my decease.

I give and bequeath unto my Sister Margaret Were of the City of Bristol Spinster the sum of One Hundred Pounds to be paid within One Year next after my decease.

And I will and direct that every Legacy bequeathed to any woman who at the time appointed for payment thereof as aforesaid shall happen to be married shall be for her and their sole and separate use and benefit and independent of the Debts, Engagements or Control of any Husband or Husbands and I do declare that their respective receipts alone shall be sufficient discharges for the same whether covert or sole.

All the rest residue and remainder of my Real Estate Together with my Monies and securities for money, Farming stock, Implements in Husbandry, Goods, Chattels, Personal Estate, and Effects, of what kind or nature soever or wheresoever not hereinbefore disposed of I give devise and bequeath unto my said Nephews Peter Were and Henry Were their Heirs Executors Administrators and Assigns. They the said Peter Were and Henry Were paying my Just Debts, Legacies, Funeral and Testamentary Expences and burying me in a decent manner. And lastly I nominate and appoint the said Peter Were and Henry Were Executors of this my last Will and Testament. In Witness whereof I the said Peter Were the Testator have to this my last Will and Testament subscribed and set my Hand and Seal the Thirtieth day of December One thousand eight hundred and forty five.

Appeared personally, Peter Were of Washfield in the County of Devon and Henry Were of Washfield aforesaid Gentlemen the Executors named in the last Will and Testament and one Codicil annexed of Peter Were late of Washfield in the said County of Devon Gentleman deceased who died on the fourth Day of August 1846 and made oath, that they have made diligent search and due enquiry after, and in respect of the personal Estate and Effects of the said Deceased, in order to ascertain the full Amount and Value thereof; and that to the best of their Knowledge, Information, and Belief, the whole of the Goods, Chattels, and Credits, of which the said Deceased died possessed within the Archdeaconry of Exeter, (exclusive of what the Deceased may have been possessed of or intitled to as a Trustee for any other Person, or Persons, and not beneficially, but including the Leasehold Estates for Years of the Deceased, whether absolute or determinable on Lives, and without deducting any Thing on Account of the Debts due and owing from the Deceased) are under the Value of Four thousand pounds to the best of these Deponents Knowledge, Information, and Belief.
