This is the last Will and Testament of me Samuel Joce of Youlden within the Parish of Landkey in the County of Devon

First I direct limit and appoint give devise and bequeath unto my Friend John Westacott of Landkey aforesaid Gentleman his Executors Admons and Assigns All those my Messuages Lands Tenements and Hereditaments called Hurscott and Stepsfoot situate and lying within the Parish of Swimbridge in the Said County, and Hakeford situate and lying within the Parish of Stoke Rivers in the said County To hold the same with their each[?] and every of their respective rights members Appurtenances unto the said John Westacott his Executors Administrators and Assigns for and during the full and complete Term of Seventy Years to commence and be computed from the time of my Discease Upon the Trust nevertheless and for the ends intents and purposes and under and subject to the Powers Provisoes and Conditions hereinafter expressed concerning the same that is to say.

Upon trust that he the said John Westacott his Executors Administrators or Assigns shall and do out of or by means of the Rents Issues and profits of the Hereditaments and Premises comprised in the said Term or by Mortgage Sale or other disposition thereof or of a competent part of part thereof for all or any part of the said Term or by bringing Actions against the Tenant or Occupier Tenants or Occupiers of the said Premises or by making entries thereupon or by any other lawfull ways or means which he or they shall think fit raise and buy during the Natural Life of my Dear Wife Sarah Joce One annuity or Clear Sum of Forty Pounds of lawful Money of the United Kingdom of Great Britain and Ireland current in Great Britain clear of all deductions whatsoever together with all Costs Charges Damages and expences attending the execution of the said Trusts And do and shall pay such Annuity of Forty Pound unto my said Wife or her Assigns for her and their own proper Use and benefit by equal quarterly payments on the twenty fifth day of March the twenty fourth day of June the twenty ninth Day of September and the twenty fifth Day of December in every Year the first Payment to be made on such of the said days of Payment as shall next happen after my Discease. And to and for this further Trust intent and purpose that in case any quarterly payment of the said annuity of Forty Pounds or any part thereof shall at any time be in arrear and unpaid by the space of Twenty Days Next after either of the said Days appointed for payment thereof as aforesaid that then and in such case as often as the same shall happen it shall and may be lawfully ...and for my said Wife or her Assigns into and upon the severall Hereditaments and Premises comprised in the said Term or any of them to enter and distrain and the distress and distresses then and there found to detain and keep until all such arrears and all cost charges damages and expenses attending the taking and Keeping such Distress or Distresses shall be fully paid and satisfied. And in default of Payment thereof or of any part thereof within five days after such distress or Distresses shall be s.. taken to appraise sell and dispose thereof or otherwise act therein according to Law in like manner as in cases of Distress made or taken for arrears of Rent received on common Leases for Years such only when made to be without impeachment of waste Provided always.

And I do hereby declare that from or immediately after the decease of my said wife and after all arrears which shall be then due of the annuity aforesaid together with all costs charges and ...attending the Execution of the Trust of the said Term of Seventy Years of and in the Hereditaments and Premises therein comprised the Same Term of Seventy years or so much thereof as shall be disposed of for the purposes aforesaid shall cease determine and be absolutely void to all intents and purposes whatsoever (anything Herebefore contained to the contrary notwithstanding) but nevertheless without prejudice to any Sale Mortgage or other disposition which shall have been made if any part of the said Premises in Persuance of the Trust hereinbefore declared concerning the same.

And from and immediately after the end expiration or other sooner determination of the said Term and in the mean time subject thereto and to the Trust thereof I do hereby direct limit and appoint give and devise All those my before mentioned Hereditaments unto and to the only use and behoof of my Son Samuel Joce (provided he my said Son Shall live to attain the age of twenty one Years) his Heirs and Assigns forever but should my said Son happen to die before having attained his said age of twenty one Years Then I direct Limit and appoint give and devise All those my before mentioned Lands Tenements and Hereditaments unto my Brothers in Law John Charley of Combmartin in the said County and William Buckingham their Heirs and Assigns To hold the same with the appurtenances unto and to the only Use and behoof of the said John Charley and William Buckingham their Heirs and Assigns forever nevertheless as Tenants in Common and not as joint Tenants.

And I do by this my Will nominate and appoint the said John Charley William Buckingham and John Westacott Trustees for my said Son & During his minority do hereby give to them and to the Survivors or Survivor of them full power and Authority to lease all or any part of my Freehold Estate to any Tenant or Tenants for any Term or Terms of Years in possession not exceeding Seven Years in any one Lease or Demise at the Best improved Yearly Back Rent without taking any fine premium or foregift for the same that for the time being can or may be had or obtained for the same. And I do hereby direct that no timber or coppice Wood growing or to grow on my said Freehold Estate (otherwise than as shall be absolutely necessary for repairs) shall at any time during the Minority of my said Son be cut down excepting the last Year of such Minority when I hereby direct the said John Charley William Buckingham and John Westacott or the Survivors or Survivor of them to cut down sell and convert into Money all such coppice Wood and to apply the Money to arise from the Sale thereof to and for the Benefit and advantage of my Said Son in such manner as they or he in their or his discretion shall think fit.

Also I give and bequeath unto my said Wife and Article of a sort of my Household Furniture to be chosen by herself. And as to all the rest residue and remainder of my personall Estate of every description and denomination and wheresoever situated and being I give and bequeath the same unto the said John Charley William Buckingham and John Westacott and to the Survivors and Survivor of them his Executors and Administrators Upon Trust that the said John Charley William Buckingham and John Westacott the Survivors or Survivor of them do and shall with all convenient dispatch after my Discease sell and convert the same into Money and apply the Money to arise from such Sale towards the payment and discharge so far as it will go of my just debts and funeral Expences and in case any Money shall remain to apply such overplus for the Benefit of my said Son. And I do hereby declare that the Receipt or Receipts of the Trustees or Trustee for the time being of the said Trust Premises for any Money payable to them or him under or by virtue of the Trusts aforesaid shall effectually discharge the Person or Persons to whom the same shall be given from being answerable or accountable for the Misapplication or Nonapplication or from being obliged to See to the application of the Money therein expressed to be received.

And I do hereby nominate and appoint the said John Charley William Buckingham and John Westacott joint Executors in Trust of this my last Will and my said Wife Guardian of my said Son. And further I do hereby empower the said Trustees or Trustee for my said Son for the time being at any time during his Minority to advance any Money for his furtherance in life they or he may deem necessary. And Lastly it is my will and I do hereby direct that the said Trustees or either of them shall not be answerable the one of them for the others or other of them or for involuntary losses. And that it shall be lawful for them to reimburse themselves and allow to the Co-Trustees or Co-Trustee their respective Costs and Expences in discharging the Trusts aforesaid out of the Money which shall come to their or his Hands by virtue hereof. In witness whereof I the said Samuel Joce have to this my Last Will and Testament contained in four sheets of paper to the first three sheets thereof set my Hand and to this fourth and last sheet set my Hand and Seal this seventh day of October in the Year of our Lord one thousand eight Hundred and fifteen.

This is the last Will and Testament of me Joan Joce of the Parish of Landkey in the County of Devon Widow, which I make and ordain in manner following.

First I give and bequeath unto my Son John Joce of the Parish of Landkey aforesaid the sum of five Pounds. Also unto my Daughter Mary Charley, eight Pounds. Also unto my Daughter Elizabeth Charley five Pounds, also all my wearing Apparel. Also I give unto my Grandson Samuel Joce Son of Samuel Joce late of Youlden in Landkey aforesaid one Pound. Also I give unto Elizabeth Hartnull, Mary Ann Buckingham and Grace Buckingham my Granddaughters five Pounds each. Also I give unto Thomas Joce Buckingham, William Buckingham and John Buckingham my Grandsons one Pound each, the above legacies are to be paid by my Executor within six Months after my decease.

All the residue and remainder of my Goods and Chattels after discharging my Funeral expenses I give and bequeath unto my Son in law William Buckingham of Landkey aforesaid whom I make sole Executor of this my last Will and Testament.
