In the Name of God Amen I David Audesley of the Parish of St James in the Liberty of Westminster in the County of Middlesex Plaisterer being Sick and Weak in body but of sound mind and memory praised be God Do make and Ordain this my last Will and Testament in manner and forme following (that is to say).

First I Commend my Soul to God that gave it and my body I Commit to the Earth to be buryed in Christian burial at the discretion of my Executors herein after named in Certain Expectation of a Joyful Resurrection at the last day and in respect of the Worldly Estate God hath been pleased to bless me with I give and dispose of the same as followeth Viz' Imprimis

And of this my last Will and Testament I do hereby make and Appoint the said Mr William Blakesley and the said Mr Thomas Elliott Joint Executors In trust for my said three last named Children And I do hereby Order and Impower my said Executors to sell all or such part of my Estate as they shall think proper and necessary to sell and to place out at Interest all the Clear moneys that shall arise thereby and all other my moneys for the use of my said three Children And to lay out and expend such money for the Education and Maintenance and also for the placing out Apprentice or otherwise of my said three Children or any of them as they my Executors shall see proper and Convenient. In the Name of God Amen I James Audsley of the Parish of Saint James within the Liberty of Westminster in the County of Middlesex Bricklayer do make this my last Will and Testament in Manner and form following. First and Principally I humbly recommend my Soul to God who gave it and my Body I commit to the Earth to be decently interred in the Church Yard belonging to the Parish of Saint James aforesaid.

Item. I will and direct that all my just debts and funeral Expences be in the first place paid and satisfied.

Item. I give and bequeath unto my Dear Wife Letitia Audsley all my household furniture linen plate and jewellery together with the Sum of one hundred pounds to be paid to her immediately after my decease to put herself into Mourning and to answer her other immediate Occasions.

Item. I give to my said Wife the Guardianship of such of my Children as shall be under the age of twenty one years at the time of my decease until they shall respectively attain that Age. And I also give her the Rent Interest and Profits of their respective fortunes or portions which they shall be entitled to by this my Will until they shall be respectively intitled to the same in Possession as herein after is mentioned my said Wife maintaining my said Children until they shall be entitled to the possession of their said fortunes respectively.

Item. I give and bequeath unto my Son David Audsley in case he shall live to attain his age of twenty one years my Book Case and all my Books but in case of my said Son's death before his attaining his said Age of twenty one years then I give and bequeath the said Book Case and Books to my Son Joseph Audsley. And my desire is that the said Books may be preserved and not sold nor the number lessened as long as conveniently may be.

Item. I give and bequeath to my Sister Mrs Sarah Handasyd To Mrs Sarah Williamson of Coventry (my Wife's Mother) and to my good friends James Warner of the said Parish of Saint James Gentleman and Robert Young of the same Parish Surgeon and to each and every of them the sum of ten pounds for Mourning.

Item. I give devise and bequeath all the Rest Residue and Remainder of my Estate real and personal unto the said James Warner and Robert Young their heirs Executors and Administrators upon Trust for and for the only Benefit of my said Wife and of all and every my Children born or in ventre sa Mere at the time of my decease to be equally divided between my said Wife and Children share and share alike the sons to receive and take their respective shares thereof in Possession at their respective Ages of twenty one years and the Daughters to receive and take their respective shares thereof in Possession at their respective Ages of twenty one years or days of Marriage which shall first happen.

Item. My will is that if one or more of my Children shall happen to depart this Life before he she or they become intitled to his her or their part or shares of my said Estate and without lawfull issue then the parts or shares of him her or them so dying shall go to the survivors of them share and share alike And the whole to the survivor of them if but one.

Item. My Will is that my said Trustees may lay out and expend out of each of my Children's fortunes respectively who shall be under the Age of twenty one years at the time of my Decease any sum of Money not Exceeding One hundred pounds in placing out of my Children to Trades or otherwise.

Item. My Will is that if my said Wife do refuse to maintain any of my Children as aforesaid that she shall have no Benefit by this my Will.

Item. My Will further is that my said Trustees may pay and apply the Rents Interest and Profits of each of my Children's fortunes respectively who shall be under the Age of twenty one years at the time of the Decease of my said Wife for the Maintenance and Education of such Child or Children until they shall be intitled to the Possession of their said fortunes respectively. And my Will also is and I do hereby authorize and impower my said Trustees and the Survivor to lend and place out at Interest or otherwise best lay out in or on some Government Publick or real Stocks funds or Securities all or any of the Moneys which they shall be intitled with by virtue of this my Will and from time to time to call and receive in the Moneys so lent or placed out on Securities and to sell and dispose of the Stocks so to be purchased or any part thereof and again to lend place out or invest the same Moneys or any Part thereof in Manner aforesaid as often as there shall be occasion and they shall think fit but so as the same be done with the Consent of my said Wife during her Life. And my Will likewise is that my said Trustees or either of them their or either of their Executors or Administrators shall not be charged or chargeable with or lyable to make good any loss or damage which shall or may happen by putting or placing out at Interest or vesting or laying out any Moneys or disposing exchanging giving up or altering any securities or stocks as aforesaid or compounding or prolonging the time or times of payment of any debt or debts owing to me or otherwise acting in the execution of any Trust hereby in them reposed without their wilful neglect default or collusion respectively nor shall they or either of them be answerable for any other of them nor for any Payment nor for any Act Deed or Default of the other of them for or relating to any such Trust or Trusts Moneys Effects or Securities as aforesaid. And that my said Trustees and the survivor of them and the Executors and Administrators of such survivor may by and out of the said Trust Moneys and Securities respectively deduct and reimburse themselves all Loss Costs Charges Damages and Expences which they any or either of them shall sustain or be put unto in or about the Execution of any Trust hereby in them reposed or by Reason or Means thereof.

Lastly I do hereby nominate and appoint my said Wife Letitia Audsley sole Executrix of this my Will and do hereby revoke all other or former Wills by me at any time heretofore made and do declare this to be and contain my last Will and Testament. My Brothers John and Thomas Blakesley being both in good Circumstances and not wanting any assistance from my fortune I therefore leave to them only Twenty pounds a piece for Mourning. I leave to my sister Sarah Williamson fifty pounds and to her Child by her present husband fifty pounds. I direct that my Executor after named shall as soon as sufficient of my Effects shall come to his hands pay off the Mortgage on and also renew the Lease of my two Houses in Vine Street and Fir Street by Picadilly. And I give my said two Houses to my Neice Laetitia Audsley for and during so many years of the present and future Term to be granted therein as she shall live and upon and after her decease I give my said House in Vine Street to her Son and my great Nephew David Audsley and my said House in Fir Street to her Son and my great Nephew William Audsley but in case either of my said great Nephews shall die in the Life time of their said Mother Then I give both my said Houses to the Survivor of them his Executors and Assigns for the residue of the Term which shall be then to come therein. And in case both my said great Nephews shall die in the life time of their said Mother Then upon and after the decease of my said Neice Laetitia Audsley I give both my said Houses unto and among all and every her Child and Children who shall be then living their Executors and Assigns for the residue of the Term which shall be then to come therein. And in case my said Neice shall leave no Child living at her death Then upon and after the decease of my said Neice I give both my said Houses unto my Brother in Law James Audsley his Executors and Assigns for the residue of the Term which shall be then to come therein. And I give devise and bequeath unto my said Brother in Law his Heirs Executors and Assigns all the rest residue and remainder of my Estate both Real and Personal and I Constitute and Appoint him my said Brother in Law sole Executor of this my Will.

This Will was proved at London before the Worshipfull Robert Chapman Doctor of Laws Surrogate of the Right Worshipfull John Bettesworth Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted on the ninth day of September in the year of our Lord One thousand Seven Hundred and forty eight by the Oath of James Audsley the sole Executor named in the said Will to whom Administration was granted of all and singular the Goods Chattels and Credits of the said deceased He being first sworn duly to Administer /Ex.
