PRO Catalogue Ref: Prob 11/491, Image Ref: 364.In the Name of God Amen I Thomas Niccolls Citizen and Merchant of London now dwelling at Highgate in the County of Middlesex and of sound and disposing mind and memory though at present somewhat indisposed in my bodily health and therefore calling to mind the frailty and uncertainty of humane Life Doe make and ordain this my last Will and Testament as followeth (viz't).
Imprimis. I Recommend my Soul into the hands of Allmighty God its faithfull Creator and Redeemer And my body I commit to the Earth to be decently but privately buryed at the discretion of my dear and loveing Wife whom I hereby make and constitute sole Executrix of this my Will.
Item. as to such worldly Estate as it hath pleased God to bless me with I give and dispose thereof as followeth (viz't). All such reall Estate whereof I have left my selfe any power of Disposeall I give devise and bequeath unto my two Daughters Katherine and Ann share and share alike and to their respective Heirs Executors and Administrators for ever. And if it shall happen that both my Daughters shall Depart this life without Issue of their respective Bodies and not having in their respective Life times Disposed of their respective shares of my said reall Estate or any part thereof to any person or persons whatsoever Then and in such case only I give devise and bequeath what shall not by them or either of them be Disposed of unto my said dear and loveing Wife Katherine and to her Heirs and assigns for ever. And my mind and Will is that in case my dwelling House at Highgate aforesaid with its appurtenances (either by the Gift Grant or Settlement of my said Wife or otherwise) Doe and shall come unto and be vested in one of (and not both) my said Daughters Then and from thenceforth my other Daughter shall have and receive for and in lieu of her part or share of and in the said House the full sume of Four Hundred pounds Sterling to be paid unto her Heirs Executors Administrators and Assigns by my said Executrix. And for prevention both of trouble and charge in the Division of my said reall Estate by the course of Law between my said two Daughters my mind and Will is That my eldest Daughter Katherine may and Doe take and have to her and her Heirs All my Estate at Pentreheilin Llandreganwin and Trederwin in the County of Montgomery at the value of Three Thousand and Three Hundred pounds Sterling and that my younger Daughter Ann may and doe take and have to her and her Heirs All my Estate in Houses and Land in the Towne and County of Salop at the value of Fourteen Hundred pounds Sterling.
Item. I give the silver Bason (given to my late son John at his Christening by his Godfather Alderman Nicoll lately deceased) and the silver Tankard (by him also given me and my Said Wife at our Marriage) unto my said two Daughters willing that the eldest shall take her choice thereof. And all the residue of my Plate with the Furniture of my best Chamber and my Coach Charriott and Coach Horses I give and bequeath unto my said Wife and also her Pearle Necklace.
And Whereas the Company of Ironmongers within the City of London are indebted unto me the sume of Five pounds Sterling I hereby give and bequeath the same unto the poor of the parish of Llandisilea in the aforesaid County of Montgomery to be distributed amongst them by and at the discretion of my said Executrix.

In the Name of God Amen I Catherine Niccolls of Highgate in the County of Middl'x Widow Relict and Executrix of Thomas Niccolls late of Highgate aforesaid Merchant deceased being in good and perfect memory and understanding do make and Ordain this my last Will and Testament in manner following.
Imprimis. I Command my Soul into the hands of Almighty God hoping for Salvation through the merits of my Redeemer Jesus Christ and my Body I direct to be verily privately buryed in the Church or Chapel of Highgate aforesaid and as near to my said late Dear husband as conveniently it can be placed at night without any pallbearers and attended only by my own man and maid.
And as for my Worldly Estate either in my power or possession I dispose thereof in manner following that is to say. I give to my said Son William Congreve the Sum of Five hundred pounds of Lawfull money of Great Britain being the same Sum of Five hundred pounds mentioned in the Agreements or Indentures made upon the Marriage of my said Son with my Daughter Catherine his late Wife deceased to be paid by my Executors after my Decease and to be in Lieu of and Satisfaction for the same Sum of Five hundred pounds the same to be disposed of in manner as in the said Agreements or Indentures is mentioned concerning the same.
Item. I give and direct to be paid to my Daughter Anne the Sum of One thousand pounds of lawful money of Great Britain which said Sum of One thousand pounds is hereby given and directed to be paid unto her in full Satisfaction and lieu of and for any part of the money for which the house in Shrewsbury near the Corn Market was sold and also in lieu and Satisfaction of and for all Claims and Demands whatsoever to be made by her her Executors Administrators or Assigns from or out of the Personal Estate of my said late Husband and her late Father or out of any part of my Personal Estate or any part of the Personal Estate in my Possession as Executrix to my said late Husband (Save and Except such Legacys or Bequests as are herein after given and bequeathed unto her). And if my said Daughter shall make any other Claym or Demand out of the said Personal Estate or Estates other than as aforesaid and as herein after is expressed Then I direct that she shall have no part of the said One thousand pounds but one half thereof shall go to my late Daughter Congreves Children and the other shall Cease.
I give unto my Daughter Anne my Pearl Necklace now in her own keeping and possession.
I give unto my Grandsons Thomas Congreve and William Congreve and my Grand daughter Anne Congreve Sons and Daughter of my said Daughter Catherine the Sum of One hundred pounds apiece And also I give and direct that whatever rings pieces of money or other things shall be lapt up in paper or otherwise with the name or names of any my said Grand Children or any of them wrote thereon with my hand shall be given and delivered to my said Grand Children respectively whose name or names shall be so wrote thereon.
I give unto my said Brother John Niccoll and my said Kinsman William Fitzherbert the Sum of twenty pounds apeice whereout they are to buy themselves Mourning and to my said Son in Law William Congreve Fifty pounds. I give to my Sister Niccoll Wife of the said John Niccoll the Sum of Five pounds and I give ___ to the Poor of Highgate aforesaid to be paid and distributed in such manner as my Executors shall direct.
And after payment of my Debts Legacyes and Funeral Expences All the rest residue and remainder as well of the said Personal Estate as also the residue of the money arising by Sale of the Messuage and Premisses as aforesaid I direct to be disposed of as follows to wit. One Moiety or half part thereof I give to the said Children of my said Daughter Catherine and her said Daughter to have one half thereof and the said two Sons to have the other half equally and if any of the said Children dye in my life tyme or in case any of them dye afterwards and without making any Disposition of their Shares respectively then the Survivors or Survivor to have the Share of him her or them so dying. And as to the other Moiety or half part of the said residue I give the same to my said Daughter Anne at her Marriage and in the mean time She to have the use and Income thereof But if She dye before her Marriage then I give such last mentioned Moiety to my said Grand Children in such proportions and manner and under such Conditions as is before mentioned of the said other Moiety or half part.
And I direct that my said Trustees shall pay and reimburse themselves all Charges and Expences in or about the said trust Out of the said Trust premisses respectively and that they respectively shall not be answerable or accountable for One anothers Acts or receipts or for any more money or other things that what shall actually come to their hands respectively nor for any Loss of money that is disposed of with the Consent of all my said Trustees and Executors living.
And I do nominate my said Son in law William Congreve and my said Daughter Anne Executrixes of this my last Will and do revoke all Wills by me at any time heretofore made and do declare this to be my last Will.

I desire to be buried by Day Light in Highgate Chappel as near my Father and Mother as may and that a Hearse and Six Horses and a Coach and Six Horses attend my Funeral And that my Nephew and the two Clergymen belonging to Highgate Chappel Attend my Funeral To each of Whom I Give a Ring Scarfe and Hatband.
Item. I Give and bequeath all the rest and residue of my Money Stocks in the Funds Goods Chattles and Personal Estate whatsoever unto the said Leak Okeover and Charles Congreve their Executors and Administrators Subject to the payment of my Debts Legacies and Funeral Expences In Trust to Pay Apply and divide the same unto and amongst all and every the Child and Children of my said Nephew equally share and share alike at their respective Ages of twenty one years.
Item. It is my Will and desire that my Said Nephew do out of the Rents and Profits of my Real Estates Educate and maintain his Children But nevertheless it is my Will and I Do Give power to my Said Trustees and Executors to pay Apply and dispose of all or any Part of the Interest and Produce of my Personal Estate during the life of my Said Nephew and after his decease of all or any part both of the Rents Issues and Profits of my Real Estate and of the Interest and Produce of my Personal Estate in and toward the maintenance and Education of my Said Nephew's Children as they in their discretions Shall think proper but not otherwise Provided always.
and my Will is that in case my Neice Ann Catherine Congreve shall Survive my Said Nephew her Husband then from the death of my Said Nephew I do Give her [an] Annuity or Yearly Sum of Twenty Pounds to be paid her Quarterly during her natural Life by four equall payments and to be paid by and out of the Rents and Profits of my Real Estate until the same shall be sold and after the same shall be sold then to be paid out of the interest and Profits of the Money Arising by the sale thereof and for that Purpose a sufficient Part of the said Money so Arising by the said Sale Shall be Appropriated by my said Trustees and Executors for raising the said Twenty Pounds Per Annum and shall not be paid to or divided amongst my Nephew's Children until after the Death of my said Neice.

Whereas I have in and by my said Will dated the Tenth day of January in the year of our Lord One Thousand seven hundred and fifty Six in which I have disposed of my Real Estate to my Nephew Thomas Congreve for his Life and all my Personal Estate to the Children of the said Thomas Congreve to be divided and shared equally alike at their respective Ages of twenty One years and also have directed my Executors to Sell all my Real Estate after the Decease of my Said Nephew for the best Price or Prices that can be got for the Same and to pay apply & divide the Money arising by the Sale thereof unto and amongst all and every the Child or Children of my Said Nephew equally Share and Share alike and I have left some Legacies mentioned in my Said Will amounting in the whole to about three Hundred and Ten Pounds or thereabouts Now I do hereby confirm the Same and also charge my Said Estates with the Payment of the further Sum of Five Pounds and Five Shillings to M'rs Ann Dangley the Daughter of M'rs Ann Jones her Mother.
Item. I Give to my Said Nephew all my Pewter Household Linnen China Glasses my Worked Bed Feather Bed Curtains and Blanketts thereunto belonging and commonly set[?] therewith and one other Blew and White Bed with the Curtains Feather Bed Blanketts thereunto belonging which I commonly lye in my self with all my Best Blanketts [?] and Coverlids the two Looking Glasses and Chimney Glass in the Parlour the three Sconces[?] and Easy Chair in my Bed chamber three of the best Stows[?] with Shovels Tongs and [?] the Red Morocco Chairs and Stools and the Copper and Iron Work.
Item. I Give to my Said Nephew's Son William Congreve my Silver Tankard.
Item. I Give to my Nephew's Eldest Daughter Ann Catherine Congreve the Turkey Cabinet painted on Glass and the dressing Mahogany Table in my Bed Chamber.
Item. I give to my Said Nephew's Second Daughter Mary Congreve my India Cabinet in my Bed Chamber and chat chat[?] stands under it.
Lastly I order M'r William Hartwell the Clerk of Highgate Chapel to have my Funeral and to be Buried in Highgate Chappel as near my Father and Mother as possible.
And the rest Residue and remainder of my Said Will I do hereby confirm and direct this Codicil to be taken as part of the Same. In Witness whereof I have hereunto set my hand and Seal the 31'st day of July in the year of Our Lord 1756.

On which day appeared personally Jacob Davison of the Parish of Saint Andrew Holborn London Gentleman and Charles Coman of the Same Parish Yeoman who being Sworn on the Holy Evangelist to depose the Truth did say and depose as follows to Wit.
that they these Deponents knew and were well acquainted with Ann Niccolls late of Highgate in the County of Middlesex Spinster deceased and have so known her for a Considerable time before and to the time of her death and during such their Acquaintance with her have frequently seen her Write and Subscribe her Name whereby they became well Acquainted with her Manner and Character of Hand Writing having now carefully Viewed the two Paper Writings hereunto annexed Marked No.(s) No.(4) Purporting to be Codicills to her last Will and Testament the said Codicil Marked No.(s) being in the Words Following. I Give to M'rs Ann Dangly the sum of Five Guineas Jan y'e 211756. and thus Subscribed (Ann Nicolls) the Said Codicil marked No.(4) beginning thus I forgot to put these five things 5 August 1756, ending thus a Tack and all my Recp't Books and thus Subscribed Ann Niccoll.

This Will was proved at London with four Codicils Annexed the Sixth day of November in the year of Our Lord One Thousand seven hundred and Fifty Six before the Worship Edward Simpson Doctor of Laws and Surrogate of the Right Honourable Sir George Lee Knight Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oath of Leak Okeover one of the Executors named in the said Will to whom administration was granted of all and Singular the Goods Chattels and Credits of the Said deceased having been first sworn duly to Administer the same Power reserved to make the like grant to Charles Congreve the other Executor also named in the said Will when he shall apply for the same. /.Ex'd
On the thirteenth Day of Feb'ry 1767 Admon with the Will and four Codicils annexed of the Goods Chattels and Credits of Ann Niccolls late of Highgate in the County of Middx Spinster deceased left unadministered by Leak Okeover one of the Ex'tors and one of the Residuary Legatees In Trust named in the s'd Will now also dec'ed was granted to William Congreve legitimate son of Thomas Congreve the Nephew of the dec'ed and as such one of the Residuary Legatees named in the Will having been first sworn duly to Administer. The Rev'd Charles Walter Congreve otherwise Charles Congreve the other Ex'tor and Surviving Residuary Legatee in Trust named in the s'd Will having first renounced as well the Execution thereof as Letters of Ad'mon with the said Will and four Codicils annexed of the Goods unadm'stred of the said deceased.
