Last Will and Testament of Thomas NICCOLLS, dated Jun 22, 1661. Proved Mar 09, 1662/63. PRO Catalogue Ref: Prob 11/310, Image Ref: 449.In the name of God Amen The two and twentieth day of June in the yeare of our Lord God one thousand six hundred sixtie and one I Thomas Niccolls of Boycott in the County of Salop Esquire being in perfect mind & good health doe make this my last will and Testament in manner Following.
First I revoke all former wills made by mee. Next I commend my soule to Almighty God and my body to the grave. And for my wordlie estate which God hath blessed mee with I dispose and bequeath it as hereafter is expressed.
Imprimis As for my lands in Ireland and New England I give and bequeath unto my sonne Charles Niccolls and his heires forever.
Item. I give to my daughter Anne Niccolls the sume of One hundred poundes.
Item. I give unto my daughter Martha the sume of One hundred poundes.
Item. I give unto my sonne Charles the sume of Twentye poundes.
Item. For my house hold stuffe furniture and implements of husbandrie at Boycott my will is that my sonne Rowland shall have the Refusall of them twentie poundes lesse than they shall be fouely appraised and valued at. And for goods and house hold stuffe in Salop my will is that my sonne Thomas shall have them he paying for them six poundes lesse than they shall fouelie appraised to. Provided Nevertheless And my will is that my Loveing wife shall have the ? of the house hold stuffe at Boycott and Salop as she shall make choice of within six months after my death for her life during her widdowhood. And for my plate I give my silver Bason and Ewre to my sonne Rowland and my silver tankard that my daughter otherwise hathe of mine in lieu of a lesser Tankard (I have of my sonne Rowland's) I give it to her. And for the rest of my plate I give it to my daughters Marie, Anne, Margaret and Martha to be divided amongst them as seeme the best by my Loveing wife. Provided Nevertheless and my will is that my Wife shall have the use of as much of my plate as she pleaseth during her widdowhood.
Item. I give unto my sonne Charles my Mortgaged landes called Parkissa[?] in or neare Oswesstrie in the Countie of Salop which is mortgaged to me by my Cozen Thomas Kinaston late of Melverley in ye same Countie and the mony remaining due upon it. I give alsoe to my said sonne Charles all those sumes of monie due to me by bond from Thomas Lee of the parish of St Brides London gent.
Item. I give to everie one of my servants who have continued Foure years with me forty shillings to each of them, and to the rest twentie shillings to each of them.
Item. I bequeath to every of my sonnes and sonnes in law the sume of five poundes and the like to my daughters and daughters in law toward buying of them mourning at my funeral Provided that they imploy it for that purpose.
Item. The rest and residue of my personall estate undisposed of in this my last will after my debts, legacies and funeral expences bee discharged I doe give and bequeath to my daughters Mary, Anne, Margaret and Martha and to my sonne Charles to be equallie divided.
Item. My further will is that if any of my children or their husbands doe refuse to give releases to my Executors for such Legacies as were left to them by anie person whatsoever for which my heires or Executors are responsible then my will is and I doe hereby revoke everie legacie and bequest which I have therein bequeathed to him or them who refuseth.
Item. My further will is that if anie of my sonnes, daughters or their husbands or anie other Legatee herein mentioned doe hinder or interrupt my Loveing wife from peaceablie enjoying or receiving any of the proffitts of her Joynture assured[?] upon her upon her since my sonne Rowland's marriage or shall detaine from her any sume of monie or rents which by him or her ought annuallie or everie half yeare ought to bee paid unto her or shall hinder her of any landes or houses herein bequeathed unto her or by other Conveyance made unto her or shall doe any act to crosse this my will then I doe hereby revoake all and everie the bequests &c I have herein made or bequeathed unto him them or anie of them.
Item. I give to M'r Lamond ___ desiring him to preach at my funerall.
Item. I give tenne poundes to be distributed amongst the order mindfull[?] poore of Pontesbury parish prohibiting those ? but indiscreete Confused soles[?] to wander ? or for the said tenne poundes to remaine as a Charitie for the benefit of the poore of Pontesburie parish at the discretion of my wife and sonne Rowland.
Item. For my Messuage landes tenements Shoppes houses barnes Gardens and other hereditaments within the Towne of Shrewsburie and the suberbs and liberties thereof I bequeath as followeth. I give and bequeath all the aforesaid premises unto my Executors untill and for soe long a time as reasonably they may raise out of the proffitts of the premises the sume of three hundred poundes interest to pay the said sume to the persons herein after named and expressed viz't. To my sonne Charles the sume of One hundred poundes of it. To my daughter Anne the sume of One hundred poundes of it. And for my daughter Martha the other hundred poundes of the said three hundred poundes after which sumes being raised and paid out of the said premises or securities given to the said Charles, Anne, and Martha I give and bequeath my Dwelling house in the Corn Markett to my wife during her life Provided that she release unto my sonne Thomas one rent charge of tenne pounde granted to be paid her during her life out of my lande in the Abby Forgate. The remainder of the said house with all the rest of my said houses Shoppes gardens and the aforementioned premises and hereditaments I bequeath to my sonne Thomas and his heires male & for want of such issue to my sonne Charles and his heires male & for want of such issue to my sonne Rowland and his heires male and for want of such issue to my heires forever.
And for my landes in Houghton in Staffordshire with the rents therewith the Manno of Houghton and rents and proffitts[?] thereof Ritiskin in Mountgomeriesheire and my Tythes in Muckleweecke in the Countie of Salop I give and bequeath to my sonne Charles for and during his life, the remainder to my sonne Rowland and his heires male & for want of such issue to my sonne Thomas and his heires male & for want of such issue to my sonne Charles and his heires male & for want of such issue to my heires forever. Provided nevertheless that if my sonne Rowland or his heires shall interrupt my sonne Charles from the quiet enjoyment of Ritiskin aforesaid or from receiving the proffitts thereof for his life Then I do give and bequeath the inheritance of the said Tythes of Mucklewicke unto my sonne Charles and his heires forever.
Item. I give all my landes tenements and hereditaments in New England and Ireland to my sonne Charles and his heires forever.
Item. I give all my landes which I hold by lease to my sonne Rowland.
Item. I give and bequeath my late Purchased Messuages landes Meadowes Pastures Mills and other hereditaments thereunto belonging in Malehurst in the said Countie of Salop unto my Executors & until they have raised and paid out of the proffitts thereof unto my daughter Congreve if she be living at the time of my Death the sume of One hundred poundes after which sume paid, I give and bequeath all the aforesaid premises in Malehurst unto my sonne Rowland and his heires male Provided that hee pay out to each of his Children and my grandaughters Anne, Jane and Pheles the sume of one hundred poundes after they accomplish the age of eighteen Yeares And for want of such issue male I bequeath the premises aforesaid unto my sonne Thomas and his heires male of his bodie upon the Condition and Provision as above. Provided Nevertheless and it is my will and bequest that my Loving wife shall have the Capitall Messuage in Malehurst and soe much of the landes &c therewith occupied as she desireth for longe as she pleaseth to inhabitt there at a reasonable racke.
Item. I give and bequeath unto my loveing wife what sume of monie she shall reasonably require to buy her mourning.
Item. I give to my sister Chesheire the like sume as to my daughters viz't five poundes to buy her mourning upon the like provisoe.
Item. I give unto blind M'r Will'm Turner, 20'e yearely to be paid him out of Malehurst.
Item. My further will is that if any of the sumes of monie which are secured unto my daughters Anne and Martha by bondes Mortgages or assignements shall not prove good to either of them then my will is that they shall be made good out of my personall estate unbequeathed.

In the Name of God Amen: May the one and Twentieth Anno Dni One Thousand six hundred Eighty Nine I Charles Niccolls of the Towne of Shrewsbury in the County of Salop gent being at present in health both of body and mind but calling to mind the frailty and uncertainty of humane life doe make my last Will and Testament as followeth.
Imprimis. my soule I bequeath into the hands of God who gave it mee, my body I comitt to the grave to be buried at the discretion of my Executor hereafter named in hopes of a joyfull Reunion both of Soule and body at the generall Resurrection of the dead.
Item. as to such worldly estate as it hath pleased God in his mercy to bless me with I bequeath and dispose thereof as followeth viz. I bequeath to my loveing sister M'rs Anne Boughey widow the sume of six pounds to buy her mourning.
Item. I give and bequeath unto my Neece M'rs Margarett Boughey daughter of the said Anne the sume of Sixty pounds.
Item. I give and bequeath unto ten poore housekeepers within the parish of Pontesbury in the said County of Salop where I was borne twenty shillings apiece to be distributed according to the discretion of my Executor.
Item. I give and bequeath unto M'r John Low Viccar of St Alkemans in Shrewsbury the sume of twenty shillings to buy him a ring.
Item. I give and bequeath unto Richard Gower Esq'r the sume of Twenty five pounds provided he be living at the time of my death.
All the rest and residue of my estate I give and bequeath unto my deare and loveing brother M'r Thomas Niccolls whom I make and constitute the sole Executor of this my last will and testament hee paying all my debts and legacyes within one yeare after my decease and I doe hereby revoke all former wills.
