This is the last Will and Testament of me James Baker the Elder of Calverleigh in the County of Devon Yeoman

I give and bequeath unto my sons John, James, Joseph, William, Henry and Benjamin the sum of Ten pounds each. I give to my son Richard the sum of Twenty pounds. I give to my daughters Sarah and Elizabeth the sum of Ten pounds each. I give to my daughter Jane the sum of Thirty pounds. And my will is that the Legacies hereinbefore by me given to my said Children, John, Joseph, William, Henry, Benjamin, Richard, Sarah and Elizabeth shall be paid to them respectively within six months next after my decease by my Executors hereinafter named. And whereas I have not heard from my said son James for many years past therefore my Will is that the sum of Ten pounds hereinbefore given to him shall be put out at Interest by my said Executors and the produce thereof paid to my beloved Wife Mary in aid of her support during her life or until my said Son James shall demand the said principal sum.

All the rest of my goods chattels and personal Estate and effects whatsoever and wheresoever I give and bequeath the same unto my said son William and William Richards of Calverleigh aforesaid Yeoman upon trust that they do and shall as soon as convenient after my decease sell and dispose of all and singular my Household Goods and Furniture Stock and Utensils in trade and call in all my money then due and owing to me on any account and after paying my just debts Funeral Expences and the Costs and charges of proving this my Will and the aforesaid Legacies then do and shall put the residue out at Interest and pay the annual produce thereof unto my said Wife for her support during her life. But my will is that if the Interest thereof should not be sufficient for her support then that my said Executors do and shall draw so much of the said principal money annually as with the said Interest as will make up the yearly sum of Sixteen pounds and pay the same to my said Wife. But in case of sickness or other accident happening to her then my Will is and I do hereby order and direct my said Executors to draw so much of the said principal money as will in their discretion be sufficient for her support during her life. And after the decease of my said Wife Then upon trust to divide such principal money then remaining amongst all my Children then living share and share alike.

And I hereby nominate and appoint my said son William and William Richards joint Executors of this my Will In Witness whereof I have hereto set my hand and seal this sixth day of February One thousand eight hundred and twenty seven.

This is the last Will and Testament of me John Squire of Cadeleigh in the County of Devon Yeoman as follows

Whereas my Wife Jane is intitled to thirty Pounds per annum during her Life To be paid to her out of the rent and Profits of an Estate called Mill with the Houses thereto belonging situated in Cadeleigh aforesaid or by a certain Lease thereof will more fully appear

Now I further Give to my said Wife the sum of Twenty Pounds yearly and every year during her life To be paid to her by my Executor hereinafter mentioned out and from the income or Produce of my Effects which with the Thirty Pounds aforesaid will make in the whole the Sum of Fifty Pounds per annum. And I further give to my said wife Jane the Sum of One Hundred & Fifty Pounds To be paid to her at the End of twelve Months next after my decease. Also I give to my said Wife Jane my Two Beds performed with all other of my Household Goods and Furniture that are in my Two first Rooms and two Chambers over them which was lately in the Possession of one John Herdles otherwise Hex. I also give to my said Wife Jane the said two under Rooms with the Chambers over them and likewise that Part of the Garden that was also in the Possession of the said John Herdles otherwise Hex To hold to my said Wife Jane Squire during her natural life. And after her decease then I give the said Dwelling Houses and Garden with all and every its Appurtenances unto my Daughter Elizabeth To hold to my said Daughter Elizabeth North during her natural life (if she remains a Widow) and after her decease To the use & behoof of my Son John Squire his Heirs & Assigns for ever. But my Mind is and I further Order and direct that my said Daughter Elizabeth shall keep and leave the said Dwelling house & premises in good Tenantable repair during the Time she holds it and that if she shall happen to get married again then she shall quit and yield up the quiet & peaceable Possession of the said House & Garden with All and every its Appurtenances unto my Said Son John his Heirs and assigns immediately after her second Marriage Day and she shall have no more to do therewith. I also Give to my daughter Mary the Sum of Two Hundred Pounds. Also I give to my Daughter [Maria crossed out] Sarah Two Hundred Pounds which said sums of Two Hundred Pounds each I order it to be paid to my said three[sic] Daughters respectively twelve Months after my Decease

I also give to my Son in Law Hugh Roberts and my said Son John Squire the sum of Four Hundred Pounds To be paid to them twelve Months next after my Decease and To hold to them the said Hugh Roberts & the said John Squire and the Survivor of them his Executors & Administrators Upon Special Trust nevertheless to and for the uses Trust interest and Purposes hereinafter mentioned (that is to say)

In the first Place immediately after their receiving it or as soon as Possible to place the same at Interest on land or good Security and call it in and replace the same again at Interest on the like good Security as often and for such Interest as you my said Trustees shall reasonably think it will prove for the most Benefit to my other two Daughters Jane & Elizabeth. And the interest arising therefrom shall be paid & applied to the use of my said two Daughters Jane & Elizabeth for their respective Maintenance & Support during their respective lives. But my Mind is & I further Order & direct that if my said Daughters Jane & Elizabeth or either of them should happen to be visited by Sickness or any other unforeseen Calamity so that the Interest is not sufficient to support them therein respectively Then you shall take out of their respective Sums of Two Hundred Pounds each what is reasonable for their respective support only & shall not be subject to the Debts Engagements nor Control of her present Husband nor any Husband or Husbands That either of them shall happen to marry with hereafter & their receipt alone notwithstanding their Coverture shall be a sufficient Discharge for the same. And if they or either of them should die leaving Issue then the said Principal Sum of Two hundred Pounds each or what shall then remain shall be paid and applied to the Use & Benefit of their respective Children for their use & Benefit by equal Portions when they attain their Age of twenty one years respectively together with the Interest arising therefrom (if any) after their Mother’s Decease respectively and if but one then to the Use of that only Child and to and for no other Use or Purpose Whatsoever.

And I further give to all and every of the Children of my said Five Daughters and likewise the Children of my said Son John Ten Pounds each To be paid within Twelve Months next after my decease to my said Trustees Hugh Roberts & John Squire and the Survivor of them his Executors & Administrators In Trust for them and as I have already confided in you so now I hope you will place it at Interest for the most Benefit to my said Grand Children in Manner & form as is above mentioned. And the Principal together with its accumulating Interest (if any) Upon Trust to pay and apply it to the use and Benefit of my said Grand Children when she[sic] shall attain their respective Age of twenty one years

And if one or more of my said Grand Children shall happen to die before they arrive to that age leaving no Issue the Survivors or Survivor in each Family shall have the deceased’s Legacy by equal Portions and if but one To the use of that Only Child and for no other Use or Trust whatsoever. And I hereby order and direct that the Children or Issue of my Grand Children shall not be entitled to receive any Legacy or Sum of Ten Pounds above mentioned but only to the Children of my said son and Daughters.

And Further I order and direct that the said Hugh Roberts & John Squire shall not be answerable nor accountable for any More Money than naturally come to their Hands & that they their Executors and Administrators shall and lawfully may deduct retain & allow to themselves out of the said Money hereby vested in them Upon Trust what is reasonable for Loss Trouble Journies[sic] and Expences that they may be put unto in and about the Trust aforesaid or any Thing relating thereto Provided such Loss shall happen without their neglect & fault.

All the Rest Residue and Remainder of my Lands Leasehold Goods Chattles Rights Credits and Effects of what Kind or Nature Soever or wheresoever they are or may be found not hereinbefore particular given I give Devise and Bequeath the Same unto my said Son John To Hold to my said Son John Squire his Heirs Executors Administrators and Assigns for ever paying my Just Debts Legacies & funeral Expences whom I nominate & appoint whole & Sole Executor of this my Will hereby revoking disannuling and making void all former and other Will & Wills by me made. and made Oath, that: he hath made diligent search and due enquiry
after, and in respect of the Personal Estate and Effects of the said Deceased,
in order to ascertain the full Amount and Value thereof; and that to the
best of: his Knowledge, Information, and Belief, the whole of the Goods,
Chattles, and Credits, of which the said Deceased died, possessed within
the: Archdeaconry of Exeter, (exclusive of what the
Deceased may have been possessed of, or entitled to as a Trustee for any
other Person or Persons, and not beneficially, (A)
and without deducting any thing on Account of the Debts due and
owing from the Deceased,) are under the Value of: Three
thousand Pounds
to the best of: this Deponent’s Knowledge, Information, and Belief, (B)
And: this Deponent lastly made Oath, that the said Deceased was not
possessed of or entitled to any Leasehold Estate or Estates for Years, whether
absolute or determinable on a Life or Lives, to the best of: this Deponent’s
Knowledge, Information, and Belief.
