William Carey Ditmars
b. 12.11.1865 in St. Catharines, Canada
William Ditmars arrived in Vancouver in 1891from St Catharines, Ontario and worked for the John Doty Engine Company of Toronto. Soon after, Carey joined the fledgling iron work firm of Armstrong Morrison and Company, eventually becoming a partner. By 1901 he had established himself in the West End in the 1800 block of Barclay Street, west of Denman two blocks from Stanley Park. By 1913 he followed other wealthy Vancouverites up to, the new and exclusive, Shaughnessy Heights subdivision where he built a new house on Pine Crescent.
William served as Grand Master of the Grand Lodge of British Columbia & Yukon in 1915 -16. In 1928 the Native Sons of British Columbia awarded him their "Best Citizen" award. And among other achivements he is accredited with bringing the "first horseless" carriage, to Vancouver.
Armstrong and Morrison built many of Vancouver's early bridges including the Granville Street, Connaught and Westminster Avenue (Main St.) bridges and the now demolished Fraser Street bridge. The company provided the iron components of the Lion's Gate Bridge.

Last Will and Testament of Richard Davey, dated Mar 10, 1849 and Proved Apr 04, 1849:

Will of Richard Davey late of Tiverton, Devon, Lime Burner and Innkeeper, deceased. Executors (acting) William Cosway and William Cosway the Younger, both of Tiverton, Devon, Lime Merchants. Proved 4th April 1849 in the Principal Registry of the Lord Bishop of Exeter.
Effects sworn under £2,000.

This is the last Will and Testament of me Richard Davey of Tiverton in the County of Devon Lime Burner and Innkeeper. I declare that my dear Wife Elizabeth shall be entitled to the whole of her wearing apparel Jewels and Trinkets and I expressly direct my Executors in no wise to intermeddle with the same.

I bequeath the following legacies, namely, to my said Wife the Bed Bedding and all other Furniture whatsoever which shall be in use in my Bedroom at the time of my decease. As also the Sum of £5 to be paid her as soon after my decease as shall be convenient to my Executors hereinafter named. To my son Richard Davey all such of my Plate and Plated articles belonging to me at the time of my decease as are or shall be marked with the initials "RD". To my son Robert Davey all such of my Plate and Plated articles are or shall be marked with the initials "RED" and also the Portrait of myself now hanging in my upstairs sitting room. To my son Henry Davey all such of my Plate and Plated articles as are or shall be marked with the initials "HB" and also my copy of Brown's Family Bible. To my daughter Charlotte the Wife of James Peake my Engraving of the Fire at Devonport Dockyard. To my daughter Mary the Wife of Hugh Roberts my Engraving of her present Majesty. To my daughter Elizabeth the Wife of William Body my Engraving of a King now hanging in my aforesaid upstairs sitting room. To my daughter Frances my three volumes of the Oxford Encyclopaedia.

I exonerate my said son Richard from the payment of all such Sum or Sums of money which may be owing from him to me at the time of my decease.

And whereas under or by virtue of the Will of Robert Ebbels late of the parish of Halberton in the county of Devon deceased I am entitled to one undivided Moiety or other part of the Rents and Profits of certain Messuages Lands and Hereditaments situate in the aforesaid parish of Halberton to accrue due during the minority of my said son Robert and in the event of his death under 21 years of age and I shall under or by virtue of the aforesaid Will thenceforth become absolutely entitled to the Fee Simple in possession of the same Hereditaments. Now I bequeath unto my Brother-in-Law William Baker my Partner William Cosway and his son William Cosway the Younger their Executors and Administrators the Rents and Profits of the aforesaid Moiety or other part of and in the aforesaid at Messuages Lands and Hereditaments to accrue due during the minority of my said son Robert nevertheless Upon Trust to pay unto him my said son Robert or apply for his benefit during his minority the yearly Sum of £20 to become payable by four equal quarterly payments the first payment thereof to be made at the expiration of Three Calendar Months after my decease with due apportioned part of the said annuity to be in proportion to the period which shall elapse between his death or attainment of majority which event shall first happen and the last preceding quarterly day of payment thereof and subject to the payment of the aforesaid annuity and such apportioned part thereof as aforesaid I declare that the said William Baker William Cosway and William Cosway the Younger shall stand possessed of my aforesaid Moiety or other part of and in the Rents and Profits of the aforesaid Hereditaments to accrue due during the minority of my said son Robert upon and for the same Trusts and Purposes as are herein expressed and contained concerning my Residuary Personal Estate. And in the event of the death of my said son Robert under the age of 21 years I devise all and singular the aforesaid Moiety or other part to which I shall in that event become entitled in Fee Simple of and in the aforesaid Messuages Lands and Hereditaments unto and to the uses of them the said William Baker, William Cosway and William Cosway the Younger, their Heirs Executors Administrators and assigns. Nevertheless Upon Trust that they or the Survivors or Survivor of them or the Executors or Administrators of such Survivor do and shall sell the same either together or in parcels and either by Public Auction or Private Contract with full power from time to time to buy in the Premises at any such Auction and to rescind or vary the terms of any such Contract and to resell the Premises in manner aforesaid without being liable for any consequential loss. And in the meantime and until any such sale I empower my said Trustees or the Survivors or Survivor of them and the Executors or Administrators of such Survivor to concur with the person or persons entitled to the other or remaining Moiety or other part of the aforesaid Hereditaments in effecting a partition thereof or of any part thereof and to receive or give any Rent or gross Sum or Sums of Money for equality of Partition and to charge any such Sum or Sums upon the Hereditaments to be taken or allotted in severally to them my said Trustees or the Survivors or Survivor of them or the Executors or Administrators of such Survivors with such power remedies and provisions for securing or raising the same as they or he shall think fit. And I declare that the net monies to arise from any such sale or to be received for any such equality of Partition as aforesaid shall be held Upon Trust for the absolute benefit of my children Richard Davey, Charlotte Peake, Mary Roberts, Elizabeth Body, Frances Davey and Henry Davey share and share alike but so nevertheless as to the shares of my said daughters Charlotte Peake, Mary Roberts and Elizabeth Body the same shall be held Upon Trust for the separate use of them respectively independent of their respective husbands.

And I devise and bequeath unto and to the use of the said William Baker, William Cosway and William Cosway the Younger their Heirs Executors and Administrators respectively all my Messuages Lands and Hereditaments in the parish of Burlescombe in the county of Devon and all other my real Estate whatsoever not hereinbefore disposed of and also all my Personal Estate and Effects (except such of them as are hereinbefore bequeathed) Nevertheless as to my Real Estate Upon Trust that they my said Trustees or the Survivors or Survivor of them or the Executors or Administrators of such Survivor do and shall as soon as conveniently may be after my decease sell the same either together or in parcels and by Public Auction or by Private Contract with full power from time to time to buy in the same at any such Auction and to rescind or vary the terms of any such Contract and to resell the same in manner aforesaid without being answerable for any consequential loss.

And as to my Personal Estate Upon Trust as soon as conveniently may be after my decease that they my said Trustees or the Survivors or Survivor of them or the Executors or Administrators of such Survivor do and shall (except as to such parts thereof as shall consist of money) call in and convert the same into money. And I declare that the net monies to arise from such sale or conversion and of my said Residuary Real and Personal Estate shall be held in the first place Upon Trust for the payment of my just debts funeral and Testamentary Expenses. And subject thereto Upon Trust that my said Trustees or Survivors or Survivor of them or the Executors or Administrators of such survivor do and shall thererout invest in their or his names or name a competent Sum in the purchase of so much Public or parliamentary stock as will produce the clear yearly Sum of £26 a year to the intent that the annual income of the same Sum of stock shall be applied in payment to my said Wife during her life of a weekly Sum of 10 shillings. And subject as aforesaid I declare that he net monies to arise from such sale or Conversion including the Sum of stock to be purchased as aforesaid expectant upon the aforesaid Life Interest therein of my said Wife shall be held Upon Trust as to five equal 5th parts thereof for the absolute benefit of my said children Charlotte Peake, Mary Roberts, Frances Davey and Henry Davey share and share alike but so nevertheless that the Shares therein of the said Charlotte Peake and Mary Roberts shall be held Upon Trust for the separate use of them respectively independent of their said respective Husbands.

And as to the other or remaining one-fifth Part of and in the said net monies to arise from such sale or conversion Upon Trust that my said Trustees or the Survivors or Survivor of them or the Executors or Administrators of such survivor do and shall invest the same in their or his names or name in or upon Government or Real securities in England with the power for them or him from time to time to vary and transpose the said Investments for or into any others of the like nature. And I declare that the Stocks Funds or Securities constituting the investments of the same 5th part of and in the said last mentioned Trust Monies shall be paid to my said daughter Elizabeth Body during her life for her separate use independent of her said husband. And after her decease Upon Trust as to the same 5th part or share of and in the said last mentioned Trust Monies and the investments thereof for all and every or such one or more exclusively of the other or others of the children or more remote issue of the said Elizabeth Body (such more remote issue being born within the period allowed by the rule of law against perpetuities) and at such age or respective ages time or times in such shares and proportions manner and form and with such provisions for maintenance education and advancement and subject in such manner in all respects as the said Elizabeth Body at any time or times or from time to time by any Deed or by her Will or any Codicil thereto shall whether covert or sole appoint and subject to and in default of any such appointment In Trust for all and every the children and child of the said Elizabeth Body who being a Son or Sons shall attain the age or respective ages of 21 years or dying under such age or respective ages shall have issue living at his or her death or respective deaths and who being a daughter or daughters shall attain the age or respective ages of 21 years or shall be married under such age or respective ages and the Executor Administrators and assigns of such children and child and if more than one to be divided between them in equal shares as tenants in common provided nevertheless and I do hereby declare that inasmuch as I have advanced or paid unto or for the benefit of my said daughters Charlotte Peake, Mary Roberts and Elisabeth Body respectively the several Sums of £210, £125 and £100 and inasmuch as I have paid by way of Apprenticeship Premium for or on account of my said Son Henry the Sum of £35 they the said Charlotte Peake, Mary Roberts, Elizabeth Body and Henry Davey respectively or any child or more remote issue of the said Elizabeth Body shall not be entitled to any share in the proceeds of that sale and conversion of my said Residuary Real and Personal Estate without bringing the same Sums respectively into Hotchpot and accounting for the same accordingly. And I declare that the costs and expenses for clothing necessaries and otherwise as well as the payment of the further Sum of £35 to which I am liable under my said Son Henry's apprenticeship Indenture shall be exclusively levied and raised out of his share under the aforesaid Trusts of and in the monies to arise from the sale and conversion of my Residuary Real and Personal Estate. And I declare that it shall not be competent for any of my last mentioned children to question or dispute the existence or amount of the aforesaid Sums hereinbefore mentioned to have been advanced or paid unto them or for their benefit. Provided also and I declare as to all and singular the Hereditaments and Real Estate hereinbefore devised and in the meantime an until the same shall be sold pursuant to the aforesaid Trusts in that behalf the Rents and Profits thereof shall be paid and applied to the same persons and for the same purposes to and for which the annual income of stocks funds or securities constituting the investments of the monies to arise from such sale are herein directed to be paid and applied.

And I declare that the provision hereinbefore made for my said Wife shall be and by her taken in lieu of all Dower out of my Freehold Hereditaments and Premises. I devise all such freehold and copyhold Estates as shall at my decease be vested in me either subject to redemption or upon any Trust capable of being performed by my devisees or devisee unto the said William Baker William Cosway and William Cosway the Younger their Heirs and assigns nevertheless with upon and subject to the powers equities Trusts and provisions respectively affecting the same. And as to the said mortgaged Estates In Trust for securing for the benefit of my Personal Estate the Principal and Interest monies received thereon.

And I expressly declare that every Receipt which shall be given by the said William Baker William Cosway and William Cosway the Younger or the survivors or survivor of them or the Executors or administrators of such survivor or any already Trustees or Trustee for the time being acting under this my Will for any money to be received by them or him by virtue thereof shall be a conclusive discharge to the person or persons paying the same and shall exonerate him or them from all liability in respect of the application thereof. And I declare that as often as either of the Trustees hereby appointed or to be appointed under this power shall disclaim or refuse to act in the Trusts hereby in him reposed or shall die either before or after my decease or desire to be discharged from or become incapable to act in the aforesaid Trusts before the same shall have been fully executed it shall be lawful for the acting surviving continuing or remaining Trustees or Trustee or the Executors or administrators of the acting or last surviving continuing or remaining Trustee by any deed or writing under their or his hands or hand to appoint any other person or persons to be a Trustee or Trustees in the place of the Trustee or Trustees so disclaiming refusing dying desiring to be discharged or becoming incapable to act as aforesaid and thereupon the said Trust Estate and Premises shall with all convenient speed be legally and effectually vested in such a new Trustees or Trustee jointly with the acting surviving or continuing Trustees or Trustee or in such new Trustees as the case may require Upon and for the Trusts and purposes herein declared and contained concerning the same or such of them as shall be then subsisting And every such new Trustee shall have all the powers and authorities of the Trustee in whose room he shall be substituted. And I declare that no Trustee of this my Will shall be answerable for the default of any co-Trustee or for any money paid over by one to another or for any banker broken or other persons with whom any part of the Trust property may be lodged or for involuntary losses. And also that it shall be lawful for the Trustees or Trustee for the time being hereunder out of the monies which shall come to them or his hands by virtue of the Trusts aforesaid to reimburse themselves or himself all costs and expenses whatsoever incurred in or about the execution of the Trusts aforesaid.

And I hereby appoint the said William Baker, William Cosway and William Cosway the Younger and the survivors and survivor of them to be the guardians and Guardian of the persons and Estates of my children during their respective minorities. And I appoint the said William Baker, William Cosway and William Cosway the Younger Executors of this my Will. And I authorise them to settle and adjust all accounts of or relating to any part of my Estate. And to make such allowances and to enter into such compositions in respect thereof as to them or him shall seem expedient.
