Dan Killey departed this life about the 21st
Inst. Intestate, whereof the Court having
Intelligence, has decreed his 2 Children, Philip
& Catherine Killey joint Admrs of all his
goods moveable & immoveable whatsoever, & a
Legacy to the Widow, 7s And
for as much as it is alleged that Catherine
has a Marriage Contract, if her Husband
& she insist on the same, & receive Benefit
thereby, then they are to be excluded from
any share of this Admion
Philip is sworn in Court, and has given
Pledges. Jo: Gale & Gilbt. Craine
Decretum et solvit 2s 4d
29 June 1716. Now Sam: Mcylchreest, & Catherine
Killey his Wife declared that the Marriage
Contract is not to be found & if it shale be
hereafter found, they promise & oblige them=
selves, their Heirs, Exrs, Admnrs & Assignes
in the penalty of twenty pounds ad upon
Dei, that the Benefits of the same shale
never be sued for by them or their Heirs
Exrs etc. Whereupon the said Samuel
Mcylchreest is sworn joint Admr with Philip Killey
