This is affirmed to be the Last Will & Testament of Alice
Qualtrough als Gelling of Kentraugh in the Parish
of KK Xt Rushen being of perfect Mind & Memory
at the making hereof who died the 12th day of
October 1729.
Imprs: She Committed her Soul to God & her Body to
Xtian Burial
Itm: She bequeathed to Ann Nelson als Crebbin
fourty shills & her Brewing pan. Itm She
forgaves Jane Kinley the Money she owed her &
left her a Cow, if there wd be any. Itm She be=
queathed to Jams? Waterson son of Edwd Waterson
of Castletown five shills Legacy Itm to Elinr
Fox twenty shills Itm She bequeathed to Mr
Wm Qualtrough of Kentraugh all the Mortgaged
Lands except lourn? Pounds? in Bally-Gonny
Itm: She bequeathed ….?????? twenty shills
Itm: She bequeathed to the poor of the Parish
one firlott of Barley, to be distributed amongst
the according to their Necessities. Itm To Jon
Crebbin her Godson, the Witness to this Will five shills
Itm: To Mr Crebbin five shills. Itm She forgave
Jon Killey Senr Six pounds of Eight pounds that he
ow’d her & to pay the Remainder onto the Exer. Itm She
forgave Jo Killey Junr twenty shills that is ow’d her
Itm she left Six pence Legacy to all claimts. Itm
She left her Man?? to the Exers. Lastly she Constituted
& apointed Henry Quaile of Castletown & his Wife
Christian Exers of all the rest of her Goods move
able & immoveable whatsoever.

Mr John Curghey’s token to appear before the Revd
Mr John Woods in order to Declare whether I had
any papers belonging to Mrs Alice Qualtrough
late of Kentraugh in the Parish of KK Christ Rushen
Do Despose, Declare & averr on the Holy Evangelists
that I have no papers belonging to the sd Alice
Qualtrough; Nor ever had any, Except two Bids
which being almost defaced & worn away She desired
me to Copy for her, which I could not exactly Do
the said Bills being so consumed but drew memdms
of the said Bills what the sum thereon mentioned
being & the persons from whom the same was due
together with the names of the witnesses thereunto
annexd, to which said memdms. I attested that I had
seen the said Bills but never saw any paper or
writing between the aforesaid Alice Qualtrough & my
father. Witness my name this 7th Novr 1729

The humble petion of Thos Nelson of KK
Christ Rushen
Shewing
That Mrs Alice Qualtrough of the sd Parish
lately bequeathed to your petrs wife a Brewing Pan in her
last Will which Will was proved at the last Court in
Castletown. But one Jon Gill alledging that the said
Pann was given to his son by the above Deceadt as he
could prove by witnesses, he obtain’d the Revd Mr
Curgheys token to have them Examined upon Oath before
The Episcopal Regr. But the said Jon Gill produ=
cing no Evidence but his own wife’s
Cousin in German, their Depositions were judged insuf=
ficient in Law: And seeing the retaining of the
sd Pann from your Petr may be to the Loss of
1s 6d p week
your Ldshipps Petr humbly prays an
Order of Court requiring the said Jon
Gill to deliver the Pann & he will ever
pray for your Lord Shipps Happiness.
All Parties are ordered to be at the
next Consistory, the 27th ? pertent? & if Jo: Gill does not
then prove a lawful Conveyance of
the Pam by sufficient Evidence, the
Court will adjudge it to the Peticonrs

The sumnr is, in the mean time to charge
two honest men to view the condition
in wch the Pan is at this Juncture.
Bp’s Court Novr 27 1729
If any Person shall presume to stop the
Sumner & 2 honest men to view the Pan
(as Jo: Gill’s wife has already done) he
or she are to be immediately comitted to
St German’s Prison by the Sumner or
a Soldier from Castle Rushen. And the
Sumner’s Complaints with the Allegations
made by Jo Gill in behalf of his wife &
sister are to be heard at the next Consistory.

Jo Gill’s Evidences are to be taken (con=
cerning the Pan) before the Revd Mr Archdn & the
Episc. Regr within ten days & the Depositions to be
returned to the Court.

The humble peticon of John Gill
Sheweth
That Mrs Alice Qualtrough late of KK Christ Rushen
sometime before her Decease & before she made her last
Will & Testament freely bestowed her brewing pan upon
your petr but it seems hath since bequeathed it in her
said last will to some other in KK Christ aforesaid.
Wherefore yr petr humbly prays
the benefit of the said Gift & a respitt
of time allowed him to bring in his Evidence
before yr Lordship or the Vicr Genrl
whenever yr Lordship shall think fitt
& in the meantime to put a stop to that p…
of the will that relates to the said pan;
which will engage the petr of your
Lordship’s prosperity to pray.
Novr 22 1729
This is to certifie that I have Lawfully charged
John Gill and wife and his son John to apear at
KK Mickel on Thursday next and to bring with them
sufficient evidences to prove that a brewing pan be=
longing to Mrs Ealise Qualtrough deceased was lawfully
conveyed to the sd John Gill junior And this by
vertue of an Order of Court Dated the 13th Instant
And I do further certifie that when I Charged two honest
men to view the above pan, we were forcibly
stoped by the sd John Gill’s mother who fell a cursing??
and said she did not value Orders and this day
threatened if I came again to charge them. She would
give me a mark. I certify also that Margret
sister to John Gill’s wife said to me In the Exe=
cution of my Office thereof she Damned me and bid
me go out of doors and several times to kiss her
breech. For which Contempt I required her
to apear at KK Mickel on Thursday ……… to
which she again an…… kiss my breech,
And this is truth by vertue of my oath

Depositions taken concerning a
Brewing pan alledged to be given
by Mrs Qualtrough to Jo Gill junr
Charles Mylrea deposes that about
2 years ago being in the house of Jon
Gill Senr he there saw Alice Qual-
trough sitting by the fire & a thing by
her, & she told him of her own accord
to this purpose I have bestowed the
Pan on little Jon Gill & you may see
it & going to the door he saw the
Brewing pan lying on the ..unghill??
& she said she woud give him some=
thing else.

Jo Keig deposes that some days before
Alice Qualtrough’s Decease she sent
him on Saturday to bring a brewing pan of hers
from Jo Gill Senrs house & meeting him
near the Bowling Green he delivered
him the message, to wch Jo Gill confesse’d
that he himself was to brew? on Monday &
therefore coud not spare it. And when
this Disponent realized that he had left
let him bring it now, because perhaps she
might have done with is that day & he might
have it again on Monday. Jo Gill said That
cou’d not be & besides he did
not know why he should send it because
he had it rented by the year & it was
Set to him until midsummer. But by
whom it was set He did not mention.

have the Pan brought to her house …..
every Christmas by Jo Gill Senr
that she then set it for hire to some
of her neighbours, being about a fortnights
time before that Festival

in Alice Qualtrough’s house when she
reckoned some money & gave it unto Jo:
Gill Senr’s hand there being some
discussion a little before betwixt them
concerning some timber he bought for
his house.

Senr’s wife) deposes that about 1
year ago he was at the sd Jo Gill’s
House when Alice Qualtrough then
was & Jo Gill junr being then also
to & fro in the House, the sd Alice
Qualtrough said to this Deponent, I
design to bestow my Brewing pan
on young Jo Gill, & something bet=
ter also.

Arthur Calcott deposes that about
2 years ago he was at Jo Gill Senr’s
house & Alice Qualtrough being there
also said to this Deponent I have
bestowed the Pan on Jo Gill junr
(who was then present) & will give
him besides something better and he
also deposes that he heard her
speak words to that effect several
other times since & before that time.

Anne Scarf widow deposes That about
a year the last Christmas she came to
Alice Qualtrough of Kentraugh to pay
her for the use of her Pan & asking
her why she did not keep the Pan at
home she replied that Jo Killey & his wife
had it on hire at 8lbs?? per year, besides
the benefit of it to herself a fortnight
at Xmas & a week at Easter
but that after that present year they
shou’d not have it any longer for that
they were in under with her for the
Rent of the Pan & for some other things 7 or 8s
for the Interest of money

Having consider’d the annex’d Depositions vouching
the Brewing Pan in dispute betwixt John Gill
junr & Anne Nelson als Crebbin, We find it
prov’d by the oaths of Charles Mylrea & Arthur
Calcot, yt Alice Qualtrough decd had bestowed the sd
Pan on John Gill aforesd. Whereby we adjudge
she put it out of her own power afterwards to dispose of
the same by Will or otherwise Dat ut supra

Christopher Kinley deposes that
Alice Qualtrough told him very
many times & at last Easter that
she had lent Jo Gill six pounds
that she was to have 7s Interest
p annu for it & that he was
to give her 8s in the year for
the Rent or Use of her Brewing
pan But that she was often
expending her Gods to get her
money from him & cou’d not.
