In the name of God, Amen.
The last will and testament of John Kinnish of the
town of Douglas who departed this life on the 7th day
November
of October^ 1734 is in the following manner.
He being sick and weak in body, but of sound and perfect
memoery, committed his Soul to God, and his mortal body
to the earth and to be buried after a decent Christian manner
and as for such worldly Goods as it pleased God to bless him wth
he bequeathed them in manner as follows.
Imprimis. He bequethed unto his grandaughter Mary
Kinnish the out house and little Garden, which he
usually called the Folly, as also all the household Goods in the
house, and half a seat in Douglas Chappel.
Item He bequeathed unto his son Robert Kinnish the dwelling
house and the upper Garden.
Item He left six pence Leagacy to anyone any person that
will claim any Legal right to any of his Effects, and lastly
he Constituted, Nominated, and appointed, his said son
Robert Kinnish, whole and sole Executor of all the rest of
his effects, moveable and immoveable, or of what kind soever.
But he provided, that if in case his said son Robert
Kinnish, would not be satisfied that his said Grandaughter
should have the little outhouse and garden afforesaid,
that then, and in that case, he cut him of with six pence
Legacy; and constitued, nominated and appointed, his
said Grandaugher Mary Kinnish, sole and whole Exectr
of all his effects, moveable and immoveable of what kind
soever. This we affirm to be the last will and Testatment
the said John Kinnish,witness our hand the 29th day
of November 1734

At a Chapter Court held in Douglas, 19th May, 1736
Robt Kinnish the Exr Nominated in the within Will being
a ..ans marian, & having neither appeard by himself or
proxy to Execute the same, and that sevrl Courts
have pass'd since the decease of the testator, the
within Mary Kinnish the Grandaughter is sworn to
bring to court the Regry a perfect inventory of all the
effects of the Dec'd & to pay his just debts according
to law.
Memdm
The goods to be inventrory for the [benefit] of Robt
Kinnish are such goods of the Deceas'd as are
not devised by the within will.
Pledges for Mary Kinnish are Robt Moore tobacconist
& Wm Cowley taylor

Robt Kinnish the Exr nominated in the within will is now
sworn to pay the debts & legacys of the testator according
to Law. And has given pledges to yt end, Wm Gilmour ....

At a Consistery Court held in Peeltown, the 19th of Augt 1736
John Kinnish of Douglas late dec'd having pass'd over in
mortgage to Thos Kinnish of KK Santan a Garden wth
certain houses in the sd Town for & in consideracon
of the sum of seven pounds sterling - one pound
was in hand paid, with the further sum of one pound
three shills & four pence to be paid unto Mr Peter Moore
of Douglas - and whereas the sum of four pounds
sixteen shills & eight pence was to be paid unto John
Kinnish affored as ... or upon demand - and that .. ...
sd Thos Kinnish can produce no receipt, vouchers or
evidences for the paymt of the same or of any part
thereof, nor satissfy the court by an allegacons
as yet offered, that he has discharg'd the sd sum
Ordered that he [the sd] Thos Kinnish afforesd do
pay unto Mr Robrt Kinnish Ext of the dec'd the afforemen=
:coned sum of four pounds sixteen shills & eight
pence - otherwide he is to be comitted in St Germans
prison - & thereremain till he submit xxxx xxxx xxx xxxx
