12       KK Michael, October the Sixth 1758: 
In the name of God, amen. I Thomas Caine of Ballalheij i
n the Parish of KK Michael do make this my last Will 
and Testament as following. 
Imprimis, I commend my soul to God and my body to be decently
buried at the discretion of my Executrix hereafter named. 
Item, to the Vicar and Wardens of KK Michael for the time being in
trust and / or the use of the poor of the said Parish, 
I give and bequeath the sum of four pounds, including 
the legacy left them by my wife, to be laid out at interest, 
as the said Vicar and Wardens shall think fit, and 
the said interest to be annually distributed among 
the said poor. 
Item, whereas I have an assignment of a mortgage bearing 
date 5th October 1745 for the principal sum of forty pounds 
on part of the lands of my son in law John Cannell of 
Ballachrionk, I do leave and bequeath all my right of 
and to the issues and profits thereof unto the said 
John Cannell & my daughter Joney Cannell his wife, during 
their natural life, and the life of the survivor of them; 
and afterwards the said mortgaged premises , or my 
right and interest in the said mortgage to fall and 
descend unto my grandson Thomas Cannell, or the lawful 
heirs of my foresaid daughter Joney, in the
nature in inheritance. And I do declare it to be my will, 
and accordingly do devise, that if the foresaid John Cannell 
or any other in his behalf, or desiring any right under 
him, shall redeem the said mortgaged premises that then 
the foresaid forty pounds, with all arrears of interest 
due thereon, or arising out of the same from the date of 
said mortgage, is to be equally divided among my
grandchildren, John, Margaret, William, Philip, Thomas, 
Daniel, & Isabel Quiggen or the survivors of them, 
share and share alike, which is hereby accordingly 
(in case of the redemption aforesaid and not otherwise) 
devised unto them. 
Item, to my foresaid daughter Jony Cannell I give and 
bequeath the yearly issues and profits of my part of my 
meadow at Fourtowns, during her natural life, which 
said meadow with its appurtenances is after her decease 
to descend to her lawful heirs in the nature of inheritance. 
Item, to my Grandchildren Thomas & John Cannell I give 
and bequeath the sum of fourteen pounds equally
between them, including the legacy of forty shillings 
each left them by my wife. 
Item, whereas my son in law John Cannell passed a note 
bearing 28th November xxxx unto Mr George Moore of 
Peeltown, for the sum of nine pounds sixteen shillings
and six pence British, which said not on paying the 
amount thereof the said Mr. Moore endorsed to me or 
order, I do therefore give and bequeath the said not 
and the contents thereof unto the said John Cannell, 
together with the second choice cow I shall
be possessed of at the time of my death. 
Item, to Cath: wife of John Corlet of Ballaugh I 
bequeath twenty shillings and declare that the twenty 
shillings left her by my wife is already paid and discharged. 
Item, to my granddaughter Margaret Quiggen I give
and bequeath the sum of twenty pounds including 
the forty shillings devised to her by my late wife. 
Item, I give devise and bequeath all the right title 
and interest that I have in the Quarterland of 
Shylcaige, or any part or parcel thereof, whether 
sale or mortgage, unto my daughter Margaret Quiggen 
during her natural life and after her decease the 
same to descend unto her heirs in the manner of 
inheritance. I also give and bequeath unto my said 
daughter the sum of ten pounds, and do declare that the ten
pounds left unto her by my wife is wholly paid and discharged. 
Item, to my grandchildren Jane Cannell, & John, 
William, Philip, Thomas, Daniel & Isabel Quiggen, 
I give and bequeath the sum of three pounds each, 
including the legacy left them by my late wife. 
Item, whereas I Thomas Caine the Testator & Jane Caine als Caine 
my late wife did by Deed bearing date 12 March
1754 give, grant, & settle upon our grandson Philip Quiggen, 
certain lands and tenements in the said Deed mentioned and set
forth, I do therefore for the better confirmation 
& strengthening of the said Deed and to the intent 
that the same may be of full force and virtue, 
hereby confirm the same to all intents and purposes whatever, 
and do hereby for the more effectual securing of the premises 
and that my intention may be carried unto full execution, 
give devise and bequeath unto my said grandson Philip
Quiggen, all the said lands and tenements in said Deed 
mentioned; to descend as in and by the said Deed is 
more particularly expressed. I also give and bequeath 
to my said grandson Philip Quiggin, the large table 
and frame, with the forms and dresser in the kitchen, 
together with all the chairs and bedsteads, in my 
dwelling house, as also whatever sheep I shall be possessed of at
the time of my decease, as legacy, and I do appoint 
the Revd. James Wilks, & John Quiggen my son in law guardians and
supervisors of my said grandson. 
Lastly, I give and bequeath unto my daughter Jane all 
my part or share of the cornmill in Glanvullin and its 
appurtenances, together with the house and garden in 
said Glan, lately purchased from John Caine Bahee and
do also leave and devise unto her all the rest and 
residue of my fortune of what nature soever, and do 
likewise nominate and appoint her my said daughter 
Jane Caine sole Executrix of this my last Will and 
Testament hereby revoking all former wills by
me at any time heretofore made. In witness whereof I 
have caused my name to be wrote and have set my mark 
thereto, the day and date first above written.

At a Court of Correction at KK Michael, 
March 7th 1759: 
The Executrix is sworn in Court in form of Law 
and hath given pledges for payment of debts and 
legacies, vizt., Thomas Cannell schoolmaster and 
the Revd. Mr. Mylrea the witness. The Revd. Mr. Wilks 
and John Quiggin are sworn supervisors of 
Philip Quiggin and they are to bring to the 
Registry an Inventory of the several bequests 
left the said Philip.

April 27, 1759: 
John Cannell came this day to the Registry and 
acknowledged that he has received from Jane Caine, 
Executrix of her father Thomas Cain the Testator, 
the cow, as bequeathed to him by said Testator, 
and does hereby acquit and discharge her of the same forever. 

The day & date above written, said John Cannell came to the 
Registry and acknowledged to have received at and from 
the hands of said Jane Caine the Executrix the sum of 
fourteen pounds being the legacy bequeathed by the
Testator Thomas Cain to his grandchildren Thomas & 
John Cannell equally between them, and does therefore acquit and
discharge the said Jane Cain of the same forever; 
as also for the sum of three pounds being the legacy 
left by the Testator to his granddaughter Jane Cannel 
which he acknowledges likewise to have received, and 
for which he likewise acquits said Executrix.

At Lezayre, April 27th 1759: 
John Cannell of KK Michael having this day received of 
& from the hands of Jane Cain Executrix of her father 
Thomas Cain the sum of fourteen pounds being the legacy 
bequeathed by the Testator to his grandchildren Thomas
& John Cannell, children of said John Cannell, and for 
their use and behalf; as also the further sum of three 
pounds being the legacy left by said Testator Thomas Cain 
to his other grandchild Jane Cannel, as appears by 
the last will and testament of said Thomas Cain; the 
said John Cannel has given pledge for the security and 
forthcoming of the respective sums before mentioned,
namely Capt. John Kaighin of KK Michael, 
before me Matthias Curghy. [signed] Jon: Kaighin. 

We the Vicar & Wardens of the Parish of KK Michael 
whose names are subscribed do hereby acknowledge 
to have received at and from the hands of Jane Caine 
aforesaid Parish the sun of four pounds being in 
full of the legacies devised unto the poor
of this Parish, as well by her mother Jane Caine, 
as by her father Thomas Caine of Ballalheij, 
and do hereby acquit and discharge the said Jane Caine, 
her Executors Administrators & Assigns forever for 
the same. And do desire that this our discharge may be 
admitted and received into the Archdeacon’s Registry, 
witness our hands this 9th May 1759.

November 30, 1759: 
Thomas Cain’s land set as follows for 4 years from Brickt[?] 
lanxx[?] xxxx xxx per annum to John Quayle 1 pound 1 shilling 0 pence; 
The Meadow to William Garret 0:18:6; Drimgarroo 2 fields to
Patrick Caine 1:0:0; The Fern ground Ja: Wilks 0:3:6. 

1760 March 15: 
Set to John Quayle syl[?] & John Crellin Ballasalley xxx xxxx 
till 1st November for 20 bundles thatch to be pd
1st Novr & xxx. Wm Crellin of Garey-Dronagh & the 
cow house for said term, he xxxx xxxx xxxx the cow 
house & paying 0:3:0. 
Rents recd 1761 Jan 1 from John Quayle & Crellin 1:10:xx; 
Jan 6 Pat. Caine 1:0:0; 
Wm Garret has paid John Quiggin 0:18:6. 

KK Michael January 22nd 1761: 
Received from the Revd. James Wilks guardian 
of Phil: Quiggin the sum of one shilling and
nine pence being an alienation fine payable on 
some lands in KK German by me: Pat: Cowley 
for Thomas Cowley Moar of KK German. 

February 2nd 1761: 
Received from the Revd. James Wilks guardian of 
Philip Quiggin the sum of four shillings
being an alienation fine payable on some lands in 
KK Michael by me, John Kaighin Moare of KK Michael. 

We whose names ensue being a Jury of four men charged 
by virtue of the Revd. Vicar General Curghey’s taken a
t the suit and instance of the Revd. James Wilks & John 
Quiggin guardians of Philip Quiggin a minor son of 
John Quiggin to estimate value and appraize
certain parcels of lands in the parishes of KK Michael 
& KK German belonging of right to their said Ward 
and having visited the same, Do say that the 
several premises hereafter mentioned are annually 
worth the several sums following. 
The lands & houses of Ballalie are value and appraize to 
forty shillings a year, and the lands at Barrogarrow both 
hay and dry land to forty shillings a year, and also the 
parcel called Cronk Oldey to forty shillings a year, 
and likewise a certain parcel of lands situate in
the foresaid parish of KK German called Scarisdale 
to fifty four shillings a years. 
And this we return as a true valuation of the
annual worth and value of said several premises 
(as lands now set) to the best of our judgement. 
As witness our subscriptions & marks to our names 
this 16th day of November 1759:

A true and perfect Inventory of certain 
Legacies left and bequeathed by Thomas Caine
of Ballalheij in the Parish of KK Michael 
unto his grandson Philip Quiggin a minor valued 
and appraised by John Caine, John Corjeage, 
William Quayle, & Patrick McBooy who were sworn 
by the Sumner of the Parish at the end of May 26, 1759: 
To a large table & frame with two forms in the kitchen 0 pound 9 shilling 6 pence; 
To a two armed chair in ditto 0:2:6; 
To a dresser in ditto 0:2:0; 
To a bedstead in the parlour 0:2:0; 
To 2 ditto in the room over the Parlour, one of them nailed to the
partition 0:4:0; 
To 4 oak chairs & 1 small ditto with the back of an old chair 0:12:0; 
To, 17 sheep in the mountain at 3 shilling per 2:11:0; 
To, 2 lambs in ditto at 1 shilling 6 pence per 0:3:0; 
To, 15 sheep under the care of John Corjeage at 3 shilling pr 2:5:0; 
To, 2 1/2 lambs with ditto at 1 shilling 6 pence per 0:3:9; 
To, 4 quarts & 4 pound wood at 2 shilling 6 pence per 0:11:6;
Total: 7:6:3. 
Note, that all the above particulars are in the custody 
of John Quiggin father and one of the supervisors of Philip
Quiggin and is to be answerable for the same. 
To be deducted: 
To the appraisers 3 days at 4 pence per dach day 0:3:0; 
To the clerk for attending the appraisers in valuing the land, 
and writing their answer 0:1:2; 
To paid for a ladder for the use of the houses 0:6:0.

KK Michael December 9, 1761: 
The within and above returned by the Guardians of 
Philip Quiggin, & John Quiggen in whose
hands these goods remain has given pledges in form of Law, 
namely John Caine (Bahee) & William Cannon both of KK
Michael. 
An Account of the annual profits of certain lands and 
tenements lately the property of Thomas Caine of Ballalheij in
the Parish of KK Michael, but now the property of 
Philip Quiggen grandson of said Thomas Caine; 
as said lands were set by the Revd. James Wilks & 
John Quiggen the said Philip’s guardians for the term 
of four years commencing at 1st November 1759. 1st, 
The lands & houses of Ballaleij in the hands of John 
Quiggen, at the appraisement, he keeping said houses in
tenantable repair, which with said appraisement is 
deemed a sufficient value for them, so if said John 
Quiggen is to be answerable for said appraisment, 
vizt, the annual sum of 2 pounds 0 shillings xx pence; 
2nd, Tallow-vair being part of Baare-garroo set to 
John Quiggin at the annual rent of 1:1:xx; 3rd, The meadow 
to William Garret at the annual rent of 0:18:xx; 
4th, Drimgarroo, 2 fields, being part also of 
Baaregarroo and set to Patrick Cain at the 
annual rent of 1:0:xx; Scarisdale Land in
KK German set to John Quiggen at Cronk Ourley 
(als Renuirlin[?Renivirlin]) to the Revd. 
James Wilks at 2:0:xx; Total Annual Rent 9:13:xx. 

Note: There is parcel of Fern Ground at the foot 
of the mountain of which no advantage was taken 
anno 1760; therefore nothing to be paid thereout 
said year; but anno 1761 the Revd James Wilks cut 
said Fern and is answerable for 3 shilling 6
pence on account of said Fern said year. 

Note that Lord’s rent, boons, carriages, church 
assessment and all other annual outgoings 
appurtenant to these lands are to be
deducted out of the yearly profits thereof. 

November 14, 1761: I John Quiggen do hereby acknowledge 
to be in the receipt of the rents & profits of all the above named
lands &c. (save Chronck-ourlay for which Mr. Wilks 
is accountable) and do hold myself answerable for the same to my son
Philip Quiggen. Witness my hand [signed] John Quiggin. 

November 14, 1761: I James Wilks do acknowledge myself 
accountable for the rent and profits of Cronck-ourlay, as also for
the Fern-ground for 1761. Witness my hand [signed] Ja:Wilks. 

At KK Michael December 9, 1761: The above account retained 
by John Quiggen and the Revd. James Wilks, pledges for the
former according to Law are John Caine, Bahee & William 
Cain of KK Michael, & for the latter Mr. William Cubon Deputy
General & xxxx. 

An Account of Sundry Costs & Charges expended and defrayed 
by the Revd. James Wilks & John Quiggen guardians of
Philip Quiggen in defending a settlement made on said 
Philip by the dead Thomas Cain & Jane his wife against 
the unjust attempts of John Cannell to frustrate said 
settlement, by Bill in Chancery: 1759: To paid Mr. John 
Taubman a retaining fee 0 pound 15 shilling 10 pence; 
May, To paid ditto for attending the Chancery Court 0:11:8; 
August 2, To paid ditto for ditto (said Cannell’s action 
being dismissed [has been crossed out]) 0:12:3; 
October 6, To paid ditto for attending Cannell’s Petition for a
rehearing and getting said Petition also dismissed 1:4:6; 
To paid for a copy of Cannell’s first action 0:1:9; 
To paid for a ditto of his second action and dismissal 0:4:8; 
To paid for ditto of Cannell’s Petition for a rehearing 
& the Court’s order for dismissal 0:7:2; 
To paid for courts confirmation of foresaid settlement 
in Glanfabba & Michael Sheading Courts 0:3:0; 
To paid for a copy of said settlement 0:1:6; 
for a copy of Thomas Cain’s Will 0:1:9; 
To paid for an Alienation Fine on account of 
the Lands in KK German 0:1:9; 
To paid for ditto on account of the Lands in KK Michael 0:4:0; 
Total outgoings to be deducted out fo the first
year’s Rent 3:19:10; Of which sum advanced by John Quiggen 1:16:11, 
by the Revd James Wilks 2:2:11, Total 3:19:10. 
Note that the Guardian’s personal Expenses and Trouble 
and Loss of time in defending this troublesome suit 
is submitted to the consideration of the Court. 

At KK Michael December 9, 1761: 
The above Account of Costs rexxxx by the Supervisors 
which is to be deducted out of the profits of the lands 
within mentioned and the personal expenses, trouble and 
loss of time of said supervisors, in defending the
rights of their Ward, is by their consent reserved to 
be considered and settled, till said Ward is of lawful age. 

To the Reverend Ro: Radcliffe and 
Matths. Curghey Vicar General of this Isle, 
The humble Petition of John 
Quiggin father and one of the
supervisors of Philip Quiggen 
of the Parish of KK Michael, 
Sheweth, 
That your Petitioner’s said Ward is by the last will and
testament of his grandfather Thomas Cain of Ballalhei of 
said Parish late deceased well entitled to certain concerns 
of houses & lands to the annual worth or value of nine pounds 
thirteen shillings and six pence as lands, and houses 
now set together with certain legacies to the amount of 
seven pounds six shillings and three pence, for the 
forthcoming whereof Petitioner & the Revd.
James Wilks the said Philip’s guardians gave in security 
to be accountable when he should arrive at age; 
That your Petitioner has been at some considerable 
expence these two yars last past in educating clothing 
and maintaining his said ward in a manner
becoming and suitable to his fortune for which 
he has not been made any allowance or compensation 
as yet; He therefore humbly pray your Reverences 
would be pleased to order Petitioner (who has 
a number of other children to provide for) a
sufficient sum out fo the growing profits of 
the said concerns for the education clothing 
and maintenance of said Ward till he
arrives of age, and Petitioner 
as bound shall for your Reverences ever pray &c. 

At KK MIchael February 18, 1762: 
The Petitioner having consented to accept of 
two pounds fourteen shillings per annum,
with the annual profits of some sheep belonging 
to Phil. Quiggen aforesaid for and on account 
of the maintenance and education of said Phil, 
which the Revd. Ja: Wilks the said Philip’s 
other guardian agrees should be allowed the 
Petitioner in this respect, provided the said 
Philip be duly kept to school, We also think the 
foresaid allowance reasonable, and it is hereby granted the
Petitioner accordingly. 

August 30th 1762: 
John Quiggin senior came this day to the Registry and 
acknowledged that he hath received at and from the
hands of Philip Radcliffe husband of Jane Radcliffe 
als Caine the Executrix the sum of ten pounds being 
the legacy bequeathed unto Margaret Quiggin his wife 
by her late father Thomas Caine the Testator, and 
does hereby acquit discharge and release the
said Philip Radcliffe & Jane his wife their 
executors, administrators and assigns thereof forever, 
before me John Gill Ar. Regr. 

August 30th 1762: 
Margaret Quiggin daughter of the above John Quiggen 
senior came to the Registry this day and acknowledged 
that she hath received at and from the hands of Philip 
Radcliffe husband of Jane the xxxx the sum of eighteen
pounds bequeathed unto her by the Testator Thomas Caine 
her grandfather and doth hereby acquit release and 
discharge the said Philip Radcliffe & Jane his wife 
their executors administrators and assigns thereof forever. 
Before me, John Gill Ar. Regr. 

August 30th 1762: 
This day John Quiggen junior, William Quiggen & 
Philip Quiggin sons of John Quiggen senior came 
to the Registry and acknowledged that they have 
each and every of them received at and from the 
hands of Philip Radcliffe husband of Jane Radcliffe 
als Caine the Executor the sum of twenty shillings 
apiece being the legacies bequeathed to them by 
their late grandfather Thomas Caine the Testator, 
and each and every of the said John, William, & 
Philip Quiggen doth hereby acquit release and 
discharge the said Philip Radcliffe & Jane his 
wife of the said sum of twenty shillings apiece l
egacy as likewise their Executors Administrators & Assigns forever. 
Before me, John Gill Ar. Regr. 

I Thomas Cannell son of John & Joney Cannell of Ballxxxx 
in the Parish of KK Michael do hereby acknowledge to have
received at and from the hands of my father John Cannell 
the sum of sxxxx pounds bequeathed unto me by my grandfather
Thomas Caine, and the further sum of three pounds ten 
shillings being one half of seven pounds bequeathed 
unto my brother John Cannell, as he is in his minotiry, 
the said several sums having been received by my said 
father from my aunt Jane Caine Executrix of the last will 
and testament of the said Thomas Caine my grandfather, 
and I do hereby acquit and discharge my said father John 
Cannell and all others of the same and every part. I have 
in like manner discharged or released him by receipt of
xxx date with these presents of the legacy of forty 
shillings bequeathed unto me by my grandmother Jane 
Caine als Caine. In witness of all which I have 
hereunto subscribed my name this 26th day of August 1769.

August 26, 1769: 
Thomas Cannell acknowledged the above received & 
acquittance, 
before me, James Wilks. 
Let this be
annexed to the last will and testament of Thomas Caine o
f KK Michael recorded in Lib: 1st Testament 1759, in the Ar: Regry.

November 27th 1775: 
This day Daniel Quiggen, Thomas Quiggen & Isabel Quiggen 
grandchildren of the Testator Thomas Caine and also John 
Corlett acknowledged to have received & be fully paid and 
satisfied the respective legacies bequeathed them by said 
Thomas Cain, and they do each and all of them hereby 
acquit release and discharge the Executor of said Thomas
Cain of said respective legacies.
