The Last Will & Testament of Henry Qualtrough
of Kentraugh Miln in the Parish of Trinity Rushen
who departed this Life about the 26th Decembr
in the year 1766.
About three days before his departure he
expressed himself in presence of subscribing
Witnesses in the following manner, in
That he looked upon himself to be a dying man,
and therefore he cut off his brother Wm Qualtrough
from any benefit of his Goods with six pence Legacy.
Itm He left & bequeathed to his Cousin
Willm Qualtrough, a Guinea, his own Chist and a
little stack of Gorse that was near the house and
to his Cousin Eleanr Cashin, als Qualtrough one of
the large Chists that was in the Parlour by way
of Recompense for their kindness in keeping him company
and attending him in his sickness.
Lastly He left all the rest of his worldly Goods
moveable and immoveable to his loving Brother viz
Ewan Qualtrough of the said Parish whom he also
Nominated and appointed his Executor.

At a Court of Correction holden at Castletown Feb. 18 1767
Willm Qualtrough one of the Testator’s Brothers having
made some objections to the validity of this Will, alledging
another Will to have been made by him, which on
Examination appears to have been made prior hereto.
But the sd Willm by Agreement here unto annexed & on
the Conditions therein mentioned having waved sd objections
Ewan Qualtrough the Execr herein named is sworn for
payment of the Testator’s Debts & Legacies according to
Law & to that end hath given Pledges namely Capt Matth.
Taggart of Castletown & Wm Qualtrough afore sd of KK
Christ Rushen.
Solvit 12d Probatum est
Ro: Radcliffe
William Qualtrough & Ewan Qualtrough both of
the Parish of Trinity Rushen have Agreed in Court that the
said Wm Qualtrough is entitled to whatsoever part
of his late Brother’s Henry Qualtrough’s Goods are
at present in his hands and also to the new miln
stone now at the miln at Kentraugh and the Croft
belonging to the said miln in Present possession to
the said William paying to his Brother the said Ewan
Qualtrough the sum of two guineas in full of all
Accompts. In Consequence hereof the Parties have
bound themselves in the penalty of sixty pounds ster.
to drop all further proceedings and Disputes upon
their Brother Henry’s Will for the future this 18th Day of
Febry 1767. Itm and that the said Wm is to have what
Goods of his own are yet in his late brother Henry’s house..

Ewan Qualtrough & Wm Qualtrough desirably acknowledged the
within Agreemt.

The last Will & Testament of Henry Qualtrough of
the Parish of KK Christ Rushen being of perfect mind &
memory who Departed this Life about the 26th Day of December 1766.
First He committed his soul to God and his Body to decent
Christian Burial.
Item He bequeathed to his Mother Eleanor Qualtrough als Waterson
the sum of Ten Pounds and a coat and Waistcoat.
Item He bequeathed to John Kinvig his great coat.
Item He bequeathed to the Poor of KK Christ Rushen the Sum of Ten
Shillings
Lastly He Nominated Ordained and Appointed his Brethren William
Qualtrough and Ewan Qualtrough to be joynt Exers of all the rest
Of his Goods moveable and immoveable to be by them quietly enjoyed
and possessed and cut off all other claimers with six pence Legacy.

John Cashin affirmeth that being with the Testator three or
four hours before his Death the Testator being at the time of
of perfect sence and memory the said Cashin asked him if he had
made his Will the Testator said he had Cashin further asked him
what Will he had made and who the Witnesses were the Testator
told him that he had no friends but his Brethren to whom he had
left all this Effects and that John Watterson and John Watterson were
witnesses to the sd Will.

John Waterson & John Waterson Witnesses to the within
Alleged Will have agreed on the holy Evangelista that
Henry Qualtrough being of perfect mind and memory declared
the same in their presence sometime in Harvest 1765
or thereabouts - and John Cashin has also agreed to this
truth of the within Declaration.

Henry Kermod of Portlemorey in the Parish of Trinity
Rushen Declares, that about the first Day of Novr in
the year of 1766 being at the house of Henry Qualtrough
of the said Parish receiving payment for his mother’s coffin the said Henry
Qualtrough then and there affirmed that he was under
great trouble and vexation that his Brother William
had got such a bargain of him against his inclination
which was a great concern to him at that time that the Death
of his Poor aged Mother and that therefore his sd Brother
William should not be above six pence the better the rest of

John Waterson of Oristal in the Parish of Trinity
Rushen declares that being in the company of Henry
Qualtrough of the said Parish the 19th day of Novr 1766
the same being the Chapter-court Day in Castletown the said
Henry Qualtrough affirmed that the Drummer (by whom
this Deponent apprehends he meant his brother William
Qualtrough ) should never enjoy above the value of six
pence of his Goods seeing he had used him so cruel, or
words to that purpose.

William Gell and John Killey both of the
Parish of Trinity Rushen do solemnly declare
that as they were threshing wheat in the house
of Henry Qualtrough of Kentraugh miln in the
said Parish on or about the 10th Day of Octobr
1766, they said to the said Henry Qualtrough that
he was grown hard because he had not given
them any drink the whole day, what did he design
to do with all this Goods? Upon this he replied that
his Goods might be little enough for himself before
he died; but as for his brother William he cut him
off with sixpence Legacy, and whatsoever Remainder of
Goods might be be forthcoming after his Death he left
them wholly to his Brother Ewan whom he also no-
iminated and appointed his Executor.
