Whereas Henry Kaighin of Scarrisdale beg in the Parrish of KK Michael 
departed this life on or about the first day of January 1771 Intestate, 
leaving behind him Five Children, namely John who obtained a Settlement 
by Marriage Contract bearing date the 18th Jan, 1763 of the said Intestate 
real Estate on Conditions and Stipulations in sd. Contract set Forth; 
and Joney, Anne, Thos and Mary Kaighin unprovided for by any Deed Contract 
or otherwise; And whereas by the Law of this Land the last mentioned Joney, 
Anne, Thomas and Mary Kaighin have all joint equivalent Right to the 
Intestate’s Chattles and Effects as also to the Sum of Two pounds ten 
shillings which was due unto the Intestate at the time of his death from 
his fores’d Son John Kaighin which was a part unpaid of the consideration 
he was to give in leiw of the fores’d Settlement.  
It is there fore hereby agreed upon by the Parties that is to say, John Kaighin 
afores’d , on the one part and Joney, Anne, Thos, & Mary Kaighin afores’d who 
are all at age on the other part, to avoid Contention and Expense to come 
to the following agreement; 
First that the said John Kaighin will pay unto his s’d Brother and Sisters 
the Sum of Six pounds exclusive of the s’d Two pounds ten shillings on demand, 
which when received by them shall with the fores’d two pounds ten shillings 
be in full of all that could be due unto them by the decease of their Father 
Henry Kaighin afores’d. 

It is likewise hereby consented that Thos Kaighin shall have all he chuses 
to accept of his father’s shaped Apparel, and that Mary Kaighin afores’d shall 
have the two Blankets and Coverlet that was on her Father’s bed at the time of 
his decease, besides their dividend of the two fores’d sums of Six pounds and 
Two pounds ten shillings. 

And for true performance hereof and abiding firmly by the contents of it, the 
parties concerned respectively bind themselves under the penalty of twenty pounds.  
In witness wereof they have caused their marks to be affixed to their names this 13th Feb 1771.

John Kaighin, Joney Kaighin, Anne Kaighin, Thos Kaighin and Mary Kaighin acknowledged 
the within and above agreement to be their mutual act and deed

At a Chapter Court holden at KK Michael
May 31, 1771 
This agreement having been duly executed by all the children of Henry Kaighin dec’d, 
the same is accepted in the place of an … of the goods and chattels of Sd. Henry Kaighin 
and John Kaighin is now sworn for payment of his said father’s Debts to which end and 
for performance of this agreement he has given pledges in form of Law namely Ja. Corkhil 
and John Collin, both of KK Michael.

Thos Kaighin and John Corkan, husband of Anne Kaighin, which sd Thomas and Anne are children 
of Henry Kaighin late dec’d acknowledge to have rec’d from their brother John Kaighin the 
sum of two pounds two shillings and six pence in full of the share of goods due unto them 
respectively by the death of their father and hereby severally acquit and discharge 
the sd. John Kaighin of the same.

James Corkan Husbd of Mary Kaighin one of the Children of Henry Kaighin late dec’d acknowledged 
to have recd from his Brother John Kaighin the sum of two pound and two shillings and six pence 
in full of the share of goods due unto him by the death of the sd. Henry Kaighin and hereby 
acquits and discharges the sd. John Kaighin of the same.  Witness his name and mark the day above written.
