25                Arbory
This is affirmed to be the last will and testament of Patrick Cannel 
of KK Arbory who departed this life the 1 of January 1778. 
First, he commended his soul to God and his body to Christian burial. 
Item, he left unto his daughter Mary wife of John Clague the sum of 
twenty pounds, and in case his said daughter died within a year and 
a day after the time of making this his will that said sum was to come 
to her children. 
Item, he left unto his son William Cannel ten pounds and all the 
husbandry gears. 
Item, he left unto his son John Cannel twenty shillings and his 
grandson Patrick son of said John Cannell forty shillings. 
Item, he left unto his daughter Margaret wife of Timothy Crebbin a cow. 
Item, he left unto his daughter Jane wife of John Stephen six pence legacy. 
Lastly, he constituted and nominated his loving wife Margaret Cannel 
sole executrix of all the rest of his goods moveable and immoveable 
and that she his said executrix was not to pay the above legacies 
until the time of her death unless she thought proper to do them.

At a Consistory Court holden at 
Castletown January 29th, 1778, 
The executrix is sworn in Court in form of Law and hath given pledges 
for the payment of debts and legacies, namely Timothy Crebbin of 
KK Christ Rushen and Wm Cannel of KK Arbory. 

To the Revd John Moore and Evan Christian Vicars Gen’l of this Isle, 
the humble Petition of Margaret Cannell of the Parish of KK Arbory, 
Sheweth 
That you petitioner’s husband Patrick Cannell of said parish departed 
this life on or about the 1st day of January 1778 but previous to 
such his decease duly made and published his last will and testament 
and thereof (after bequeathing several legacies) appointed your 
petitioner sole executrix and residuary legatee of all his goods, 
chattels and effects. 
That there are several outstanding debts due to your petitioner in 
right of her said husband which are upon a precarious footing and 
may unless timely prosecuted be xxx lost to the manifest detriment 
of all concerned; 
Your petitioner therefor humbly prays that your Reverences will be 
pleased is appoint a short day for the probate of said Will whereby 
your petitioner may be enabled to and duly empowered to come at 
justice according to Law and your petitioner as in duty bound shall pray etc. 

Ordered that the matter of this petition on to be heard at a Consistory 
Court to be at Castletown in Thursday the 29 instant xxx all proper parties 
and persons xxx all the next of kin have due notice and xxx service. 
Given at KK Arbory the xxx 1778.

Pursuant to the above order, I have charged John Cannell and William Cannell 
to appear at a Consistory Court to be at Castletown Thursday by ten o’clock 
in the forenoon to answer the suit of Margaret Cannel. 
This I aver this 23rd day of January 1778.

Pursuant to the above order I have charged Timothy Crebbin, John Clague, 
Henry Watterson, James Christian to appear at Consistory Court to be holden 
at Castletown on Thurxday next 29th Instant at ten of the clock in forenoon 
to answer the suit of Margret Cannell. 
This I aver this 24th of January 1778.

By virtue of the Rev. Vicar Gen’l Moore’s order granted on the petition 
of Margret Cannell I have served John Stevenson & Jane Stevenson alias 
Cannel his wife with said petitioner and likewise charged them to appear 
at the Consistory Court to be held at Castletown on Thursday the 29 Instant 
by ten of the clock in the forenoon at the suit of said petitioner. 
This I aver January the 25, 1778.
