NOTE:

Catherine died sometime between 1705 and 1725. The Decree was issued as a result of a Petition by her grand-son William Kinread.



June 18th 1785
   To the Revs John Moore and Evan Christian Vicars Genl of this Isle
      The humble petition of William Kinread of Killey-brickey
      in the parish of KK Christ Lezayre
Sheweth
      That William Baston of KK Andreas departed this life sometime
   in the year 1704 and having made his will, after Bequeathing
   several Legacies he left to Daniel Dowan's wife his estate of land
   and houses if his contract given to his wife would not stand and
   lastly he applointed Catherine Baston otherwise Kinread his sd wife
   and Grandmother to petr (since deceased) sole and whole Executrix
   of all the rest of his goods movable and imovable whatsovever as
   by his said wife may at large appear.
      That petitioner hath lately been charged before the woship-
   -ful Deemster Moore Esqr at the suit of several persons in the
   sd parish of KK Andreas to make a Division and boundary
   fence in a certain parcel of Land situate in sd parish
   called Curragh ny jey Groatyn part of which belonged to the sd William
   Baston & Catharine his sd wife - The plaintiff's alledging
   that petr was the Heir at Law and next of Kin of the said
   Catherine Baston.
      That petr since the discovery of his right and Title
   to the said parcel of Land hath been credibly informed that said
   William Baston and Catherine his wife were proprietors
   of much larger prossesions and parcels of Lands than their
   part of the before mentioned parcel.
      That petr in order to make a further discovery of his Title
   to said premises on add application to a will the Episcopal
   and Archdeacons Registers for a copy of his sd Grandmother's
   Will or Decree which petr hath not been able to find upon Record
   as by the respective certificates of the Revd John Crellin Episcopal
   Register and the Revd Thomas Cubbon the Archdeacons Reg
   so that effect may at large appear.
      That tho' the said William Baston left all his Lands and
   Houses to sd Daniel Dowan's wife as mentioned in said Will
   yet it is clear that it was upon condition & with a provio
   also expressly specified "if (or in case) his contract given to his said
   wife would not stand" as by the said Will may appear.
      That by vertue of the said Contract Deed petr humbly
   conceives he ought to have an undoubted right to the
   premises of Land and Houses settled by sd William
   Baston upon petrs said Grandmother as her Heir at Law.
      That petr would further observe to your Revces that
   as no Will or Decree of his sd Grandmother appears to
   have been recorded - Your petr apprehends that no
   disposition was by her made either of what her said
   husband had settled upon her by sd Contract Deed
   or of her own part of sd Estate of Houses and Lands by which he
   would well hope he hath a very just right & title to
   all and every the said Estate of Houses and Lands whatever.
      That petr is advised that notwithstanding his un-
   =doubted right and Title to the sd premisies as Heir at
   Law & next of kin of the said Catherine Baston
   yet it will still appear absolutely necessary that pertr
   be in the first place Decreed Administrator fo the good
   chattles & effcts of sd Catherine Baston beofe he can
   proceeed fait leges with any legal prpinety to clear up
   his right and title to the premises.
           In tender consideration of the premises
           the petitioner humbley pray that your Revcs
           would be pleased to admit off and Decree petr sole
           and whole Administrator of the goods and
           Effects of said Catherine Baston at the next
           Consistory Court to be holden at KK Michael
           for upon such short time as to your Revcs shall
           seem meet - that petr may proceed to act
           by vertue of said Administration to clear up
           display & ascertain his undoubted right to
           all and every the premes mentioned in
           this petition. And petr will pray etc.
           
Ordered that the matter of this petition come
on to be heard at a Consistory Court to be holden
at St John's Chappel on Frday the 24th
instant whereof allproper persons as aslo the
next of kin to have due notice & service.

This is to certify that having searched the
Episcopal Registry for the Will or Decree of
Catharine Baston of the parish of KK Andreas
who is alleged to have died between the years
1704 and 1731 inclusive, no Will or Decree
under her name appears to have been recorded
in the sd Registry during the period above
mentioned. As witness my hand this
11th day of June 1785

I do hereby certify that I have examined the
Registry from the year 1705 to the year 1725 & I cannot
find either the Will or Decree of Cath: Baston during
that period. As witness my hand this 13th June 1785.

      At a Consistory Court holden at KK
      Patrick on the 24th day of June 1785
Catharine Barston als Kinread als Callister
of the parish of KK Andreas having departed
this life between the years 1704 and 1725 and
certificate having been returned by the Episcopal
and Archdeacon's Register that no Will or
Decree under her name can be found during
that period the Court upon intelligence
thereof hath decreed her two Grand-children
namely, William and Ann Kinread join Ad-
-ministrators of all her goods chattels and
       movable and immovable
effects ^ of what kind or nature soever. The sd
Ann having in Court resigned her Right in
the administration of the sd effects to William
Kinread. He is thereupon sworn well and
truly to administer the goods chattles &
effects of the Intestate, and to pay all her
just Debts so far as the said goods will
extend and the Law shall bind him. To
these ends he hath given pledges in form of
Law namely, William Quayle of Ballaugh
and Thomas Cannell of the parish of Maslew.
