Maughold
The humble petition of Thomas Martin of Ramsey an administrator of the
estate of Wm Martin of the said town deceased.
Sheweth: That the said Wm Martin departed this life sometime ago intestate
and Letters of Administration of his estate and effects were granted unto
your petr and Edmd Martin on the 17th Feb 1804.
That the personal estate of the said decedent is considerably deficient
to discharge the amount of the several claims substantiated against the said
estate as will be made to appear.
Wherefore your petr humbly prays for a hearing of this petition and that
your Reverences will be pleased to order a distribution of the said
estate to be made amongst the several claimants thereof and that all orders
against your petr in the capacity aforesaid may in the mean time
be suspended and your petr shall pray.
9 Oct 1806 Ordered that this petition do come on to be heard at a
Consistorial Court to be holden in the Court House in Kirk Michael on
Thursday the 30th day of October instant and that all orders of this
court against the petr as administrator of the estate of Wm Martin deceased
be stayed and suspended whereof all proper parties and persons to have
notice.

At a Consistorial Court holden in the parish of KK Michael on the 29th
day of July 1807.
Upon hearing the beforegoing petition in the presence of parties and upon
reading copies of the inventory appraisement and accounts Sale of the estate
and effects of the said Wm Martin deceased an extract of the claims entered
and proved against the said estate and the other proceedings had in this
court respecting the same and upon consideration had thereof as also of what
was otherwise pleaded argued, alleged and admitted by and on behalf of the
said parties respectively. It is the
opinion of the court that the personal estate assets and effects of the said
decedent are not sufficient to pay the full amount of all the claims entered
and proved against the said estate and effects and it is
thereupon hereby ordered ajudged and decreed that the Deputy Episcopal
Register do after having deducted funeral expenses all other claims that
have a priority of payment and his own fees from the said estate distribute
the remainder thereof pari pasau amongst the common creditors of the said
estate and that the said administrators do
forthwith pay them their respective dividends thereof sub paenas juris with
also fees. Evan Christian

Mr Thos Martin the bearer informed me that one half of a yawle which
was appraised and sold by him at Auction as part of the estate of his father
and inventoried has since been sold by virtue of the Honorable Deemster
Crellin's order and execution for materials furnished at
building the said yawle by John Quilliam Coroner of Garff Sheading for
less money than that which he was first sold. You will therefore please
to allow him to deduct the sum for which he sold her for from the
auction sale before a distribution will be made of the estate as it would
otherwise be less of ©6 1 shilling to the bearer complying with which
will oblige.

Pursuant to an order of Judgment of the Rev'd Vicar General Christian
granted on the petition of Thomas Martin one of the administrators of
the state of William Martin of the town of Ramsey late deceased, dated 29th
day of July 1807. I have distributed the amount of the said estate amongst
the respective claimants thereof whose proportions stand as in the schedule
following:

From which last amounts deducted the value of one half of a yawl
included in the said accounts Sale which yawl was afterwards taken and sold
by order of the Honorable Deemster Crellin in order to discharge certain
debts incurred on account of materials furnished for building
said yawl which debts exceeded the proceeds of the last sale of the said
yawl.
Allowed the said Admor for funeral expenses of the said deceased and
his own trouble, costs, and fees attending the administration of the said
estate as per taxed account £25- 7 - 77 Manx is £21 - 15 -1 1/2
Matths Morrison claims including fees for wages 0-6-6
Deputy Register's trouble making this distribution and a
copy thereof 0 - 7 - 6
Remain to be distributed amongst common claimants

Know all men by these presents that we Wm Sayle and Daniel Christian
of Ramsey and William Kneale of Maughold do hereby own and
acknowledge ourselves to be and stand justly indebted unto Edmd Martin and
Thomas Martin of Ramsey aforesaid administrators of the state and effects of
Wm Martin late of the said town deceased in the sum of fifty pounds to the
payment whereof well and truly to be made unto the said Edmd Martin and
Thomas Martin the executors and administrators we
bind ourselves, our executors and administrators firmly by these present as
witness our hands the 26th day of Jun 1805.
Whereas the said Wm Sayle hath entered and duly proved his claim
against the estate and effects of the said Wm Martin for the sum of twenty
pounds four shillings British as by an order dated the 19th day of May 1804
may appear.
And whereas the said Daniel Christian hath also entered and duly proved
his claim against the estate and effects of the said William Martin for
the sum of five pounds twelve shillings British as by an order dated the
19th day of May 1804 may appear.
And whereas the said William Kneale hath also entered and duly proved
his claim against the estate and effects of the said William Martin for
the sum of three pounds six shillings and seven pence half penny British
as by an order dated the day of May also appear.
And whereas the said several ordered have been stayed and suspended or the
application of the said Edmd Martin and Thomas Martin under
pretense that there may be a deficiency of assets to satisfy and discharge
the whole of the debts due by the said Wm Martin deceased.
Now the condition of the before written bond or obligation is such that
in case the said estate and effects which ever of the said Wm Martin
deceased shall be insufficient to pay and discharge the whole of his
debts if the said Wm Sayle, Danl Christian, and Wm Kneale and every of them
their executors and administrators shall refused to the said Edmd Martin and
Thomas Martin the executors and administrators all such sums and sums of
money as they shall severally have received over and above the respective
dividends or shares and shall at all times and demnify
and save nevertheless the said Edmd Martin and Thomas Martin their
executors and administrators the before written bond or obligation to be
void otherwise to be and remain of full force and virtue.
