To the Revd Evan Christian Vicar General of the Isle and Diocese of Sodor
and Man.


The humble petition of James Quirk Esquire of Knockaloe, in  the parish of
Kirk Patrick and Philip Quirk of Liverpool (ship builder)
Sheweth That Philip Quirk of Ballavahger in the said parish departed this
life in or about the month of January last past and previously thereto duly
made and published his last will and testament nunrecuperative wherein and
whereby he nominated, constituted, and appointed your petitioners his two
elder sons and William Clark of Ballawillian and John Gell of
Kennaa, executors in trust; thereof and guardians of his youngest children;
until they attain the age of twenty- one years.
That the said William Clark and John Gell have expressed a wish and desire
to exonerated of the said trust and guardianship and seem to decline the
burden of the execution of the said will.
Wherefore your petitioners pray an hearing of this petition and that in case
they the said William Clark and John Gell refuse the burden of the execution
of the said will as aforesaid and also the guardianship that your
petitioners may be sworn the executors in trust of the said will and sole
guardians of the said children and your petitioners will pray.
Ordered that the before going petition do come on to be heard at an Eccl
Court to be holden in the Court house in this parish on Friday next where of
all proper parties and persons to have notice.
Given at KK Patrick 7th July 1807   Ev Christian

This is affirmed to be the last will and testament of Philip Quirk of
Ballavaugher in the parish of KK Patrick being of sound perfect mind and
memory at the making thereof as follows this 6th Jan 1807 -
First He committed his soul to Almighty God and his body to Christian
burial.
2ndly He left unto his two eldest sons James and Philip the sum of five
shillings British a piece.
Item: He left unto his daughter Ellinor the sum of five shillings British.
Item:  He left unto his daughter Ann the sum of seven pounds and seven
shillings British she borrowed of him.
Item:  He left unto his son John the sum of fifteen pounds British and his
whole right and title to a certain house and back yard thereunto belonging
situate in the town of Peel known by the name of Hutchins House and also his
right and title to a certain meadow situate in the parish of KK German known
by the name of Keail Curragh.
He left unto his son Joseph the sum of twenty pounds British.
Item:  He left unto his daughter Christian his part of a certain dwelling
house situate in Castletown together with the shade backyard and garden
therein belonging.
Item:  He left unto his daughter Catharine the sum of One hundred Pounds
British.
Item:  Whatever legacies that is due unto John, Joseph, Christian and
Catharine aforesaid by the death of their mother is to be included in their
legacies. Which is now bequeathed unto them in this present will.
Lastly He nominated and appointed his two youngest sons namely Thomas and
Charles to be joint executors of all the rest of his goods and effects
moveable and immoveable be the same what kind or denomination soever.
He further nominated and appointed his two eldest sons namely James and
Philip and William Clark of Ballawillin and John Gell of Kennaa to be sworn
executor in trust and guardians over his youngest children until they arrive
to the age of twenty-one years.

At an Eccl Court holden in the parish of Kirk Patrick on the 10th day of
July 1807.
The said William Clark and John Gell having refused to undertake the burden
of the execution of the before going will and also to be guardians of the
testator's said youngest children, they the said James Quirk and Philip
Quirk the other two executors in trust and guardians therein named are
thereupon sworn executors in trust of the said will to exhibit a full, true
and perfect inventory of all and singular the goods, rights, credits,
chattels, and effects of the said testator into the Archdeacon's Registry
and to be guardians of his children who are under age and have given pledges
for the payment of his debts and legacies namely James Cowle of Ballquane in
the parish of Kirk German Esquire and Matthias Kelly of Douglas Chandler
Probatums est  Ev Christian

We William Quirk, John Quirk, Anne Fayle als Quirk, Ellinor Fargher als
Quirk, Catherine Sayle als Quirk and Isabel Quay als Quirk sons and daughter
of Wm Quirk of Kirk Patrick late deceased do hereby acknowledged to have
received from Richard Quirk the executor of the last will and testament of
the said Wm Quirk all and every the legacy and legacies left and bequeath
unto us in the said will and do hereby acquit exonerate release and
discharge the said Richard Quirk and his Heirs, Executors, Administrators,
and assigns of the same and every part thereof.  As witness our names and
marks this 23rd day of June 1808.

William Quirk John Quirk, and Philip Fargher acknowledged the within receipt
and discharge to be the proper voluntary act and deed before me
Thos Cubbon.
