To the Reverend Thomas Cubbon and Thomas Stephen Vicars General of this
Diocese. The humble petition of Catharine Kelly of the town of Douglas
widow.
Sheweth - That on or about the 3rd day of Aug last past Henry Killey of the
parish of Kirk German departed this life but previous to his decease made
and published his last will and testament in writing and thereof appointed
your petitioner executrix which will bears date on the 13th day of October
1821. That your petitioner who is a daughter of the said Henry Killey
attempted to have the said will proved at a Chapter Court holden in St
John's Chapel on the nineteenth day of October instant, but in consequence
of the litigious opposition given by the petitioner's brother in law William
Cannon the cause touching the validity for the said will was held over for
trial and investigation in consistory. Your petitioner therefor humbly
prays for a hearing of this petition and cause and that the said will may be
received and established in form of law and your petitioner thereof sworn
executrix accordingly, and that the said William Cannon may be ordered to
pay the costs of suit and your petitioner prays for such other and further
relief in the premises as the case may seem to require and she will
pray------ John Stephen for petr. Ordered that this petition do come on to
be heard at a Consistorial Court to be holden in Ramsey on Thursday next
whereof all proper parties and persons are to have due notice. Given at
Kirk Marown this 25th day of October 1822. J. Stephen.
In the name of God Amen. I Henry Killey late of BallaKaighin in the parish
of KK German but now of the town of Douglas being of sound mind memory and
understanding and calling to mind the uncertainty of this life do make this
my last will and testament in manner as followeth: FIRST - I commit my soul
to God and my body to a christian burial.
ITEM - I leave and bequeath to the poor of the Parish of KK German ten
shillings British to be distributed among them as legacy.
ITEM - I leave and bequeath to my daughter Ellinor she wife of William
Cannon of BallaKaighin KK German ten shillings British as legacy.
ITEM - I leave and bequeath to my granddaughter Ann Killip the wife of
Thomas Killip of Moaney Voar ten shillings British as legacy.
ITEM - I leave and bequeath to my grandson John Cannon five shillings
British as legacy.
ITEM - I leave and bequeath to my grandson John Cannon five shillings
British as legacy.
ITEM - I leave and bequeath to my granddaughter Ellinor Cannon five
shillings British as legacy.
ITEM - I leave and bequeath to Thomas Shimmin all what he is in my debt as
legacy.
ITEM - I leave and bequeath to my grandson John Kelly all what he is in my
debt as legacy.
ITEM - I leave and bequeath to my daughter in law Ellinor Killey two
shillings and six pence as legacy.
LASTLY - I nominate constitute and appoint my living daughter Catherine
Kelly widow, whole and sole executrix of all the rest of my goods rights
credits chattels and effects moveable and immovable of what kind or nature
soever excluding and debaring all other claiming friends at two shillings
and six pence legacy each. In testamony whereof I have hereunto ordered or
sett my mark to my name this the thirteenth day of October One Thousand and
Eight Hundred and Twenty One, Oct 13th 1821. Witnesses present Richard
Cowley and John Cowley. Henry Killey my X mark.
The executrix is sworn in court in form of law and hath given pledges for
the paying of debts and legacies namely William Kelly of Douglas and John
Cowley the witnesses.
By order of the Revd Vicar General Thomas Cubbon and Thos Stephen I have
charged William Cannon, Thomas Killip and Eleanor Killey of German debtors
and Richard Cowley and John Cowley of German witnesses to appear before
their reverends at a consistorial to be holden at Ramsey on Thursday next by
Eleven O Clock in the forenoon to answer the suit of Catharine Kelly this 25
