This indenture made the Thirteenth day of April one thousand eight hundred
and thirty five between Peter Fargher of Balla Whetstone in the parish of
Malew and John Fargher of Castletown baker of the one part and Thomas
Fargher of Derby Haven in the said parish of the other part witnesseth that
whereas Peter Fargher late of Derby Haven aforesaid deceased departed this
life intestate leaving the above named parties entitled to his property.
And whereas in order to avoid law, litigation or contention, in the
distribution of the said estate they  have come to the following
agreement in the premises that is to say the said Peter Fargher hereby
relinquishes and give up unto the said Thomas Fargher all his right title
and interest of in and unto the whole of the personal estate of the said
Peter Fargher including farming stock money and goods, and every other thing
under the denomination of personal property on being paid the sum
of Thirty Pounds British and the said John Fargher in like manner hereby
relinquishes and gives up the said Thomas Fargher all his right title and
interest in and unto the whole of the  personal estate of the said Peter
Fargher deceased including farming stock money and goods and every other
thing under the denomination of personal property on being paid the sum of
forty pounds British and the said Thomas Fargher hereby engages and binds
himself and his heirs and assigns to pay or cause to be paid
unto the said Peter Fargher and John Fargher the said several sums of thirty
pounds British and forty pounds British and also to pay off and
fully discharge all claims debts, dues, and demands, due and owing by the
estate of the said deceadent and to save and keep harmless the said
Peter Fargher and John Fargher for or on account of the same against all
persons whatever.  And for the true and faithful performance hereof and of
every covenant and agreement contained herein, the said Peter Fargher John
Fargher and Thomas Fargher bind and oblige themselves their heirs and
executors and administrators each to the other in and under  the penalty of
forfeiture of fifty pounds British each to be levied and paid according to
law.

At Castletown 14 April 1835.  The said Thomas Fargher one of the executing
parties to the foregoing paper writing or agreement
acknowledge the same to be his proper act and deed and Thomas Kewley one of
the subscribing witness thereto made oath on the Holy Evangelists that Peter
Fargher and John Fargher two of the executing parties signed and duly
executed the same in the deponents presence and also in the presence of John
Taylor the other subscribing witness to the same.
