Braddan
I Richard Murray of Mount Murray in the Isle of Man do leave this as my
last will and testament.
Item: After payment of my just debts and funeral expenses, I leave
devise and bequeath to my wife Margaret Murray and her heirs and
assigns my dwelling houses situated in Atholl Street Douglas one
being in my own occupation the other occupied by Miss Bridson and all
my furniture linen books pictures plate wines carriages grains hay
horses cattle farming stock and farming implements of every
description and also the sum of five hundred pounds.
I leave and bequeath to my daughter Elizabeth Ann Murray one hundred pounds.
I leave and bequeath to my daughter Emily Maria Bacon one hundred
pounds.
I leave and bequeath to John Thos Hutchin my chest of the rolls, one hundred
pounds.
I leave devise and bequeath all the remainder of my houses, lands,
property real and personal to John McHutchin Esq and Edward Moore
Gawne Esq and the survivor or survivors of them and the heirs of such
however In trust to pay out of my personal estate to my children
Elizabeth Anne Murray, Emily Maria Gawne and Henry Murray the sum of seven
thousand pounds, the money to which they are entitled under the settlement
made upon my marriage with their late mother and upon trust to pay to my
said son Henry Murray out of the rents, issues, and profits
of the said property the further sum of one hundred pounds yearly and every
year during the life time of my wife Margaret Murray the first payment to be
made twelve months after my death. And to pay to my
said daughters Elizabeth Anne Murray yearly and every year during her
natural life the further sum of thirty five pounds the first payment to be
made twelve months after my death, and these upon trust to suffer and permit
my said wife to occupy possess receive and enjoy the tenament
and the interest and profits of my estate real and personal during her
natural life and upon her death to pay to my daughter Margaret Tenison
Murray yearly and, every year, during her life the sum of two hundred
and twenty five pounds the first payment to be made six months after
the death of my said wife and if the said Margaret Tenison Murray shall
leave issue her surviving then upon trust to pay the sum of four thousand
five hundred pounds to each issue in such proportions and at such times as
the said Margaret Tenison Murray may by will or deed direct and in default
of such directions to an amongst all and every her sons and daughters and
daughters and the children of children of such sons and daughters in case
any of them should be dead leaving issue in equal
shares and proportions but so as if the children or children of the said
son or sons and daughter or daughters shall then happen be the dead shall be
entitled only to the share which his or her father and mother would
have been entitled to if living equally to be devised amongst such
children of them be more than one and if but one, the wholly to such only
child, and these upon trust to assign and convey the said goods and lands
hereditaments and personal estate to my said son Henry Murray and his heirs
executors administrators and assigns for ever but in case my said son shall
die without issue him surviving or in case such issue should survive him
and not live to attain the age of twenty one years then upon trust to assign
issue and convey the remainder of my personal estate to the said Margaret
Tenison Murray and to assign issue and convey to the said Margaret Tenison
Murray my estates and lands situate in the parish
of Santan, Braddan, Onchan, and Marown called Mount Murray,
Ballacostain, and Ballaquayle and to my grandson Richard Murray Gawne my
estate and lands situate in the parish of German called BallaLeece
and in case either of my said daughter, Margaret Tenison Murray, or grandson
Richard Murray Gawne shall depart this life without leaving
issue them surviving or in case such issue shall survive them and not
live to attain the age of twenty one years then upon trust to assigns
issue and convey the properties estate and affects to the survivor of them
the said Margaret Tenison Murray and Richard Murray Gawne and the heirs
executors and administrators of such survivor forever and in case the said
Henry Murray, Margaret Tenison Murray, and Richard Murray Gawne shall all
depart this life without leaving lawful issue or in case
they shall die leaving issue which issue shall die before he, she, or they
attain the age of twenty one years then upon trust to issue assign and
convey the said properties estate and effects to my grandson Edward Gawne
and his heirs and assigns forever.
Upon the event of my personal estate proving insufficient to pay the
sums of money and legacies hereby directed to be paid it is my will that
such deficiency shall be charged on the lands of BallaLeece and BallaCostain
equally hereby declaring that such deeds as may be
executed for that purpose by the said trustees or the survivors or survivor
of them or the heirs of such survivor to be ------ and affects.
I leave to my said son Thomas Murray to be possessed by him after the death
of my wife and not sooner the two places.

I hereby declare that the said bequests and legacies being ------ in
amount and value then the claim or demands which any of the said
legatees could have under my marriage settlement are in full
satisfaction and discharge of all claimers and demands under such
settlements.
I nominate constitute and appoint my wife Margaret Murray, John McHutchin,
and Edward Moore Esquire my executors to this my last will and testament in
testimony where of I have hereunto set my hand and affixed my seal this
twenty second day of November one thousand eight hundred and forty one.

At a Special Eccl Court holden at Douglas 5th Dec 1843. The executors and
executrix are sworn in court in form of law, and have given pledges
for the payment of debts and legacies namely James Holmes Esquire and Barton
Tenison Esquire both of the town of Douglas and parish of
Braddan.
