The humble petition of Jane Caine of the parish of Michael
Sheweth: That your petitioneršs mother Mrs Elizabeth Cain of Ballaskyr
in the parish of Michael departed this life in or about the month of
November last having previously published her last will and testament in
writing whereof she appoint your petitioner executrix.
That your petitioner is desirous to have the said will received into court
and probate granted
Wherefore your petitioner prays a hearing of this petition and that your
Worship may be pleased to grant probate of the will of the said Elizabeth
Cain unto your petitioner and she will pray.
Ordered that this petition do come on to be heard at a court to be holden at
KK Michael on Monday the 29th day of January instant whereof all proper
parties to have due notice.

I Elizabeth Caine of Ballaskyr of the parish of KK Michael being of sound
mind memory and understanding do make this my last will and testament
in form and manner following:
In the first place I commend my soul into the hands of God who gave it
and my body to Christian burial.
I leave and bequeath to my son John Caine of Stockport the sum of forty
pounds as his legacy.
I leave and bequeath to my son Thomas Caine the sum of twenty pounds
as his legacy.
I leave and bequeath to my son Philip Caine the sum of twenty pounds as his
legacy.
I leave and bequeath to my daughter Ann Shimmin wife of John Shimmin
the sum of ten pounds as her legacy.
I leave and bequeath to my daughter Elizabeth Metcalf wife of Edward Metcalf
the sum of fifty pounds as her legacy.
I leave to my granddaughter Jane Caine of Stockport the sum of ten pounds
as legacy.
I leave to my granddaughter Mary Caine of Stockport the sum of ten pounds as
her legacy.
I leave and bequeath to my granddaughter Elizabeth Shimmin the sum of ten
pounds as her legacy.
I leave and bequeath towards paying the debts on the Methodist Chapel at the
Barregarrow the sum of five pounds as a legacy.
I leave and bequeath to the Wesleyan Methodist Missionary cause the sum of
five pounds as a legacy.
I leave and bequeath to my grandson John Caine and heir at law of
Ballaskyr a feather bed and a bedding and furniture thereto belonging as his
legacy.
Lastly I nominate ordain constitute and appoint my daughter Jane Caine whole
and sole executrix of this my last will and testament of the remainder of
all my goods and effects whether moveable or immoveable
of what nature kind or denomination soever they be ratifying and confirming
this and no other to be my last will and testament this the
17th of March 1845.

Pledges John Caine and Thomas Caine
Edward Metcalf husband of Elizabeth Metcalf appeared at the Registry
this fifth day of June 1847 and acknowledge to have received and been paid
the legacy of fifty pounds bequeath to his said wife in and by the before
going will.
At the same time and place appeared Philip Caine another legatee who
received 20 pounds
also Thomas Caine received 20 pounds
John Shimmin of Ballabooie Kirk German husband of Ann Shimmin alias Caine a
legatee name in the last will and testament of Elizabeth Caine of Ballaskyr
received 10 pounds on 13 May 1848.
Elizabeth Shimmin received from grandmother 10 lbs on 31 Mar 1853.
John Caine received 40 lbs 4 Sep 1846
Mary Caine received from Jane Caine 10 pounds bequeathed to her by her
grandmother on 4 Sep 1846
