In the name of God Amen.
We Thomas Cowley of Ballaleece in the parish of Kirk German and
Isabella Cowley my wife, being of sound disposing mind, memory and
understanding, but considering the uncertainty of this mortal life do hereby
make this our last joint will and testament in manner and form following:
First we commit our souls to God and our bodies to a Christian burial.
Item: We leave devise and bequeath unto our children Thomas Cowley, Robert
Cowley, Elizabeth wife of Thomas Clarke, Margret wife of Richard Crellin and
Ann wife of John Teare all and singular a certain dwelling
house and premises thereunto attached situated near the Stone Bridge in the
town of Castletown to be equally divided between them.
Item: We leave devise and bequeath unto our said children Thomas Cowley,
Robert Cowley, Elizabeth wife of Thomas Clark, Margaret wife of Richard
Crellin, and Ann wife of John Teare all and singular the amount of a bond
and security granted by Thomas Carran joiner of the town of Peel and Mary
his wife for the sum of three hundred and ten pounds dated 15th day of
February in the year of 1838 charging and encumbering certain lands and
premises situate in the parish of Kirk Michael to be equally divided between
them. We also leave devise and bequeath unto our daughter Elizabeth
Margaret and Ann one half of our household furniture.
Item: We leave devise and bequeath unto our said children Thomas
Cowley, Elizabeth wife of Thomas Clarke, Margaret wife of Richard
Crellin, and Ann wife of John Teare the sum of two hundred pounds each but
this legacy and also the former legacies are to be subject and
amenable to the restrictions herein after mentioned.
Item: We leave devise and bequeath unto Elizabeth Teare of the town of
Douglas the interest money of one hundred pounds to be paid to her
during her natural life by our executor herein after named and upon her
death the said sum of one hundred pounds to be equally divided between our
grandchildren.
And whereas our children the said Thomas Cowley, Margaret the wife of
Richard Crellin, and Ann the wife of John Teare are at present
embarrassed in their circumstance and in pecuniary difficulties. It is
therefore our further will and intention and we do further order and
direct our executor herein after named and do hereby invest him with ample
full power and authority to receive and be in full possession and enjoyment
of the legacies therein before bequeathed so far and in
respect to the legatees Thomas Cowley, Margaret the wife of Richard Crellin
and Ann the wife of John Teare in trust nevertheless that our executor shall
and will from time to time advance and pay over to them
the said Thomas Cowley, Margaret the wife of Richard Crellin, and Ann
the wife of John Teare, such sum or sums of money as he may deem and think
expedient for their support and maintenance in life, or otherwise
at the discretion of him our executor to advance and pay over the whole
of the aforesaid legacies into the hands of the legatees but it is our
further will and intention and we do hereby provide and declare that the
said several legacies so bequeathed to our said children Thomas Cowley,
Margaret the wife of Richard Crellin, and Ann the wife of John Teare,
shall not be liable and subject to the payment of any debts or debts due and
owing by either of them now, or thereafter nor are the said Richard Crellin
and John Teare to have any control or management over the said legacies but
only the receipts of their wifes shall be a sufficient
liquidation and discharge executor herein after named and which said
legacies are to be paid in manner aforesaid twelve months after the
death of the survivor of us.
Item: We do thereby nominate constitute and appoint the survivor of us the
said Thomas Cowley and Isabella Cowley to be executor or executrix nominally
of this our last joint will and testament and we hereby do
further jointly and severally nominate constitute and appoint our son the
said Robert Cowley whole and sole executor and residuary legatee of this our
last joint will and testament - Hereby revoking and altering any
former will or wills by us or either of us before made
In testimony whereof we have hereunto subscribed our names this the tenth
day of May in the year of our Lord one thousand eight hundred and fifty
(1850)
