74 Maughold The humble petition of William Goldsmith of the parish of Maughold and Isabella his wife. Sheweth that Isabella Kermode of this parish of Maughold widow mother of your petitioner Isabella lately departed this life having previously published her last will and testament in writing whereof she appointed your petitioner Isabella and Daniel Joughin Jr as trustee for Catherine Cowley wife of William Cowley executors That the said Daniel Joughin Junr refuses to act in the said trust. Wherefore your petitioner prays a hearing of this petition and that your worship may be pleased to grant probate of the will of the said Isabella Kermode into your petitioner William Goldsmith alone or in conjunction with John Cringall of the parish of Bride son of the said Catharine Cowley who has consented to act in the administration of the estate of the said Isabella Kermode in Trust for the said Catharine Cowley in the place and stead of the said Daniel Joughin Junr or that your worship may be pleased to grant administration of the estate of the said Isabella Kermode with her said will annexed unto your petitioner William Goldsmith and the said John Cringall and your petrs will pray. Ordered that this petition do come on to be heard at an Eccl Court to be holden at Ramsey on Friday the 11th day of March instant whereof all proper parties and persons to have due notice. Given this 1st March 1853 T. A. Corlett. In the name of God Amen. I Isabella Kermode of the parish of Maughold widow relict of Richard Kermode deceased being advanced in years but of sound mind memory and understanding do make this my last will and testament in manner following. I commend my soul unto Almighty God and my body to decent Christian burial. And whereas by the will of the said Richard Kermode he bequeathed his right and title in and to certain lands and premises called Booilley Losht being part of the staff land in the parish of Maughold unto me the said Isabella Kermode which it is now my will and desire should descend unto my eldest son and heir at law Robert Kermode. I leave devise and bequeath unto my grandson William Kermode son of my son William Kermode deceased and his heirs and assigns the one half or moiety of the whole of the said lands called Booilley Losht with one half the buildings thereon erected subject however to the payment of four pounds to each of his sisters Ann Kermode and Isabella Kermode. I leave and bequeath unto my son Robert Kermode and my said grandson William Kermode the sum of ten pounds each as legacy and I hereby declare and my will further is that should either the said Robert or William Kermode bring forward any claim or demand against my estate for any thing except the bequests aforesaid that they or he so doing or disputing this my will shall forfeit all interest and right to the legacies herein before bequeathed to them or him. I leave and bequeath unto my nephew Daniel Joughin Junr of Chronkbane thirty pounds in trust for the sole and separate use of my daughter Catharine Cowley and for which her own receipt shall alone be a sufficient discharge to the said Daniel Joughin Junr. I leave and bequeath unto the Vicar and Wardens of Maughold six pounds to be laid out at interest for the benefit of the Poor of that parish. I leave and bequeath unto my daughter Isabella wife of William Goldsmith and Daniel Joughin Junr of Cronkbain as trustees for my daughter Catharine Cowley all and singular all my right title and interest in and to that and those dwelling house and premises situate in the town of Ramsey now in the occupation of Thomas Kneale Merchant. I leave and bequeath unto the said Daniel Joughin Junr as trustee for the said Catharine Cowley the amount due at foot of a Deed of Bond and Security passed to me by Wm Cowley and the said Catharine Cowley I leave and bequeath unto my daughter Isabella Goldsmith and Daniel Joughin Junr as trustee for that said Catharine Cowley all the rest residue and remainder of my goods and chattels rights and credits and do hereby nominate and appoint the executor of this my last will and testament. It being my express will and desire that the said Daniel Joughin Junr shall stand seized and possessed of the whole the property herein and hereby bequeathed to him as trustee for the said Catharine Cowley and appropriate the same to her own sole and separate use notwithstandings her coverature and that the same shall not be subject to the control of her husband nor liable to be attached for his debts or engagements hereby revoking all former will or wills by me at any time heretofore made and declaring this to be my last will and testament In witness whereof I have hereunto subscribe my name this twenty fifth day of March One thousand eight hundred and forty three. Isabella Kermode her X mark Witnessed by F. B. Clucas Charles E. Butt John Cringall and Wm Goldsmith sworn as executors Pledges John Kissack and Daniel Kermeen. Catharine Cowley received 30 lbs 25 March 1843. William Kermode a minor 10 lbs by his guardians Thomas Corteen and Robt Joughin.
