We Samuel Moore Looney and Christian Looney alias Quirk do make our
joint last will and testament in manner and form following.  Hereby
jointly revoking all other and former will or wills heretofore made and
executed, and declaring this only to be our joint last will and testament
in manner and form following:
We are jointly and severally entitled to a dwelling house and premises
situate in Hill Street Foxleth Park Liverpool and also to three cottages
in Silver Street Summers Court Liverpool held at present under certain
tenantry and which said premises having no ----- is not governed by the
law of England as to its proprietary the same being governed by the domicle
of the proprietors at the time of death and is not subject to the payment of
probate or legacy duty, as the Proprietors have not adopted a domicile in
England --------- the property so situate in England.  And whereas the said
Samuel Moore Looney and Christian Looney have one daughter Emma Elizabeth
Swan the wife of John Saunders Swan of Liverpool, Wine and Spirit broker,
but previous to the marriage of the
said John Saunders Swan it was deemed advisable to lease whatever property
in possession reversion remainder for proprietor any that would be  --- the
property of the issue of the said John Saunders Swan and
Emma Elizabeth Swan his wife had not provision been made to avoid any losses
that might have occasioned to the said John Saunders Swan in Business to the
prejudice or injury of his family and which provisions
are fully and effectually explained by Deed of Marriage Articles bearing
date the 20 day of September one thousand eight hundred and fifty and were
so made and executed for the guidance and government of all
parties interested as by the said Deed of Marriage Articles appear.  And
whereas the said Samuel Moore Looney and Christian Looney are desirous to
settle their affairs and to make a ---- disposition of their property
and with that interest do hereby reserve to themselves severally and
respectively for and during their several and respective natural lives and
the life of the survivor of them, the lands and premises of Ash Lodge in
Kirk Patrick Isle of Man subject to their sole dominions and control
during their natural lives and also the said houses and premises in Hill
Street Foxleth Park Liverpool and the said three cottages in Silver
Street Summers Court Liverpool aforesaid to their own several and occupation
use and behalf during their natural lives and the life of the survivor of
them.  And that upon the death of the said Samuel Moore Looney and Christian
Looney and  her survivors of them the said several and respective properties
shall revert to the issue of the said John Saunders Swan and Emma Elizabeth
Swan in manner and form as directed by the said Deed of Marriage Articles
dated the 20 day of September one thousand eight hundred and fifty and shall
be governed by a covenants
and conditions therein contained as fully and effective as the same could be
so governed and whereas the said Samuel Moore Looney and Christian Looney
have a reversionary right in certain lands and premises in Kirk Arbory Isle
of Man called Knock William Moore subject to the life estate therein of
Thomas Samuel Moore Looney upon whose death the said property of -----
reverts to and becomes the property of the said
Samuel Moore Looney and his representative or representatives.
It is our joint will and desire that the said last named property shall be
governed and disposed of in like manner as the property conveyed by the said
Deed of Marriage Articles herein before mentioned and the whole of the
before said property hereby conveyed shall be subject to the payment of our
several respective debts legacies and other expenses.  And the whole of the
house hold goods furniture and effects on the premises of Ash Lodge having
been conveyed by Thomas Harrison Moore Looney the
son (deceased) of the said Samuel Moore Looney and Christian Looney
unto and in favour of the said Samuel Moore Looney and Christian Looney
it is our will and desire that the said household goods furniture and
effects be granted and conveyed by the said Thomas Samuel Moore Looney shall
be subject to the same covenants conditions resale to us and restrictions as
govern the disposition of the whole of the property conveyed the twentieth
day of Sept 1840 and it is our further will and desire that the whole of the
stock crop and other effects of every description upon the lands and
premises of Ash Lodge of every kind and description not herein before
enumerated and described shall become the property of and belonging to the
executor or executrix of this will, as
the case maybe, to the sole and absolute use and behalf of such executor or
executrix and not subject to the dominion power or control of the said John
Saunders Swan or any person or persons on his behalf.  And it is hereby
further provided that in the event of the death of the said Samuel Moore
Looney before the said Christian Looney that the said Christian Looney shall
have the option and power vested in her of disposing of the whole of the
household goods furniture effects crop and stock on the premises of Ash
Lodge to such person or persons as she may think proper As witness our
subscription at Ash Lodge in the parish of Kirk Patrick in the Isle of Man
where no stamps or ----- papers is used or to be had,
this the twenty fifth day of July one thousand eight hundred and fifty
three.
