Be it known to all Men by these presents that we Samuel Thomson and Margaret
Heywood alias Thomson considering the extreme uncertainty of this life do
hereby make our last will and testament.
We therefore in consideration of the love and affection and confidence we
have in each other, will leave and bequeath the onr to the other the whole
of our real and personal estates. That is to say, the survivor or longest
liver is to inherit and become entitled to the whole of the Brewer on the
House side, warehouse, utensils, garden with its appertances also to Hewood
House, garden, and houses adjoining all as more particularly narrated in the
Bills of Sale from our brother Calcott Heywood to have and to hold and
received the issues and profits or dispose of the same for the survivors own
use and advantage as fully as we jointly could do or have done, also all our
other goods and chattels of every description whatsoever to the survivor,
save as hereafter excepted. That is to say if I Samuel Thomson should
first depart this life one pounds each to cash of my children and my wearing
apparel to my sons and if I Margaret Thomson should depart first one pound
to each of my children and my wearing apparel to my daughters and we
further will and desire that in the event of the survivor departing this
life without disposing otherwise of this property that we mutually will and
bequeath the whole of the property we may possess at our respective deaths
to be all divided between our said children share and share alike in just
and equal proportions taking into cvalulation the sums of monies that may
have been advanced to each of our children during our lifetime and I Samuel
Thomson of hereby nominate and appoint my wife Margaret as my sole executrix
and I the said Margt Thomson do in like manner nominate and appoint my said
husband Samuel Thomson as my sole executor and we mutually nominate and
appoint ( in the event of no future disposition being made by the survivor)
our two eldest daughters that may be in life at that time our trustees to
see this our will carried into effect and executrixes of the same. And it
is our further will and desire and pleasures and to prevent disputes and law
suits that in the event of any children or person disputing this deed or
will we leave and bequeath such child or children or person one shilling
each in full of all claim right and title he she or they may or might have.
