23 Braddan
In the name of God Amen. We John Quine and Margaret Quine alias Kelly xxxx
being man and wife of the Parish of Braddan Calling to mind the uncertainty
of human life the love and affection we have and do have unto each other have
therefore Amicably Consented agreed upon to make this our last will and
testament together in the manner following.
Firstly we John Quine and Margaret Quine alias Kelly my wife have mutually
agreed to commend our souls to God and our bodies to Christian burial after
this the discretion of the longest Survivor of us is
agreed to be the Executor in Executrix of our Estates.
Secondly We John Quine and Margaret Quine as aforesaid do appoint the longest
Survivor of us John Quine or Margaret Quine Whosoever it will please the
Almighty God to permit the same whole and sole Executor or Executrix of all
Goods Chattels Effects purchased land and all moveables or immoveables of
Whatsoever kind or denominations.
We leave and bequeath unto our Grandson Jonathan a small parcel of land called
and known by the name of Battery hill being part of the Quarterland of
Ballawillin situated in the parish of Braddan and bounded in the East by the
rent of John Quine the Lands of the late Joseph Hampton in the south And Lands
of William Clucas in the west and north with all the Houses and Offices erected
upon the same together with all easements priviledges and appertenances to
the same belonging or in any wise appertaining from the longest Survivor of
us John Quine or Margaret Quine aforesaid.
But if in case he our Grandson Jonathan Quine will have no lawful Issues of
his body that the said parcel of Land is hereinbefore Mentioned is to return
back undiminished and unencumbered unto our next of kin by right of inheritance
without any failure whatsoever Further he the said Jonathan Quine is at liberty
to mortgage sell or dispose of the same any way soever, But provided he hath
Lawful Issue it is to descent to them as Heirship from the dominion or Controle
any person or persons whatsoever. Except that he the said Jonathan Quine his
heirs and Assigns do pay his Mother Anne Quine alias Cowley the sum of four
pounds yearly and every year in account of the above said Land and premises
Commencing when he or his heirs or assigns will be in possession of the above
said property during her life time and as long as the said Anne Quine alias
Cowley Continues in her husbands name.
Item
We Leave and Bequeath unto our daughter Margaret Quine (now Margaret Jelly by
marriage) a parcel of land with the dwelling house thereon erected called and
known by the name of Cureagh Philip part of the Quarterland of Ballagarrey in
the parish of Braddan adjoining the Lands of John Quine in the East, the Lands
of Robert Quiggin in the south. The High road in the West and the Lands of
John Wade Cowin in the north. And if in case she the said Margaret Quine
otherwise Jelly shall or will have no Lawful Issue that then the said parcel
of Land after her decease shall return back unencumbered in way of Inheritance
to the next of kin.
Item
We leave and bequeath unto any person or persons that will claim a right to
this our last will and testament the sum of one Shilling each as legacy.
Lastly We John Quine and Margaret Quine aforesaid do select Nominate appoint
Constitute and Ordain the longest liver of us John Quine or Margaret Quine
Whomsoever it will please God to be so whole and sole Executor or Executrix of
this our last will and testament Agreeing upon that on legacy herein left and
bequeathed is not to take effect until the death of the last Survivor of us
And this we declare to be our joint will and testament revoking and
disannulling all other wills and Settlements if the like will be found And if
so be that and Settlement is found before the date of this our joint will
and testament it will be Null and Void.

At a Chapter Court held in Douglas on the 9th day of May 1856.
Philip Killey and George Moore the subscribing witnesses to the foregoing paper
writing purporting to be the Will of John Quine deceased having made Oath upon
the Holy Evangelists that said John Quine the Testator when of sound and disposing
mind memory and understanding duly signed and executed the same as and for his
last Will and Testament in their presence – Margaret Quine the survivor and
Executrix in said Will named is therefore sworn well and truly to fulfil and
execute the same according to Law – to pay all the just Debts, Legacies and
Funeral expenses of said Testator so far forth as the Goods and Effects will
extend and the law bind her And also to return to the Archdeacon’s Registry a
full true and perfect Inventory of said Estate and Effects with an accurate
account of her Acts and proceedings in the promises which thereunto lawfully
required And to these ends she hath given pledges namely Thomas Jelly and
George Moore who have entered into and executed the usual Bond in presence
of the Court. –

WHEREAS the Ecclesiastical Court of this Diocese have this day granted Probate
of the last Will and Testament of John Quine
deceased to Margaret Quine
AND WHEREAS Thomas Jelly of Baldwin
in the Parish of Braddan and George Moore
of Mount Rule in the Parish of Braddan have agreed
to become pledges for the said Margaret Quine for the due administration
of the said Estate according to law.
Therefore know all men by these Present, that we, the said Thomas Jelly
and George Moore hereby bind and oblige
ourselves and our Executors and Administrators, as pledges for the said Margaret Quine
for the due and faithful administration of the goods
and effects of the said deceased according to law. And in her default we bind ourselves and our Executors
and Administrators to be answerable to all parties interested in the said Estate, or the Administration thereof.
Witness our subscriptions this 9th day of May 1856.
