The humble petition of Ceasar Caine of the parish of Jurby. Sheweth that
David Caine your petitioner's father departed this life in the month of
June last having made and published his will in writing whereof he
appointed your petitioner executor.
That your petitioner now finds it necessary that the said will should be
received in court for probate.
Your petitioner therefore prays a hearing hereof and that your worship maybe
pleased to grant probate on the said will and that your petitioner
be sworn to execute the same according to law.
And your petitioner shall pray.
Ordered that this petition do come on to be heard at a court to be holden at
Ramsey on Friday the 1st of February whereof all proper parties are
to have due notice.

I David Caine of Ballacaine in the parish of Jurby calling to mind the
uncertainty of human life do make publish and declare this my last will
and testament hereby revoking all and every will or wills by me
previously made.
First I commend my soul to God and my body to Christian burial.
I give leave and bequeath to my son Caesar David Caine in Trust for my
two grandsons John Caesar Morrison and William Morrison such sum of money
out of my personal estate as will at the common rate of interest payable in
the island raise an annuity as yearly payment of five pounds sterling each
for and during the term of their natural life to be paid to them in such way
and manner and at such time as to him my said son Caesar David Caine shall
seem proper and after the death of said grandsons such sum reserved for the
payment of said annuity to fall into the residue of my estate.
I give leave and bequeath to my son Caesar David Caine all my goods,
cash, notes, bonds, credits, chattels, and effects of whatever nature
description or denomination and I nominate constitute and appoint my
said son Caesar David Caine whole and sole executor of this my last will
and testament. In witness whereof I subscribed my name hereto this eighth
day of June one thousand eight hundred and sixty.

Edward Creer
At an Ecclesiastical Court held in Ramsey the 1st of February 1861. John
Corlett one of the subscribing witnesses to the foregoing paper writing
purporting to be the last will and testament of David Cain the testator
having made oath upon the Holy Evangelists that the testator when of sound
mind duly signed and executed the same as and for his last will
and testament in deponents presence and in presence of Edward Creer the
other subscribing witness thereto Caesar David Caine the executor
therein named is therefore sworn well and truly to fulfil and execute the
said will according to law to pay all just debts legacies and funeral
expenses of the testator so far forth as his goods will extend and the
law bind him and to return a true and faithful inventory of the same with an
accurate account of his acts and proceedings in the premises, to the
Episcopal Registry when thereunto lawfully required and to these ends
he that given pledges namely John Corlett of Berrag in the parish of
Jurby and William Morrison of Ballaworey in the said parish who have entered
into and executed the usual bond in presence of the court.

Whereas David Caine late of Ballacaine in the parish of Jurby gentleman
did in and by his last will and testament bearing date the 8th day of June
1860 give and bequeath unto his grandson John Caesar Morrison an
annuity or yearly sum of 5 pounds to be paid to him by his son Caesar David
Caine whom he appointed executor of his said will and who duly proved the
same shortly after the decease of the said David Caine. And whereas the
said John Caesar Morrison the annuitant some time since departed this life
having first duly made and published his last will and testament in writing
whereof he appointed Eliza his wife executrix who
duly proved the same and whereas the said Eliza Morrison hath since
intermarried with John Lancaster of the town of Liverpool, Licensed
Victualler.
Know all Men therefor by these presents that we the said John Lancaster and
Eliza Lancaster (late Morrison) do own and acknowledge to have had and
received of the said Caesar David Caine as aforesaid the said annuity of
five pounds and all arrears thereof together with all costs chares and
expenses attending the same so bequeathed to the said John Caesar Morrison
as aforesaid. And we the said John Lancaster and Eliza
Lancaster (late Morrison) do hereby acquit release and discharge the
said Caesar David Caine his executors and administrators of and from
the same. And we do therefore hereby request that the said annuity of five
pounds so bequeathed to the said John Caesar Morrison as aforesaid
in and by the said will of the said David Caine as aforesaid may be and
stand cancelled upon record as witness our subscription this Twenty
Third day of March 1867.
