This is the last will and testament of me William Caine formerly of the
Voaney in the parish of German, but at present of KK Michael Street in
the town of Peel, made this twenty fifth day of June one thousand eight
hundred and sixty three.
I direct all my debts and funeral and testamentary expenses to be paid by my
executrix hereinafter named.
I leave and bequeath to my brother Cæsar Caine the sum of eighty three
pounds as a legacy.
I leave and bequeath to my sister Ellen Kelly wife of William Kelly the
sum of twenty six pounds and ten shillings as a legacy.
I leave and bequeath to my mother Eleanor Caine my share of the Fishing
Jugger "Ruby" of Peel together with the whole of my fishing nets and I
hereby constitute and appoint her the said Eleanor Caine whole and sole
executrix of this my will and residuary legatee of my estate property
and effects of what kind or nature soever.
In witness whereof I have hereunto subscribed my name this the date before
written.

Signed declared and published by the testator as and for his last will and
testament in our presence who at his request in his presence and in presence
of each other have hereunto subscribed our names as witnesses. (the words
"wife of William Kelly" being first interlined over the 13th
line of this 1st page)

At a Chapter Court held in Peel on the 23 day of October 1863
Jonathan Nelson Cregeen of the town of Peel -  surgeon one of the
subscribing witnesses to the foregoing paper writing purported to be the
last will and testament of William Caine the testator having made oath
on the Holy Evangelists that the testator when of sound mind memory
and understanding duly executed the same as and for his last will and
testament (the same having been previously read over to the testator) in his
presence and with presence of William E. Stevenson Moore the other
subscribing witness thereunto Eleanor Caine the executrix named in the said
will of the testator is therefore sworn well and truly  to fulfil and
execute the said will according to law and pay all just debts and
legacies and funeral expenses of the testator  so far forth as the goods and
effects of the testator will extend and the law bind her and to return
a full true and perfect inventory of the same with an accurate account of
her acts and proceedings at the premises to the Episcopal Registry of the
diocese when thereunto lawfully  required and to these ends she hath
given pledges namely Thomas Kermode of the town of Peel in the parish
of German and William Meyreck of Peel aforesaid who have entered into and
executed the usual bond in the presence of the court.

Proof having been given to me of the identity of the within named William
Kelly husband of Ellen Kelly in the said will named as one of the legatees
and the said William Kelly having appeared before me and acknowledged that
he had received and been paid the sum of twenty six pounds and ten shilling
from Eleanor Cain executrix of the within named William Cain
the same being the sum of the legacy left unto Ellen Kelly in the said
will -  the payment of the said legacy is therefore cancelled upon record.

William Kelly the part to the foregoing receipt acknowledged the same
to be his proper act and deed.
BEFORE ME   - JOHN HARRISON
