I Ann Cubbon of Ballaquale in the parish of Malew widow of the late
Henry Cubbon deceased being of sound disposing mind memory and understanding
do make my last will and testament in manner following: I give devise and
bequeath to my son Robert Cubbon all my rights, title, property, and
interest whether in my own right or under the will of my
late husband Henry Cubbon deceased, in and unto certain lands both
quarterland and intack called and commonly known by the name of
Ronague or some such name situated and being in the tern of Ronague in the
parish of Arbory  To have and To Hold unto him and his heirs and assigns
forever with all ways, watercourses, easements and
herditaments to the same belonging or appertaining  He paying there out
to my son William Cubbon the sum of one hundred pounds mentioned and
directed to be paid to him in by the will of the said Henry Cubbon
deceased but without interest.
I leave and bequeath to my daughter Ann wife of John Cowley the sum of
ninety pounds, a feather bed, and suit of bed clothes.
I leave and bequeath to my son Richard the sum of eighty pounds
I leave and bequeath to my daughter Eliza wife of Edward Collister the
sum of one hundred and twenty pounds
I leave and bequeath to my daughter Margaret wife of John Corlett the
sum  of one hundred pounds.
I leave to my son William the sum of ten pounds.
The foregoing legacies not to be paid until the expiration of twelve
months after my decease and not to bear interest until the expiration of
this said twelve months after my decease.
The foregoing legacies to be paid to my said sons Richard and William
and to my daughters Ann, Eliza, and Margaret in addition to the legacies
bequeath to them respectively in and by the will of their father the said
Henry Cubbon deceased but if they or either of them can and will demand
interest from my executor out of the said legacies so bequeathed to
them by the said Henry Cubbon then and in that case the legacies bequeathed
to them and each of them by me in this my said will shall be taken to be in
full of such interest if they can and will claim and
summons the  same.
I leave and bequeath to Ann Jane daughter  of my son Richard Cubbon the sum
of thirty pounds to be paid to her on attaining the age of twenty one years
but without interest.
I leave and bequeath to my grandson William Collister the sum of fifty
pounds to be paid to him on his attaining the age of twenty one years but
without interest.  I also leave him my black oak chest.  In case my said
grandchildren Ann Jane Cubbon and William Collister or either of them
shall die without attaining the said age of twenty one years then and in
that case the legacy or legacies bequeathed to them shall fall and
descend to each  of their fathers and mothers respectively.
I leave and to my brother Philip Quirk the sum of twenty pounds.
I leave to my niece Ellinor Christian widow three pounds and all my
wearing apparel - those two last mentioned legacies of twenty pounds
and three pounds not to be paid until twelve months after my decease
and not to bear interest before the expiration of the said twelve
calendar months after my decease.
I leave the Vicar of Malew for the time being the sum of two pounds for the
poor or the parish.
I leave devise and bequeath to my son Thomas Cubbon all my right, title, and
interest in and unto those lands houses and premises situate in the said
parish of Malew called Ballaquale and Phildsaw and at present in
the holding of myself and my son Robert To have and to Hold unto him the
said Thomas Cubbon with all ways, watercourses, easements ,heriditaments and
appurtenances unto the same belonging or
appertaining in consideration whereof he is to pay to my daughters Eliza
wife of Edward Collister and Margaret wife of John Corlett the
respective sums of two hundred pounds each as directing to be paid thereout
in and  by the will of my said husband Henry Cubbon deceased.  I also leave
him the said Thomas Cubbon five pounds as legacy and which
is to be in full discharge and satisfaction all claims which he can in
anywise have upon direction that if any of my children before named
shall attempt in anywise to enter law proceedings against my executor
co executors in any way whatever to interfer with this my said will or
to defect the intentions  thereof or prevent the same being carried into
effect such party or parties shall forfeit all rights and claims
thereunder in anywise whatsoever said and except to a sum of five shillings
in lieu of the bequeath made to him or her or them in this my
said will
I leave all the rest of my goods, chattels, moneys, property and effects
of every kind and description movable or immovable to my said son
Robert Cubbon and I do hereby appoint him whole and soel executor of
this my last will and testament according to law.  In witness whereof I
have hereunto caused my mark to be sett to my name this tenth day of
September one thousand eight hundred and sixty.
