Malew 1867 19 The humble petition of Robert Love and Hannah Love otherwise Leyland his wife. Sheweth: That Daniel Leyland late of Castletown deceased father of your petitioner Hannah Love did sometime ago depart this life having first duly made and executed his last will and testament bearing date the 16th day of August 1862. That the said Daniel Leyland did in and by his said will nominate and appoint your petitioner the said Hannah Love and his daughter Catherine Jabet wife of Thomas (Richard) Jabet of Birmingham executrixes of his said will. That the said Catharine Jabet and her said husband Thomas(Richard) Jabet reside out of this jurisdiction of the Eccl Court of this Isle and have renounced the said will and declined to take upon themselves the burden of the execution of the said will. That your petitioners are desirous that probate of the said will be granted. Wherefore your petitioners pray a hearing of this petition and that your Worship may be pleased to grant probate of the said will and that your petrs may be duly sworn to execute the same according to law and your petitioners will pray. John Gell for the petrs I Daniel Leland of Castletown being of sound disposing mind memory and understanding do make my last will and testament in manner following. I leave to my daughters Hannah wife of Robert Love and Catharine widow of the late Richard Jabet deceased all my houses and real estate of every kind situate in Castletown aforesaid such consisting of a dwelling house and premises at or near Parliament Square a dwelling house garden and premises in Stope Street a dwelling house and premises in Mill Street on the east side adjoining the premises of the late William Cain Publican deceased two dwelling houses and premises in Mill Street aforesaid on the west side of the said street and a dwelling house and premises in Queen Hithe Street to have and to hold unto them and their heirs and assigns forever the surplus rents of the said premises after payment of the interest of the mortgage in mortgages chargeable thereon and the necessary repairs of the premises to be applied towards the support and maintenance of my daughter Elizabeth wife of John Dakin and her children until the youngest child shall have attained the age of twelve years if she and they should not before that time be otherwise provided for by the said John Dakin or by their own exertions when such surplus rents shall not be any longer liable for applying in such maintenance but shall belong to solely to the said Hannah Love and Catharine Jabet equally between them with the said houses and premises share and share alike and to their heirs and assigns forever and which rents shall not be at any time liable to the debts and demands of the said John Dakin but shall be for the exclusive use of the said Elizabeth Dakin and her children as aforesaid to be paid and applying by the said Hannah Love and Catharine Jabet as they may see best for that purpose. All my other children being in comfortable circumstances and not requiring any part of my real or personal estates I make no provision for them but which is necessary in law to carry this my will into effect. I leave the said Hannah Love and Catherine Jabet all my household goods and effects and personal estate of every kinds they to whom the said Elizabeth Dakin the use of such part of the house as they may think proper during the period aforesaid. Lastly I appoint my said daughters Hannah Love and Catherine Jabet whole and sole joint executrixes of this my will according to law - Revoking all wills by me heretofore made.
