In the name of God Amen I Ann Killip of the Voaney in the Parish of German,
widow of Thomas Killip deceased, being of sound disposing mind memory and
understanding, but considering the uncertainty of this mortal life - Do
hereby make this my last will and testament in manner and form following:
First I commit my soul to Almighty God and my body to be buried by my
executor herein after named.
Item. I leave devise and bequeath to my daughter Maria Killey wife of Edward
Killey of the parish of Patrick the sum of 100 pounds sterling as legacy to
be paid to her in yearly payments of five pounds at Christmas in each year
until the said legacy of 100 pounds be liquidated and paid. And it is my
further will and I do hereby declare that her husband the said Edward Killey
is to have no control over the said legacy nor is the same to be subject or
liable for any debt or debts my heir contracted or which he may hereafter
contract, but that only the receipts of the said Maria Killey shall be taken
and held as legal discharge for the payments of the said respective sums of
five pounds as the yearly income due after my decease, the amount of said
legacy to be applied for the sole use and benefit of my said daughter Maria
Killey and in the event of my said daughter Maria Killey departing this life
before she receives full payments of this amount of the said legacy of 100
pounds my further will is and I do hereby direct that the balance or
remaining sum unpaid, shall be equally paid and divided between the children
of my daughter the said Maria Killey.
Item: I leave devise and bequeath one shilling to the following:
Jane wife of John Halsall of German.
James Killip.
William Killip.
ITEM: I leave devise and bequeath to my daughter Mary Killip who lives with
me, and who is of weak intellect the yearly sum of three pounds sterling to
be applied towards her support and maintenance, during her natural life,
such payments to be made out of the money I may be entitled to at the time
of my death, and in the event of my said daughter Mary Killip departing this
life before the whole of the said money be expended and paid to her my
further will is, and I do hereby direct that the balance or remaining sum
unpaid shall be equally paid and divided between my grandchildren daughters
of William Killip and daughter of daughter the said Maria Killey the wife of
Edward Killey to be paid to them when they respectively become of age.
ITEM: I leave devise and bequeath to my granddaughters Jane Killip and
Eleanor Margaret Killip daughter of my son William Killip the sum of one
pound each as legacy.
LASTLY. I do hereby nominate constitute and appoint my said son William
Killip executor in trust of this my last will and testament for the sole
purpose and intent of carrying the same into effect, hereby revoking and
altering any former will or wills by me before made. In testimony whereof I
have hereunto subscribed my name this twenty third day of April in the year
of our Lord one thousand eight hundred and sixty three 1863.

Signed published and declared by the testatrix as and for her last will and
testament who at her request and in presence of each other have put our
names hereto as witnesses:

At an Ecclesiastical Court held in Peel on the 16th day of May 1867. William
Clague one of the subscribing witness to the foregoing paper writing
purporting to be the last will and testament of Ann Killip of the Voaney in
the parish of German widow deceased having made oath upon the Holy
Evangelists that the said Ann Killip the testatrix whereof
sound and disposing mind memory and understanding duly signed and executed
the same as and for her last will and testament (save and except the words
"Ten" written on erasures in the eleventh and thirteen line of will (which
appear to have been made subsequent to such signing and execution as
aforesaid) in his presence and in presence of John Cottier the other
subscribing witness thereto. William Killip the executor in said will named
is therefore sworn well and truly to fulfil and execute said will according
to law by paying the just debts and funeral expenses of the deceased and the
legacies contained in her will so far forth as her goods and effects will
thereto extend and the law bind him and to return into the Episcopal
Registry of this Diocese a full true and perfect inventory of all and
singular the said estate and effects with an accurate account of his acts
and proceedings in the premises when thereunto lawfully required and to
these ends he hath given pledges namely John Killey of Lambfield beg and
James Killip of BallaKaighin both in the parish of German who have entered
into and executed the usual bond in the presence of the court. Probatum est

At a Special Consistorial Court held at Peel on the 12th day of February
1869.
Pursuant to the judgement and decree of this court of equal date herewith
made in a cause wherein William Killip was petitioner and James Killip was
defendant whereby the alterations on the 11th and 13th lines of the first
page and on the 2nd line of the second page of the foregoing last will and
testament of Ann Killip of the Voaney in the parish of German widow deceased
are decreed satisfactorily accounted for. The foregoing probate dated the
16th day of May 1867 of the said will granted to William Killip the executor
in trust therein names with the addition of the word "ten" in the 11th and
13th lines of the 1st page and in the 2nd lines of the second page of the
such will is hereby confirmed and probate to issue when called for.

Know all men by these presents Maria Killey wife of Edward Killey of the
parish of Patrick one of the legatees doth hereby own and acknowledge to
have received from William Killip the executor of the within named Ann
Killip the sum of five pounds the one half of a certain pecuniary legacy
left to her by the foregoing will of the said Ann Killip and she doth will
over and direct that the said pecuniary legacy may be and stand cancelled on
record to the extent of five pounds as witness her name this 25 September

made oath on the Holy Evangelists that Maria Killey the party thereto duly
signed and executed the same in his presence.
