Malew 1869 No 48 I William Shimmin of the Ballabeg in the parish of Malew being of sound disposing mind memory and understanding do make my last will and testament in manner following. I commit my soul to Almighty God and my body to Christian burial. I leave and bequeath to my daughter Esther wife of John Gawne and to my sons William and Edward her half brothers one pound sterling each as a legacy. I leave and bequeath to my five daughters namely Ellinor, Jane Maria, Isabella Mary, Eliza and Emily Louisa full sisters of the said William and Edward and half sisters of the said Esther Gawne the sum of three hundred pounds sterling each as legacy to be payable to them respectively upon attaining the age of twenty one years or upon being married (the same to be for their own exclusive use and benefit and not to be liable or subject to the control or liabilities of any husband that they or either of them may have, their receipt alone notwithstanding coverature to be sufficient in law for the said legacies and all matters and transactions connected with such legacies) but if my wife Mary Shimmin shall survive me and intermarry again or die before my said five daughters her children before named shall respectively attain the said age of twenty one years or be married then and in that case the said legacie shall be payable at such intermarriage or death to such of the said children as shall then have attained the said age of twenty one years or be married aforesaid and the whole of the said legacies shall bear interest at five per centnum per annum from the day of such intermarriage or death of the said Mary Shimmin But so long as any of the said children shall continue to live with their mother the said Mary Shimmin the legacy or legacies of the child or children so continuing to live with her shall not be payable nor bear interest. And I do direct that if any of my said five daughters Ellinor, Jane Maria, Isablla Mary, Eliza and Emily Louisa shall die before attaining the age of twenty one years or without being married that the legacy bequeathed to the child or children so dying shall be divided equally amongst the surviving sisters of the full blood children of my present marriage with the said Mary Shimmin I leave and bequeath to my said wife Mary Shimmin a sum of seven hundred pounds which sum John Duggan and James Kewley trustees named in a certain indenture or Deed of Sale in trust of my lands called Thalloo ne glooie - Grenaby - Stockfield, Ballaby Mill called Grenaby Mill and Island called Kitterland granted to them by me the said William Shimmin and Mary my said wife and bearing equal date with this my will, are to raise by way of mortgage or security upon the estate or parcels of land with the houses and buildings thereon, Mill and Island called Kitterland, all in the said Deed more particularly described to be by her the said Mary Shimmin disposed of at her decease to and amongst allh er children before named males and females or such of them as she may think proper and in such way and manner as she may see fit to direct. I leave devise and bequeath to my said wife Mary Shimmin all that parcel of land situate in the said parish of Malew called Thalloo ne Glooie purchased by me some time since from by son in law John Gawne of the Rowany and Esther his wife and which is reserved out of the said sale in trust to the said John Duggan and James Kewley to have and to hold unto her and her heirs and assigns forever with all easements hereditaments and appurtenances to the same belonging or appertaining . I leave the said Mary Shimmin all the rest of my property moneys goods chattels and effects of every kind and description whatsoever moveable and immoveable and do hereby appoint her executrix of this my last will and testament according to law. Hereby revoking and making null and void all wills by me heretofore made and declaring this only to be my last will and testament and debarring all other claimants if any there can be with six pence legacy.
