The humble petition of Julia Boyd of the town of Castletown, spinster.
Sheweth:  That Thomas Boyd late of Castletown, Blacksmith, and Ann
Boyd his wife both now deceased did on the 2nd day of Feb 1874 execute and
publish their joint last will and testament bearing date on the said 2 Feb
1874 whereby they appointed the survivor of them executor or executrix (as
the case might be) and they directed that after the death of such survivor
your petitioner should be executrix of such will.
That the said Thomas Boyd died on the 27th Nov 1874 leaving his said
wife Ann Boyd him surviving.  And the said Ann Boyd died on the 8th day
of  May 1875 without having proved the said will.
That it is necessary that the said joint will should now be proved.
That the only next of kin of the said testator are their three sons and
three daughters namely Thomas Boyd, Robert Boyd and James Boyd, Ann wife of
William Thomson, Sarah Boyd and your petitioner.
Wherefore your petitioner humbly prays a hearing hereof and that
probate of the said joint will may be granted to your petitioner.  And
that your petitioner may have such other relief as is meet - And she will
pray.

Ordered that this petition do come on to be heard at an Eccl Court to be
held at Castle Rushen on Friday the 12 day of November 1875 at 11 o'clock in
the forenoon.  Whereof all proper parties and persons are to have due and
lawful notice.

This is the joint last will and testament of us Thomas Boyd of
Castletown Blacksmith and of Ann Boyd wife of the said Thomas Boyd we being
of sound mind memory and understanding at the making hereof hereby revoking
all wills by us or either of us heretofore made.
We leave devise and bequeath as follows:
1.  To our son Thomas Boyd that dwelling house and premises situated on the
Quay in Castletown aforesaid in which we now live together with the
old Smithy thereto adjoining including the whole the property bounded by the
said Quay - the street known as the Bank and Water Street.  To hold unto the
said Thomas Boyd the younger his heirs and assigns from and after the death
of the survivor of us absolutely subject however to the mortgage affecting
the same it being a condition of this devise that the said Thomas Boyd his
heirs and assigns shall pay to each of our
daughters Sarah and Julia the sum of fifty pounds which sum shall be a
charge and lien on the property devised to the said Thomas Boyd.
2.  To our son Robert Boyd his heirs and assigns that dwelling house and
premises situate in Malew Street in Castletown aforesaid now occupied
by John Cubbon as tenant and that dwelling house and premises situate in
such street and commonly known as the "Big Tree House" to hold from
and after the death of the survivor of us.  It being a condition of this
devise that the said Robert Boyd shall pay off and discharge two certain
mortgage affecting my property one for the sum of two hundred and fifty
pounds passed to Wm Caley of Douglas and the other for the sum of fifty
pounds passed to the offices of  the Rechabite Friendly Society and that he
shall pay to each of our said daughters Sarah and Julia the sum of
sixty pounds and it being hereby declared that such last mentioned sums
shall be a charge and lien on the property hereby devised to the said Robert
Boyd.
3.  To our son James Boyde the sum of five pounds.
4.  To our said daughter Sarah Boyd that dwelling house garden and premises
situate in Malew Street aforesaid in which we formerly lived
and which is now in the occupation of William Thomson as tenant to hold unto
her and her heirs and assigns from the death of the survivor of us
absolutely provided always and it is hereby declared that no right shall
be claimed or exercised in respect of the said property to the use or
enjoyment of the passages or polerope through another property leading to
Hope Street.
4. To our said daughter Julia Boyd those two dwelling houses yards and
premises situate in Hope Street in the said town now in the occupation
of Mrs Looney and  Mrs Cannell together with the passage or polerope
adjoining the same which passage shall be for the exclusive use of  the
said property and for no other purpose also that field or parcel of land
situated near Castletown aforesaid commonly called the
"Bog" and also that enclosure of ground used as a lumber yard situate
near the said Quay in Castletown aforesaid to hold unto the said Julia
Boyd her heirs and assigns absolutely from and after the death of the
survivor of us.  It being a condition of this devise that the said Julia
Boyd shall pay off and discharge a certain mortgage or Deed of Bond and
Security passed to the late Edward Moore Gawne Esquire now deceased
affecting my property.  Also that dwelling House, Back House, Yard ,and
premises together with the passage or polerope leading from the said
property to the Quay in Castletown aforesaid such property being situate
opposite to the said Old Smithy and separated there from by Water
Street aforesaid.  Also that Warehouse and premises adjoining the the
said house and now in the occupation of Mr William Gill as tenant to hold
unto our said Julia Boyd her heirs and assigns from the  death of the
survivor of us absolutely.
6.  To our daughter Ann wife of William Thomson five pounds.
7.  To our said daughters Sarah and Julia after the death of the survivor of
us the whole of our household furniture goods chattels and effects and
personal property to be equally divided between them share and share
alike.
8.  We leave devise and bequeath to the survivor of us the whole of our
property real and personal of every description but subject nevertheless
to the disposition thereof made by this our will to take effect after the
death of such survivor.
9.  Provided always and it is hereby declared that the mortgages by the
1st 2nd, and 3rd clauses hereof to be paid off shall be so paid off and
discharged within twelve calendar months from the death of the survivor
of us in so far as the sum shall affect property other than that devised
by such clauses respectively and provided also that the said sums
directed to be paid to our daughters Sarah and Julia by our sons Thomas and
Robert shall not be payable till the expiration of such twelve months but
that after such time such sums if not paid shall bear interest at the rate
of six per cent.
10.  We nominate and appoint the survivor of us executor or executrix as the
case may be of this our last will and testament and after the death
of the survivor of us then we will and direct that our said daughter Julia
Boyd shall be executrix thereof and we leave devise and bequeath to our said
daughter the rest and residue of our property real and personal.  In
testimony whereof we hereunto subscribed our names this second day of
February one thousand eight hundred and seventy four.
