The Humble Petition of Robert Evans Creer

Sheweth
That petitioner’s mother Esther
Creer of the town of Ramsey widow of
William Creer late of the said town on
or about the 15th November instant
departed this life having first
duly made and published
her last Will and Testament
in writing whereof she appointed
petitioner sole Executor.
The petitioner is desirous
of proving the said will and obtaining
probate thereof in due form.
Wherefore petitioner prays
a hearing hereof and that
your Worship may be pleased
to receive the said Will and
grant probate thereof to petitioner
or some other fit and proper 
person and herewith prays

Ordered that this petitioner
come on to be heard at an Ecclesiastical 
Court to be held at Ramsey on Friday
the 26th day of November 1875 at 11 o’clock
in the forenoon. Whereby all proper
parties and persons are to have due
and lawful notice

Whereas the Ecclesiastical Court of this Isle and Diocese of Sodor and Mann hath 
this day granted Probate of the
Will of Esther Creer
late of Ramsey in the Parish of Maughold, widow
deceased, to Robert Evans Creer the Executor

And Whereas, Edward Creer of Ramsey
in the Parish of Maughold and Robert Cleator
of Ramsey in the Parish of Maughold
have agreed to become Pledges for the due and faithful
Administration of the said Estate by the said Robert Evans Creer 
according to Law.
Now, Know all Men by these Presents, that we the said Edward Creer
and Robert Cleator hereby bind and 
oblige ourselves, jointly and severally, and our Heirs, Executors, and Administrators, firmly by 
these presents, as pledges for the said Robert Evans Creer
that he shall well and truly administer, all and singular, the Personal Estate and Effects of the said deceased, according to Law.  And in his default we bind ourselves, and each of us, our Heirs, Executors, and Administrators, to be answerable and responsible for the whole to the said Court, and to all
parties interested in the said Estate and Effects, or the administration thereof, in the place and stead of the said Robert Evans Creer

Witness our Subscriptions, this 26th day of November in the Year of our Lord
One Thousand Eight Hundred and seventy five

The foregoing Bond and Obligation		}
was duly signed and delivered, and		}
Also acknowledged by the executing		}	
parties to be their proper Act and		}

This is the last Will and
Testament of me Esther Creer
of the town of Ramsey widow
of William Creer late of the said town
deceased, which I make publish
and declare this the thirteenth
day of October one thousand eight
hundred and seventy three.
I leave and bequeath to my 
son Robert Evans Creer all
and Singular that and those
Houses Yards Lands and premises
situate in Queen Street in the 
said town of Ramsey now occupied 
by John Corlett baker as tenant and
including those premises purchased 
by me from Thomas Cubbon by deed
dated the twenty fourth day of February
one thousand eight hundred and
seventy one. Also All and Singular
that Warehouse situate near the sea-
shore in the said town of Ramsey
formerly a Wesleyan Methodist Preaching
House together with the yard, outbuilding 
and premises thereunto belonging. To 
hold the same unto him his heirs and 
Assigns from the day of my decease
absolutely for ever.
I leave devise and bequeath 
to my son William Creer All and
Singular that and those dwelling
house and premises situate near
the old cross in the said town 
of Ramsey now in the occupation
of William Cain as tenant. Also
All and Singular that and those
dwelling house and premises situate
near the Marketplace in the said 
town of Ramsey now occupied by 
Sarah Linton as tenant. To hold
the same with all the rights and
appurtenances thereunto belonging
unto him the said William Creer
his Heirs and Assigns from the
day of my decease absolutely for
ever. And I further leave and 
bequeath unto my said son William
Creer the sum of fifty pounds
as legacy together with my iron 
bedstead with green curtains A
feather bed bolster and three pillows
and bedding a chest of drawers in
my bedroom which were his fathers’
drawers a French timepiece looking-
glass and twenty one pictures in 
my room intending by this description
to bequeath and comprise the whole
of the furniture of my own bedroom.
I leave and bequeath the remains
of my household furniture to my said
sons Robert Evans Creer and William
Creer and to my two granddaughters
Frances Cleator and Edith Adeline 
Cleator daughters of my deceased 
daughter Esther share and share alike.
I leave and bequeath all the rest
remainder and residue of my of my goods
chattels and effects unto my said
son Robert Evans Creer and I
nominate constitute and appoint
him the said Robert Evans Creer
whole and sole executor of this
my last will and Testament
In witness thereof I have
hereunto subscribed my name
the day and date first before written

Signed published and
declared by the said Esther Creer
the Testatrix and for her last
will and testament in our presences
who at her request in her presence and
in presence of each other have hereunto
subscribed our names as witnesses
the word “bed” in the eighth line
on the third page having been
previously underlined and the words
“Walter Radcliffe” on the fifteenth line
on the second page having been previously
struck out and the words “Sarah
Linton” substituted therefore

At an Ecclesiastical court held at Ramsey
on the 26th day of November 1875
Frederick Saunderson one of the subscribing
witnesses to the execution of the foregoing
paper writing purporting to be the last Will
and Testament of Esther Creer late of the 
town of Ramsey widow deceased who
died on or about the 15th day of November
1875, having made Oath on the Holy
Evangelist that said testatrix Esther 
Creer when of sound and disposing mind
memory and understanding duly signed
and acknowledged the same as and for her last
Will and Testament in his presence and at the
same time in the presence of Thomas A Faragher
the other subscribing witness to such execution and
that they at the same time in the presence of
the said testatrix and of each other subscribed the 
same in attestation thereof – The erasure and 
interlineation on the second page and the interlineation
on the third page thereof,  having been made
previous to such execution as aforesaid.
Robert Evans Creer, a son of the deceased the
Executor in said Will named is therefore Sworn
well and truly to fulfil and execute said Will
and to administer All and Singular the personal
estate and effects of the said Deceased according 
to Law by paying the just Debts and Funeral
expenses of the said Deceased and the Legacies
contained in her will do far forth as her Estate
and Effects will thereto extend and the law
bind him And to return to the Episcopal Registry
of this Diocese of Sodor and Mann a full true
and perfect inventory of All and Singular 
the said Estate and Effects with an accurate
account of His Administration thereof
when thereunto lawfully required And to these
ends He hath given pledges. Namely Robert 
Cleator and Edward Creer both of the
town of Ramsey, in the parish of Maughold
who have entered into and executed the usual
Bond in the presence of the Court.

Know all men by these
presents that William Creer of
Jarrow-u-Tyne England doth hereby
own and acknowledge to have
received and to be fully paid
and satisfied by from the
hands of Robert Evans Creer
Executor of the Will of Esther Creer
of the town of Ramsey widow deceased
dated the thirteenth day of October
one thousand eight hundred and
seventy three and proved at an
Ecclesiastical Court holden at
Ramsey the twentyninth day of
November one thousand eight
hundred and seventy five the
full amount of a certain legacy
of fifty pounds together with certain
articles of bedroom furniture in and
by the said Will of the said Esther
Creer bequeathed to him the said 
William Creer and doth hereby 
release acquit and for ever discharge
the said Robert Evans Creer Executor
as aforesaid his executors and 
administrators from all claim and
demand in respect thereof and doth
direct the said legacy of fifty pounds
and of the specific articles
of furniture in the said will
contained to be and stand for
ever to be cancelled upon Record.
As witness his subscription this
Second day of October one thousand
eight hundred and seventy seven (1877)
