This is the last will and testament of me Thomas Joshua Graves of
Stanley Terrace in the town of Peel.
I leave to my wife Martha Graves all my personal estate of every
description.
I leave and devise to John James Karran of Thornton near Douglas all my
lands houses tenements and real estate of every description to hold to
him and his heirs and assigns in trust to suffer and permit my said wife
to possess and enjoy the same and the rents and profits thereof for and
during her lifetime and in her decease to convey the same to and amongst my
children then living and their heirs and assigns in equal shares. In case
any one or more of my children should die in my wife's lifetime
leaving issue surviving him or her then the issue to be entitled amongst
them to the share which share or their parent or parents would if living
have been entitled to.
If all my children die in the lifetime of my wife without issue then I
leave and direct the said trustee on her death to convey one half of my real
estate to my heirs at law and the other half to the heirs and assigns of my
said wife provided always that the interest hereby given in my
real estate to my said wife for her life shall be for her own maintenance
and not subject to the support maintenance and education of my children
whilst under age and provided always that my said wife shall have full power
to grant leases of any parts of my real estate for terms not exceeding
twenty years from the date of such leases at full rack rents. And further
that she shall also have full power and authority to grant
and sell any portions of my said real estate in fee simple to any persons
contracting with her for the same at such prices or on such proved rents as
she and the said trustee or any trustee acting under this will however
appointed may deem reasonable value for the same and I declare that the
receipt of my said wife for any money paid as considerate for such purchases
shall be an effectual discharge to the person paying the same and shall be
inclusive as against all persons interest in my estate. Any ground rent
made payable on any such sale to be made payable to the said trustee to be
held by him or the trustees on which the property sold
shall have been held. And with respect to moneys received by my said
wife as consideration money for any such sales I direct her to invest the
same on security in the name of the trustee of my will and the same
shall be subject to the said trusts on which the property sold shall be
subject by this my will provided also that it shall be in the owner of my
said wife with the concurrence of the trustee for the time being of this
will either out of monies received by such sales or out of monies to be
raised by mortgage or security of my said real estate or any part thereof to
make any advances they may think right and proper for or toward the
education advancement or from ---- in life of my children or any of them and
for such purpose I authorize my said wife with the inconvenience of the said
trustee to raise such moneys as they may think right and to
grant and --- ----- any portion of my said real estate and to secure the
lender then of with such provisos is and stipulating as they may consider
necessary to insert many ---- as mortgages granted by them. I direct the
amount so advanced for any of the said children to be reckoned against him
or her as part of his or her share of my real estate if alive at the death
of my wife or against his or her issue if deceased.
I appoint my said wife my executrix and revoke all other wills made by
me.
