Onchan 1877 No 2 This is the last will of me Eliza CREER of Clypses in the parish of Conchan. I leave to the daughter of my son John Creer the sum of twenty pounds to be paid on her attaining the age of twenty one years. I leave to each of his sons the sum of five pounds to be paid on their respectively attaining twenty one years of age. I leave and devise all the rest residue and remainder of my property real and personal to my son in law Robert Corlett and Richard Sherwood advocate on the one of them who may accept this trust and the survivor of them and the heirs executors administrators and assigns of such survivor upon trust nevertheless to convey the whole of the same to such person or persons and for such trusts and purposes and at such time or times and absolutely or otherwise as my daughter Anna now the wife of the said Robert Corlett of Douglas Grocer shall by any deed or instrument testamentary or otherwise duly executed by her notwithstanding coverture direct and appoint and in default of and in the meantime until such appointment and so far as any such appointment shall not extend in trust to suffer her to possess dispose of enjoy and receive the same and the rents issues and profits thereof for her sole use free from marital control and on her death in trust to convey the same to such portion thereof as shall not have been disposed of and received by her or as shall not be otherwise appointed or directed by her to and equally amongst such of her children as may be then living and the issue then living of such of her children as may have predeceased her such issue to take only the share which his her or their deceased parent or parents would if living have been entitled to and in case my said daughter should die without leaving any issue her surviving then in default of and subject to such appointment as aforesaid in trust to convey and assign the same to and amongst all the children of my said John Creer and their heirs executors administrators and assigns to prevent misunderstanding I declare that I have sometimes been called and have used the name of Elizabeth and sometimes Eliza. I appoint the said Robert Corlett and Richard Sherwood executors hereof and revoke all other wills made by me. I witness whereof I have hereunto subscribed my name this 25th day of April one thousand eight hundred and seventy four. I leave ten pounds to the trustees of the Douglas Hospital and ten pounds to the trustees of the House of Industry Douglas for the use of them established accounts. Eliza Creer Signed and published by the testatrix as and for her last will and testament in presence of us who at her request in her presence and in presence of each other have hereunto subscribed our names as witnesses. Richard Sherwood Wm L. Clarke At an Eccl Court held at Douglas on the 22nd day of February 1877. Richard Sherwood, Esquire, and William Levitt Clarke the subscribing witness to the execution of the foregoing paper writing purporting to be the last will and testament of Eliza Creer late of Clypse in the parish of Conchan widow deceased who died on or about the 23rd day of January 1877 having made oath on the Holy Evangelists that the said testatrix Eliza Creer when of sound and disposing mind memory and understanding duly signed and acknowledge the same as and for her last will and testament in their presence and that they at the same time in the presence of the said testatrix and of each other subscribed the same in attestation thereof. And Robert Corlett one of the executors therein named having predeceased the testatrix and Richard Sherwood the other executor therein also named having renounced the said executorship. This court hath therefore grants Letters of Administration (with the said will annexed) of all and singular the personal estate and effects of the said Eliza Creer, deceased to Anna Corlett, widow, a daughter of the deceased and accordingly she is sworn well and truly to administer the said estate and effects of the said deceased in terms of her will hereto annexed and according to law - by paying the just debts, funerals and testamentary expenses of the said deceased and the legacies contained in her said will so far forth as her estate and effects will thereto extend and the law bind her. And to return to the Episcopal Registry of this Diocese of Sodor and Mann a full true and perfect inventory of all and singular the said estate and effects with an accurate account of her administration thereof when thereunto lawfully required. And to these ends she hath given pledges namely William Shimmin of Douglas in the parish of Braddan and Henry Kellett of Douglas in the parish of Braddan who have entered into and executed the usual bond in the presence of the court. Probatum est Decretum est R. Jebb At a court holden at Douglas on the 13th day of March 1905. The annexed paper writing dated the 25th day of April 1874 having been proved on this 22nd day of February 1877 as the last will and testament of Eliza Creer late of the Clypse in the parish of Conchan widow deceased who died on the 23rd day of January 1877 and administration (with her said will annexed) of the personal estate and effects of the said Elizabeth Creer deceased granted to Anna Corlett a widow a daughter of the testatrix and it appearing that the said Anna Corlett hath departed this life without having fully administered the personal estate of the said Eliza Creer deceased. This court hath therefore granted administration de bonis non (with her said will annexed) of the personal estate and effects of the said Eliza Creer deceased to George Alfred Kelly of Woodfield Road Cheadle Hiline in the city of Manchester and accordingly he is sworn well and faithfully to administer the personal estate and effects of the said Eliza Creer deceased so left un-administered as aforesaid in terms of her said will and according to law.
