Lezayre 1878 No. 198 I John Quayle of Narradale in the parish of Kirk Christ Lezayre calling to mind the uncertainty of this mortal life do proceed make and publish this my last will and testament in manner following. First I commend my soul to God and my body to a Christian burial. Secondly I leave and bequeath unto my son John Henry and his heirs and assigns the whole of my lands and premises situate in the said parish of Lezayre part of the quarterland of Shleu(Slieau Managh) Meanagh (meaning Mountain of the monks) and commonly called Bwoailly glass to come into possession thereof upon his attaining the age of thirty years. Thirdly I leave and bequeath unto the whole of my other children born or unborn the sum of two hundred pounds each as legacy to become payable (without interest) at the death or intermarriage of my wife but in the event of any or either of my said children departing this life before being paid or having received the aforesaid legacy and without leaving lawful issue to claim the said legacy then and in that case such legacy or legacies is to be equally divided share and share alike amongst the survivors or survivor of my said children and further my will is that should my said wife as widow at any time hereafter intermarry with another husband then and in that case my said children is immediately after such marriage to become entitled to the whole of their respective legacies as aforesaid and the issues and profits thereof any thing herein stated to the contrary notwithstanding and further my will and mind is that if my executrix hereinafter named will at any time see fit to pay the whole or a portion of the said legacies to any of my children during her life time she my said executrix is at full liberty to do so and the receipt for the same will be a good and sufficient legal discharge for such legacy in any portion thereof. Lastly I leave unto Eleanor Margaret Quayle formerly Cowley my wife those lands and premises called Bwoailey Glass as foresaid until my son John Henry shall attain the age of thirty years unless she intermarries as aforesaid and I do further nominate, constitute, ordain, and appoint my aforesaid wife my whole and sole executrix and residuary legatee of all the rest and remainder of my goods chattels, invoices, credits, and effects of whatever kind nature or description whatsoever or wheresoever. And I do hereby revoke all and every former will or wills made or executed by me in testimony whereof I have hereunto subscribed my name or mark to my name this the twelfth day of June one thousand eight hundred and seventy six 1876. John Brew Robert Cowley At a Chapter Court held at Ramsay on the 25 day of October 1878 John Brew and Robert Cowley the subscribing witnesses to the execution of the foregoing paper writing purporting to be the last will and testament of John Quayle of Narradale in the parish of Lezayre ---------- the testator who died on the 3 day of September 1878 ------ made oath on the Holy Evangelists that the testator John Quayle and when of sound and disposing mind memory and understanding and after the same had him read over to him duly executed and acknowledge the same as and for his last will and testament in the presence and that they at the same time in the presence of the testator at his request and in the presence of each other did then and there subscribe their names as attesting witnesses thereto. Eleanor Margaret Quayle the relict of the deceased widow the executrix of the said will named is therefore sworn well and truly to fulfil and execute the same and to --- ----- all and singular the personal estate of the deceased according to law by paying the just debts funeral and testamentary expenses of the deceased and the legacies ------- in his will so far forth as his estate and effects will thereto extend and the law bind her and to return unto the Episcopal Registry of the Diocese of Sodor and Mann a true and perfect inventory of the said estate with an accurate account of her acts and proceedings in the premesis when thereunto lawfully required and to that end she hath given pledges namely Mary Goldsmith of Ramsey and Robert Cowley of Ramsey who have executed the usual bond in the presence of the court. Probatums Est R. Jebb. Whereas the Eccl Court of this Isle and Diocese of Sodor and Mann that this day granted probate of the will of John Quayle late of Narradale in the parish of Lezayre deceased, to Eleanor Margaret Quayle the widow and executrix named in the will. And whereas, Henry Goldsmith of Ramsey in the parish of Lezayre and Robert Cowley of Ramsey in the parish of Maughold have agreed to become pledges for the due and faithful administration of the said Estate by the said Eleanor Margaret Quayle according to Law. Now Know all Men by these Presents, that we, the said Henry Goldsmith and Robert Cowley hereby bind and oblige ourselves, jointly and severally, and our Heirs, Executors, and Administrators, firmly these presents, as pledges for the said Eleanor Margaret Quayle that she shall well and truly administer, all and singular, the Personal estate and Effects of the said deceased according to Law. And in her default we bind ourselves and each of us, our Heirs, Executors, and Administrators, to be answerable and responsible for the whole of the said Court, and to all parties interest in the said Estate and Effects, of the administration thereof, in the place and stead of the said Eleanor Margaret Quayle. Witness our subscriptions, this 25th day of October in the Year of our Lord One Thousand Eight Hundred and Seventy Eight. At a Chapter Court, held at Ramsey on the 25th day of October 1878.
