Malew 1880 No 208 Whereas Mary Shimmin widow of William Shimmin of Grenaby in the parish of Malew and who died on the 20th May 1880 by her will dated the 1st December 1874 and of which will probate was granted on 24th December 1880 to her daughters Ellinor and Jane Maria devised to her son Edward Shimmin the lands and premises of "Thalloo ne gooie" in the parish of Malew which were devised to her under the will of her husband the said William Shimmin and in such will fully described but subject to the payment of the said Edward Shimmin of a sum of three hundred and twenty pounds to his sisters the said Ellinor and Jane Maria Shimmin. Now these presents witness that the said Ellinor Shimmin and Jane Maria Shimmin do respectively acknowledge to have received from the said Edward Shimmin the said sum of three hundred and twenty pounds and they do therefore for themselves and their respective executors and administrators acquit and discharge the said Edward Shimmin his heirs executors, administrators, and assigns and the said lands and premises from any charge or liability in respect thereof. In witness whereof they have subscribed their names this 25th day of February 1913. Elenor Shimmin Jane Maria Shimmin Witnesses by Charles H. Bickerstaff At Castletown 26 Feb 1913 Whereas William Shimmin of the Ballabeg and Grenaby in the parish of Malew (now deceased) and Mary his wife did by sale in trust by them made and executed and bearing date the 8th day of June 1867 for the considerations and trusts therein declared sell and convey to James Kewley of Castletown and John Duggan of the parish of Arbory all their estate lands houses and premises of Grenaby the Ballaby Stockfield and Thalloo ne glooie(the Thalloo ne glooie in the said deed particularly described in the said parish of Malew and the Island called Kitterland in the parish of Rushen and also the one half of that Water Corn Mill with the appurtenances and machinery situated in this parish of Malew called and known as Grenaby Mill to have and to hold unto the said James Kewley and John Duggan and the survivor of them and the heirs and assigns of such survivor upon the trusts uses intents and purposes in the said Deed declared. An whereas among the several trusts in and by the said deed created and declared a power of appointment is provided and given to the said Mary Shimmin and to be exercised by her of a sum of seven hundred pounds for the trusts and purposes in the said deed mentioned and provided. And whereas the said James Kewley and John Duggan and the survivor of them and the heirs and assigns of such survivor and in and by the said deed authorized and empowered under and upon the direction and appointment of the said Mary Shimmin (she having survived the said William Shimmin and continued a widow in his name ) by will or deed by her made and executed to raise by way of mortgage or security upon the said estate lands and premises (upon the death of the said Mary Shimmin) called Thalloo ne glooie Grenaby Stockfield Mill and Island of Kitterland in of such parts of them as they may see fit a sum of six hundred pounds and upon the said lands houses and premises of the Ballaby a sum of one hundred pounds making together the said sum of seven hundred pounds and pay and apply the same in such way and manner and to such person or persons as the said Mary Shimmin shall in and by her last will and testament or otherwise in writing direct and to bear interest at the rate of five per centum per annum from the time that William Shimmin Junior and Edward Shimmin children of the said William Shimmin and Mary Shimmin shall severally be entitled to possess the said several lands, Mill, Island, and premises under the trust of the said Deed of the 8th day of June 1861 as by the said Deed duly recorded will appear. And whereas the said Mary Shimmin is desirous of making her will and of exercising the power of appointment of the said sum of seven hundred pounds -------------- to her in the said deed of the 8th June 1861. The said Mary Shimmin do therefore make my will and appointment of the said sum of seven hundred pounds sterling so reserved to me in and by the said deed of the 8th day of June 1861 in manner following, that is to say. I leave bequeath and appoint the said sum of seven hundred pounds above mentioned to my daughters Ellinor Shimmin and Jane Maria Shimmin in trust for the purposes hereinafter mentioned and expressed and I do will appoint and direct that the said James Kewley and John Duggan and the survivor of them and the heirs and assigns of such survivor shall and will at my decease or so soon afterwards as conveniently can be raised by way of mortgage or security of the said several lands houses and premises mill and island of Kitterland or such parts of them as they may see fit the said sum of seven hundred pounds sterling and interest thereon at the rate of five per centum per annum from the day of my death in terms of the said Trust Deed the 8th day of June 1861 and hand over the same to the said Ellinor Shimmin and Jane Maria Shimmin deducting there from all their legal charges and some compensation for their trouble in and about the premises - the receipt of the said Ellinor Shimmin and Jane Maria Shimmin to be a guarantee and full discharge to the said James Kewley and John Duggan and the survivor of them and the heirs and assigns of such survivor for the same. I also leave and bequeath to the said Ellinor Shimmin and Jane Maria Shimmin in trust as aforesaid a sum of three hundred pounds owing by my son Edward Shimmin to me under an agreement and sale to him of the stock and crop and farming implements to me belonging on the said several lands and premises aforesaid bearing date the 9th day of May 1872. I also leave and bequeath to the said Ellinor Shimmin and Jane Maria Shimmin in trust as aforesaid a sum of three hundred and twenty pounds and which my said son Edward Shimmin is hereby required and directed to pay to them as the consideration for the bequest of the lands and premises of Thalloo ne glooie herein and hereby made to him - the said several sums of seven hundred pounds three hundred pounds and three hundred and twenty pounds making together total sum of thirteen hundred and twenty pounds sterling the whole of which I leave to the said Ellinor Shimmin and Jane Maria Shimmin in trust for themselves and their three sisters hereinafter named to be paid and applied by them as hereinafter directed. I leave devise and bequeath to my said son Edward Shimmin all and singular those lands and premises called Thalloo ne glooie (not the Thalloo ne glooie in the said Deed of the 8 June 1862 conveyed to the said James Kewley and John Duggan) bequeathed to me in and by the will of my said husband William Shimmin bearing date the said 8th day of June 1861 and which lands and premises are in and by the said will fully particularly described to have and to hold unto the said Edward Shimmin his heirs and assigns with the hereditaments and appurtenances to the same belonging from the day of my death forever in consideration of and for such bequests the said Edward Shimmin his heirs and assigns shall pay to the said Ellinor Shimmin and Jane Maria Shimmin the said sum of three hundred and twenty pounds but he shall not be compelled to pay the same until end expiration of six calendar months from the day of my death on his refusing or declaring to pay the said sum of three hundred and twenty pounds as before directed the said bequest of the said lands of Thalloo ne glooie to him is hereby cancelled and the said lands are hereby devised to the said Ellinor Shimmin and Jane Maria Shimmin in trust for themselves and their said three sisters before named. It is my will and I do hereby direct that the said Ellinor Shimmin and Jane Maria Shimmin so soon as they shall received the said sum of thirteen hundred and twenty pounds and interest and any other property goods and effects that they may be entitled to and received under this my will shall and will present and making an equal division of the same in five equal shares and after deducting there from all my lawful debts and testamentary expenses take and have one each of such five shares to and for themselves and pay and apply the others three shares to my said daughters Isabella Mary Eliza and Emily Louisa Shimmin. And I do will and direct that all and every the goods property moneys and effects that my said five daughters Ellinor, Jane Maria, Isabella Mary, Eliza and Emily Louisa may received or be entitled to under this my will shall be for their and each of their exclusive use and benefit and shall not be liable to the debts of claims or upon any husband then they may either of them may marry their direction as to the same and the application hereof to be legal notwithstanding coveriture. Lastly I do hereby leave and bequeath all the rest of my property goods and effects moveable and immoveable and wheresoever the same may be to the said Ellinor Shimmin and Jane Maria Shimmin in trust of themselves and their said three sisters Isabella Mary, Eliza, and Emily Louisa before named. And I do hereby appoint the said Ellinor Shimmin and Jane Maria Shimmin executrixes and trustees for the purposes aforesaid of this my will according to law. And I do hereby revoke and render null and void all or any will or wills by me heretofore made. In testimony whereof I have hereunto subscribed my name this first day of December one thousand and eight hundred and and seventy four.
